ORDINANCE NO. 07
AN ORDINANCE PROVIDING FOR THE ANNEXATION TO THE CITY OF JACK-
SONVILLE, ARKANSAS, OF CERTAIN LANDS LOCATFa) IN PULASKI COUNTY,
ARKANSAS; DECLARING AN EMERGENCY TO EXIST AND FOR OTHER PURPO-
SES.
WHEREAS, the lands described hereinafter have been determined to rep-
resent the actual growth of the City of Jacksonville, Arkansas beyond its legal
boundary;
WHFZREAS, said lands are needed by the City of Jacksonville, Arkansas
for the extension of needed police regulation, for improving the adaptability of
certain industrial property for further growth and development, for prospective
municipal parks and recreation areas and for other purposes;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF JACKSONVILLE, ARKANSAS, that:
Section 1. That the City of Jacksonville, Arkansas, acting through its
City Council, does hereby approve and accept for annexation and does hereby
make a part of the incorporated area of the City of Jacksonville, Arkansas, the
following described real property, to -wit:
(1) That portion of Section 31, Township 3 North, Range 10 West,
south and west of F3ayou Meto, south and east of the Missouri Pacific
Railroad right of way and north and west of State Highway 161;
(2) that portion of Section 36, Township 3 North, Range 11 West,
south and east of the Missouri Pacific Railroad right of way and
north and west of State Highway 161 less and except the following
described property: (a) Starting at the Northeast corner of Section
36, Township 3 North, Range 11 West; thence along the east line of
Section 36 on a bearing of South 1 degree 50 minutes West, a distance
of 1,013.0 feet to a point in the center of the north or west track of
the Missouri Pacific Railroad, which point is located 81.0 feet from
We west abuttment of Missouri Pacific Railroad Bridge No. 467,
measured on the same bearing as the railroad track; thence turning
an angle to the right of 54 degrees 23 minutes with a bearing of South
56 degrees 13 minutes West along said center line of the railroad
track a distance of 2,494.2 feet to a point; thence turning an angle
to the left of 86 degrees 20 minutes with a bearing of South 30 degrees
07 minutes East a. distance of 50.15 feet to a point of beginning on the
south right of way of the railroad. From the point of beginning, for-
merly known as the northeast corner Lot 28, "Cloverdale Gardens"
(unrecorded) continue on the bearing of South 30 degrees 07 minutes
east, a distance of 1,164.9 feet to a point formerly known as the
southeast corner Lot 28, "Cloverdale Gardens "; thence turning an
angle to the right of 79 degrees 49 minutes with a bearing of South
49 degrees 42 minutes West, a distance of 671.8 feat to a point formerly
known as the southwest corner Lot 29, "Cloverdale Gardens "; thence
turning an angle to the right of 91 degrees 33 minutes with a bearing
of north 38 degrees 4 minutes West, a distance of 1,244.6 feet to a

point formerly known as the northwest corner Lot 29, "Cloverdale
Gardens "; thence turning an angle to the right of 94 degrees 58
minutes with a bearing of North 56 degrees 13 minutes East, a dis-
tance of 850.0 feet to the point of beginning, said plot comprises
some 21.0 acres, more or less; (b) commencing at the northeast
corner of said Section 36; thence South 01 degree 50 minutes West
along the East line of Section 36, 1,013.0 feet to a point in the
center of the Missouri Pacific Railroad right of way, said point
being located 81.0 feet from the West abuttment of Missouri Pacific
Railroad Bridge No. 467; thence South 56 degrees 13 minutes West
along said center line of Missouri Pacific Railroad right of way 2,494.2
feet; thence South 37 degrees 07 minutes East, 50.15 feet to the
southerly line of said railroad right of way; thence South 56 degrees
13 minutes Wes feet along said southerly right of way line to
the point of beginning; thence South 38 degrees 45 minutes Fast,
1,244.6 feet; thence South 49 degrees 42 minutes West, 680.0 feet,
thence North 38 degrees 39 minutes West, 1,321.2 feet to the southerly
right of way line of Missouri Pacific Railroad; thence North 56 degrees
13 minutes East along said southerly right of way line, 680.0 feet to
the point of beginning, containing 20.0 acres, more or less; (c) that
portion of the Southwest 1/4 of the Southwest 1/4 lying South and
East of the Missouri Pacific Railroad right of way;
(3) beginning at the intersection of the east line of the Southwest 1/4
of the Southwest 1/4, Section 36, Township 3 North, Range 11 West
with the south and east right of way line of the Missouri Pacific
Railroad, thence southeasterly along said right of way line to its
intersection with the south line of' the Northeast 1/4 of the Northeast
1/4 of the Northeast 1/4, Section 2, Township 2 North, Range 11
West, thence south on the east line of the Southwest 1/4 of the North-
east 1/4 of the Northeast 1/4 a distance of 300 feet; thence north-
easterly parallel to the south and east right of way line of the Missouri
Pacific Railroad to the east line of the Southwest 1/4 of the Southwest
1/4, Section 36, Township 3 North, Range 11 West; thence north on
said east line 300 feet to the point of beginning;
(4) the Southwest 1/4 of the Northeast 1/4 of the Northeast 1/4, and the
Southeast 1/4 of the Northwest 1/4 of the Northeast 1/4, Section 2,
Township 2 North, Range 11 West;
() beginning at the intersection of the south line of the Southeast 1/4
of the Northwest 1/4 of the Northeast 1/4, Section 2, Township 2
North, Range 11 West with the north and west right of way line of
the Missouri Pacific Railroad; thence southwesterly along said right
of way line to the southwest corner of Section 2, Township 2 North,
Range 11 Wept; thence north along the west line of Section 2, Town-
ship 2 North, Range 11 West a distance of 300 feet; thence northeasterly
parallel to the north and west right of way line of the Missouri Pacific
Railroad to the south line of the Southeast 1/4 of the Northwest 1/4
of the Northeast 1/4, Section 2, Township 2 North, Range 11 West;
thence east along said south tine 300 feet to the point of beginning;
(6) a portion of Section 1, Township 2 North, Range 11 West, more
particularly described as follows: beginning at the northeast corner
of the Northwest 1/4 of the Northwest 1/4, Section 1, Township2
North, Range 11 West; thence south along the east line of the North -
wes t 1/4 of the Northwest 1/4 850 feet; thence south 87 degrees 25
minutes east 769.4 feet more or less to Cloverdale Road; thence
southwesterly along Cloverdale Road to the southwest corner of

