0189 la 1 ORDINANCE NO. 1 ( q AN ORDINANCE OF THE CITY OF JACKSONVILLE, ARKANSAS, PROVIDING A POLICY FOR SICK LEAVE AND ANNUAL LEAVE, PROVIDING A SAVINGS CLAUSE, REPEALING ALL ORDINANCES IN CONFLICT HEREWITH AND DECLARING AN EMERGENCY. WHEREAS, there is no established policy governing sick leave, annual leave and vacations for certain employees of the City of Jacksonville, Arkansas; and WHEREAS, the health, welfare and morale of said City employees has been adversely affected by said situation; NOW, THEREFORE, HE IT ORDAINED BY THE CITY COUNCIL OF JACK- SONVILLE, ARKANSAS, that: Section 1. That from and after the passage and approval of this ordinance, the responsibility for management of leave privi- leges and enforcement of leave regulations for employees of the City of Jacksonville has been delegated as follows: A. The Mayor is responsible for administration of the leave regulations and leave policies and for advising department heads, supervisors and other employees in leave matters. B. The department heads are responsible for establish- ing vacation schedules, for approving applications for all types of leave, and for determining the type of leave which shall be granted in accordance with the leave regulations. C. All leave records shall be kept and maintained in the office of the Mayor and shall reflect actual accrued annual and sick leave and the Mayor's office shall properly record on each employee's leave record the type of leave granted or used by every employee, and this leave shall be charged immediately on the leave record card of each employee upon the receipt of the leave application executed by the City employee and approved by the department head. Section 2. All permanent City employees hired after February 1, 1967, shall accrue sick leave with pay at the rate of one 8 -hour work day per each calendar month of continuous employment. Any person being employed by the City prior to February 1, 1967, shall have entered on his record an accrued amount of sick leave equal • to one 8-hour day for each calendar month of continuous employ- ment, but said entry shall not exceed sixty (60) working days. No employee shall be permitted to use sick leave benefits until said employee shall have had three (3) months of continuous employment. Sick leave shall accrue, if not used, to a maximum of ninety (90) working days. Sick leave shall be used for illness of the employee only, and any employee absent from work for any other reason shall have this lost time deducted from his regular pay or applied to his annual leave. Any employee failing to report to work because of illness shall notify his immediate supervisor or department head. Said supervisor or department head shall notify the Mayor's office of each day of absence by the employee and the reason for said ab- sence. Any employee being absent from work because of illness three (3) consecutive days shall submit a statement from his doc- tor to his department head. on the third day of said absence to support sick leave application. Section 3. All permanent employees shall be entitled to five (5) regular working days of annual leave with pay after one (1) year of continuous employment. All permanent employees shall be entitled to ten (10) regular working days of annual leave with pay after two (2) years of continuous employment. No employee shall be entitled to more than ten (10) regular working days of annual leave regardless of his length of employment. All employees shall notify their department head between January 1st and March 31st of each year of the date that they wish to take their annual leave. Section 4. Sick leave and annual leave shall apply to perma- nent employees only, and shall not apply to part -time or temporary employees or to elected officials. Section 5. In addition to the foregoing, the City of Jack- sonville will observe the following legal holidays: r e • • New Year's Day January 1 Washington's Birthday February 22 b Memorial Day May 30 Independence Day July 4 Labor Day 1st Monday in September Thanksgiving Day (2 days) 4th Thursday Sc. Friday in November Christmas Day December 25 Section 6. The provisions of this Ordinance are intended to be separate and severable, and the holding of any portion hereof to be invalid, shall not affect the other portions. Section 7. All ordinances inconsistent with the provisions of this Ordinance shall be, and the same are hereby repealed. Section $. That this Ordinance being necessary for the imme- diate preservation of the public health, safety, welfare and morale of the citizens of the City of Jacksonville, Arkansas, an emergency is hereby declared to exist and this Ordinance shall have full force and effect .immediately after its passage.
