AN ORDINANCE GRANTING A VARIANCE Wl rH RESPECT TO 'rHE_ USE OF
CERTAIN PROPERTY IN THE CITY OF JACKSONVILLE, ARKANSAS;
AMENDING ORDINANCE NOS.•213.AND 238 OF THE CITY OF JACKSONVILLE,
ARKANSAS- DECLARING AN EMERGENCY, AND FOR OTHER PURPOSES.
WHEREAS, a request has been filed for a variance of certain property
within the City of Jacksonville, Arkansas and public notice has been duly pub-
lished in the Jacksonville Daily News, a newspaper having authority to publish
notice, in the time and manner required by law; public hearings have been held
pursuant to public notices and at the time and place set therefor; that the Planning
Commission has considered said request and has made the recommendation that
the variance requested be granted as hereinafter indicated.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF JACKSONVILLE, ARKANSAS, That:
SECTION 1. That the owners of the following described property are
hereby granted a variance in use so that the following described property may be
used for all uses permitted by the R -4 mobile home. district classification estab-
lished by Ordiance Nos. 213 and 238 of the City of Jacksonville, Arkansas, said
property being more particularly described as follows, to -wit:
Part of the North one -half (N1/2) of the Northeast Quarter (NF'/4) of Sec-
tion 24, Township 3 North, Range 11 West, and Part of the South one -half (S1
of the Southeast Quarter (SE'/) of Section 13, Township 3 North, Range 11 West,
Pulaski County, Arkansas, more particularly described as follows:
Starting at the center of Section 13, T -3--N, R -11 -W; thence S 00 deg.
54' W, 441 .5 feet; thence 5 88 deg 28' E, 2410.6 feet; thence S 01 deg. 32' W,
410.0 feet; thence 5 88 deg. 28' E, 356.3 feet to the westerly right of way line
of Marshall Road; thence 5 09 deg. 08' W, along said westerly right of way line
of Marshall Road, 1395.8 feet to the point of beginning; thence continue 5 09 deg.
08' W, 1010.0 feet; thence N 88 deg. 24' W, 1799.0 feet; thence N 1 deg. 34' E,
220.5 feet; thence N 88 deg. 24' W, 100.0 feet; thence N 01 deg. 34' E, 779.5
feet; thence S 87 deg. 52' 20" E, 2032.1 feet to the point of beginning, containing
45.1 acres, more or less.

SECTION 2. Said property owners having represented that the R-4
use granted by this variance shall be. of a temporary nature, said variance shall
be subject to review by the City Council of the City of Jacksonville, Arkansas
years from the date hereof.

SECTION 3. That all ordinances or parts of ordinances in conflict
herewith are hereby repealed to the extent of any such conflict.
SEC'T'ION 4. This ordinance being necessary for the immediate- pre-
servation of the public health, safety, welfare and morale of the citizens of the
City of Jacksonville, Arkansas, an emergency is hereby declared to exist and
this ordinance shall have full force and effect immediately after its passage.
