WHEREAS, L.H. Griffin Company, a corporation, is the owner
of the following described real property, to-wit:
TRACT B
A parcel, of land in the NWT NE4 and the NE4 NA, Section
30, Township 3 North, Range 10 West, Pulaski County,
Arkansas, more particularly described as follows: Start-
ing at the northwest corner of NW%4 NFL, said Section 30;
thence South 2 degrees 11 minutes West, 236.11 feet; thence
North 87 degrees 149 minutes West, 9.144 feet to a point on
James Street west right- of-way :Line, said point being the
point of beginning for the parcel described herein; thence
North 12 degrees 141 minutes East, 119.57 feet to a point of
curvature of a curve to the left with a .radius of 386.29
feet; thence northerly along an arc on said curve having a
chord distance of 130.25 feet to a point on the southerly
right -of -way lino of West Main Street, said point being
South 2 degroes 11 minutes West, 57.10 feet and South 87
degrees 149 minutes East, 1.140 feet from the northwest cor-
ner of NA NFMj thence South 87 degrees 149 minutes Fast
3.38 feet along the south right -of -way 'Tine of West Main
Street to a point on the existing west right -of -way line
of Dupree Drive; thence South 23 degrees 33 minutes East
along said existing Dupree Drive west right --of -way line,
58.15 feet to point of intersection with existing west
right -of -=way line of James Street; thence following said
existing West James Street right -of -way line along a curve
to the right with a radius of 80.0 feet, an are distance
of 87.15 feet to a point of curvature; thence continuing
along said existing Jamos Street west right- of-way line
South 38 degrees 52 minutes West 37.5 feet to point of
tangency of a curve to the left with'a radius of 150 feet;
thence continuing along existing James Street west right -
of -.way line southwesterly slung said curve, an arc distance
of 16.72 feet to the point of beginning, containing 3,62.5
square feet, more or less, measured by planilneter,
and is willing to convey the same to the City of Jacksonville for use
as a street and to pay the City of Jacksonville the sum of .$2,000
in cash upon the following conditions:
That the City of Jacksonville
(a) will pave and grade a permanent curb cut from James Street
to the Safeway store site over the following described real property,
to -wit:

Starting at the northwest corner NW's N1% - Section 30,
Township 3 North, Range 10 West, Pulaski County, Arkansas;
thence South 2 degrees 11 minutes West along the west line
of NA NF3 .F, 337.25 feet to a point; thence North 87 de-
grees 49 minutes West 22.82 feet to a point on the proposed

west right- of-way line of James Street; thence Northerly
along a curve having a radius of 432.29 feet, and defin-
ing the proposed west right -of -way of James Street, an
are distance of 67.21 feet to a point of tangency with a
line bearing North 12 degrees 41 minutes Rant; thence con-
tinuing along proposed west right-of -way line of James
Street North 12 degrees 41 minutes East, 49.06 feet to the
point of beginning of a line segment described herein;
thence continuing North 12 degrees 41 minutes .Fast along
proposed west right -of -way line of James Street, 20.34 feet
to a point on the projected center line of Dupree Drive;
thence continuing North 12 degrees 41 minutes East along
proposed west right-of-way line of James Street, 14.73
feet to a point of curvature on a curve to the left with
a radius of 386.29 feet; thence continuing along proposed
westerly right -of -way line of James Street, northerly along
said curve, an arc distance of 5.60 feet to the point of
termination of the line segment described herein, said seg-
ment intended to extend 20.0 feet each side at right angles
to a projection of the center line of proposed Dupree Drive.
(b) Will permanently close and vacate as a street and perman-
ently place in the possession of Griffin Realty Company, inc.,
for ear parking purposes, the following described real property,
to wit:

degrees 49 minutes West, 22.82 feet to the point of be-
ginning for the parcel described herein, thence continue
North 87 degrees 49 minutes West, 7.18 feet to a point on
existing James Street west right-of-way lino; thence North:
2 degrees 11 minutes :East along said existing west right-
: of-may Line, 25.2 feat to a point of curvature of a curve
to the right with a raaus of 150 feet; thence continuing
along existing James Street westerly right -of -way line,
north - northeasterly along said curve, anarc distance of
79.32 feet to a point, being South 2 degrees 11 minutes
West, 236.40 feet and North 87 degrees 49 minutes West,
9.44 feet from the northwest corner NW NEr`'.L, said Section
30; thence South 12 degrees 41 minutes West 34.56 feet to
a point :,of curvature with a curve to the left having a
radius of 432.29 feet; thence Southerly along said curve,
an arc distance of 67.21 feet to the point of beginning,
containing 850 square feet, more or less, measured by
pl.animeter.
(c) Will build and permanently maintain a retaining wail
along the east side of said Tract flan; and
(d) The deed to he executed by t.11. Griffin Company shall
contain a reverter clause providing for reversion to grantor in
the event there is any failure on the part of the City of Jack -
sonville to comply with conditions (a), (b) and (c) above; and

WHEIIEAZ, it is deemed that it is to the advantage of the
City of Jacksonville to accept the said offer of L.H. Griffin
Company on the conditions hereinabove set forth:
NOW, THEREFORE, BE IT ORDAINED BY THE C.Ln COUNCIL OF 'AWE
CITY OF JACKSONVILLE, ARKANSAS, that:
Section 1. Upon the execution and filing of a deed by L.H.
Griffin Company which conveys to the City of Jacksonville for use
as a street, Tract nBn, as hereinabovo described, the City of
Jacksonville shall pave and grade and maintain a permanent curb
cut on Tract nCn, as horeinabove described; shall cause to be le-
gally and permanently closed and vacated with the right to perman-
ent possession in L.H. Griffin Company, its successors and
assigns, for car parking purposes, the real property described
in Tract nAn, as hereinabovo described; and shall.. build and perman-
ently maintain a retaining call along tho east side of said
Tr'ac't Mu.
Section 2. This ordinance being necessary for the immediate
preservation, improvement of the public peace, health, safety and
morals of the City of Jacksonville, Arkansas, an emergency is
hereby declared to exist; and this ordinance shall be in fuil
force and effect from and after its passage and approval.
