0173 ORDINM CE NO. 171_ AN ORDINANCE PROVIDING FOR THE SUBMISSION TO THE QUALIFIED ELECTORS OF THE CITY OF JACKSONVILLE, ARKANSAS, THE QUESTION OF LEVYING AN ANNUAL TAX OF ONE -RALF MILL ON THE DOLLAR UPON Tiir,' ASSESSED VALUE OF THE REAL AND PERSONAL PROPERTY WITHIN THE CITY FOR TIP: PURPOSE OF ESTABLISHING THE POLICEMEN'S PENSION AND RELIEF POND IN ACCORD - ANCE WITH ACT 250 OF 1937, AND AMENDMENTS THE ETO, OF THE GETERAL ASSEMBLY OF THE STATE OF ARKANSAS. WHEREAS, the City of Jacksonville, Arkansas, Is a city of the first class and is authorized by Amendment 31 to the Constitution of the State of Arkansas to levy an annual tax of not to exceed one mill on the dollar upon the assessed value of all :real and perao nal property within such city for the purpose of paying paying policemen retirement pensions and pensions to the widows and minor children of deceased policemen and widows and minor children of deceased retired policemen; and, WHEREAS, a Judiciously administered pension fund would be a potent agency for securing mad retaining the aorviceas of a most faithful and efficient class of men connected with a department of municipal service in which every property owner and resident of this city is most vitally interested; and, WHEREAS, a petition containing more than four hundred signatures of qualified electors of such city, evidencing their Interest in the establishment of such a pension and relief fund, has been presented to the City Council; and AREAS, it is the opinion of the members of the City Council of the City of Jacksonville, Arkansas, that it is for the best interest of the City of Jacksonville, Arkansas, that such a pension and relief fund be established, NOW, THEREFORE, BE IT ORDAINED SY THE CITY COUNCIL OF TSS CITY OF JACKSONVILLE, ARKANSAS: SECTION L. That there shall be submitted to the qualified electors of the City of Jacksonville, Arkansas, at a special election to be held on the 12 day of July , 1966, mha question of the levy of an anneal tax of one -half mill on the dollar upon the assessed value of all real and personal property within the city for the purpose of paying pensions to retired policemen, and pensions to widows and minor children of deceased policemen and widows and minor children of deceased retired policemen. SECTION 2. That the ballot title shall appear as follows: "The Question of Levying an Annual Tax of One -Half Mill on the Dollar of the Assessed Value of the Real and Personal Property within the City dor the Purpose of r Establishing the POLICEMEN'S PENSION AND RELIEF FORD in Accordance with Act 250 of 1937, and Emendmonta Thereto, of the General Assembly of the State of Arkansas." SECTION 3. That the question shall be placed on the ballot for the special election in substantially the foil:wing form: R9oto on measure by placing an "1" in the square beside the measure either for or against: "FOR POLICEMEN'S PENSION AND RSLIEF FORD 0 + "AGAINST POLICEMEN'S P$NOION AND RELIEF FUND SEC ION 4, That the election shall be held and conducted and the vote canvassed and the results declared undet the law and in the manner provided for manic/pa elections, so far as the same may be applicable, and the Mayor shall give notice of such election by an advertisement published once a week for four consecutive weeks in a awupaper haring a bona fide circulation intbe city, with the last publication to be not lose than ten days prior to the date of the election, and only qualified electors of the city shall, have the right to vote at said election on said question. SECTION 5. That the results of said election shall be pro- claimed by the Mayor and his proclamation shall bo published one time in a newspaper having a bona fide circulation in the city, which proclamation shall advise that the results as proclaimed shall be conclusive unless attacked in the courts within tatty (30) days after the data of such proclamation. SECTION 6. That a copy of this Ordinance shall be fmsniehed the Pulaski County Board of Election Commissioners so that the necessary election officials and supplies may be provided. SECTION 7. That in the event of the approval of the tax levy by the qualified electors of the City of daokaonvillo, Arkansas, that such steps be taken as are necessary to comply with the will of the people as expressed in said election.
