AN ORDINANCE AUTHORIZING MAYOR AND CITY CIERK TO ALTER
TERMS OF CONTRACT WITH ARKANSAS POWER AND LIGHT COMPANY
AUTHORIZED UNDER ORDINANCE NO. 175.
WHEREAS, Arkansas Power & Light Company's Municipal
Street Light Service Rate Schedule Ll has been revised
since the adoption of Ordinance No. 175; and
WHEREAS, Said revision now provides a reduction in
the term of contract from five years to one year, with
automatic year to year renewals, unless terminated by
written notice as provided therein; and
WHEREAS, the City Council of the City of Jacksonville,
Arkansas, did on the 6th day of July 1966, authorize the
execution of the original contract by the Mayor and City
Clerk for a period of five year$; and
WHEREAS, the reduction from a term of five years to
one year is a material variance from the authority given
in Ordinance 175; and
WHEREAS, it is now necessary to authorize the Mayor
and City Clerk to amend the original agreement referred to
in Ordinance No. 175;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL that
the Mayor and City Clerk be and they are hereby authorized, em-
powered and directed to make and enter into a contract for
and on behalf of the City of Jacksonville with the Arkansas
Power & Light Company, which contract shall be substantially
the same as that authorized by Ordinance No. 175, and executed
on the 7th day of July, 1966; except that Section 8 of said
Agreement shall have the following wording:
"8. The term of the agreement shall be from
July 7, 1966, to July 7, 1967, and shall be auto-
matically extended for successive periods of one
year each antil terminated by written notice given
by one party to the other not more than six months,
nor less than three months, prior to the expiration
of the original term or any extension thereof."
That a copy of the letter altering the terms of the
Agreement shall be attached hereto and made a part hereof.