Arkansan; thence south 38 degrees 19 minutes east 19 feet to

north 28 degrees 31 minutes east 544.0 feet to the northeast corner
of Chastain's Gardens Subdivision; thence north 53 degrees 30
minutes east 205.0 feet; thence 36 degrees 30 minutes west 75.0

and west right of way line of Stat e Highway 161; thence north-

Highway 161 and south of Bayou Meto;
(12) that portion of the Northeast 1/4 of the Southwest 1/4, Section
31, Township 3 North, Range 10 West, lying south of Bayou Mato;
(13) that portion of the Southeast 1/4 of the Southeast 1/4, S
36, Township 3 North, Range 11 West, lying south and east of State
Highway 161;
(14) part of the SE 1/4 of the NW 1/4 and part of the NE 1/4 of the
SW 1/4 of Section 31, Township 3 North, Range 10 West, Pulaski
County, Arkansas, lying north of Bayou Meto and more particularly
described as follows: Beginning at a point on the East line of the
NE 1/4 of the SW 1/4 of said Section 31, 50 feet, more or less,
south of the NE corner thereof; thence South 40.8 feet along said
East line; thence 5 40 degrees 27 minutes 30 seconds West 550
feet, more or less, along a line 410 feet southeast of and parallel
to the centerline of Highway *161 to the center of Bayou Meto;
thence Westerly along the center of Bayou Meto to the Southerly
right of way line of Highway *161; thence North 40 degrees 27 minutes
30 seconds E 800 feet, more or less, along said right of way tine;
thence S 49 degrees 32 minutes 30 seconds E 313.5 feet, more or
less to the point of beginning, the tract containing 5.5 acres, more
or less; and

(15) part of Section 31, Township 3 North, Range 10 West,
Pulaski County, Arkansas, more particularly described as
follows, to-wit: commence at the point of intersection of the
south city limits of the City of Jacksonville, Arkansas and the
west right of way line of Arkansas State Highway #161; thence
in a westerly direction along the south city limits line of the
City of Jacksonville, Arkansas to the point of intersection with
the centerline of Bayou Meto; thence in a southeasterly direction
along the centerline of said Bayou Meto Creek to the point of in-
tersection with the westerly right of way line of Arkansas State
Highway #161; thence in a northeasterly direction along said high-
way right of way line to the point of beginning.
Section 2. That in compliance with the provisions of Act 298 of 1971, a
special election shall be held on the . 18 1 day of I`
197Swithin the City of Jacksonville, Arkansas, and within the area above des-
cribed to determine whether or not said area should be annexed to the City of
Jacksonville, Arkansas.
Section 3. That the City of Jacksonville, Arkansas shalt extend city
fire, police and garbage services to the above described area within three
years of its being annexed to the City of Jacksonville, Arkansas and such other
services as may from time to time become feasible.
Section 4. That it is further ordained that the aforesaid lands be and
they are hereby assigned and attached to and made a part of Ward of
the said City of Jacksonville, Arkansas.
Section 5. it is hereby found and determined that the enactment of this
ordinance is immediately necessary for the purpose of bettering the health,
welfare and protection of the citizens of Jacksonville, Arkansas and an emergency
is hereby declared to exist and this ordinance shall take effect immediately upon
its passage and approval.
