0172 • , a V J , 1 ORDINANCE NO. : I ../C- AN ORDINANCE PROVIDING FOR THE SUBMISSION TO THE QUALIFIED ELECTORS OF THE CITY OF JACKSONVILLE, ARKANSAS, THE QUESTION OF LEVYING AN ANNUAL TAX OF ONE -HALF MTT.T, ON THE DOLLAR UPON THE pOSESSED VALUE OF THE REAL AND PERSONAL PROPERTY WITHIN THE CITY FOR THE PURPOSE OF ESTABLISHING THE FIREMEN'S RELIEF AND PENSION FUND IN ACCORDANCE WITH ACT 491 OF 1921, AND AMENDMENTS THERETO, OF THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS. WHEREAS, the City of Jacksonville, Arkansas, is a city of the first class and is authorized by Amendment 31 of the Constitution of the State of Arkansas to levy an annual tax of not to exceed one mill on the dollar upon the assessed value of all real and personal property within such city for the purpose of paying firemen retire- ment pensions and pensions to the widows and minor children of deceased firemen and widows and minor children of deceased retired foremen; and, WHEREAS, a judiciiously administered pension fund would be a potent agency for securing and retaining the services of a most faithful and efficient class of men connected with a department of municipal service in which every property owner and resident of this city is most vitally interested; and, WHEREAS, a petition containing more than four hundred signatures of qualified electors of such city, evidencing their interest in the establishment of such a relief and pension fund, has been presented to the City Council; and WHEREAS, it is the opinion of the members of the City Council of the City of Jacksonville, Arkansas, that it is for the best interest of the City of Jacksonville, Arkansas, that such a relief and pension fund be established, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JACKSONVILLE, ARKANSAS: SECTION 1. That there shall be submitted to the qualified electors of the City of Jacksonville, Arkansas, at a special election to be held on the '" day of , 1966, the question of the levy of an annual tax of one -half mill on the dollar upon the assessed value of all real and personal property within the city for the purpose of paying pensions to retired firemen, and pensions to widows and minor children of deceased firemen and widows and minor children of ##### deceased retired firemen. SECTION 2. That the ballot title shall appear as follows: "The Question of levying an Annual Tax of One -Half li V Mill on the Dollar of the Assessed Value or the Real and Personal Property within the City for the Purpose of Establishing the FIREMEN'S RELIEF AND PENSION FUND in Accordance with Act 491 of 1921, and amendments thereto, of the General Assembly of the State of Arkansas." SECTION 3. That the question shall be placed on the ballot for the special election in substantially the following form: "Vote on measure by placing an "R" in the square beside the measure either for or against: "FOR FIREMEN'S RELIEF AND PENSION FUND "AGAINST FIREMEN'S RELIEF AND PENSION FUND ,C 7 " SECTION 4. That the election shall be held and conducted and the vote canvassed and the results declared under the law and in the manner provided for municipal elections, so far as the same may be applicable, and the Mayor shall give notice of such election by an advertisement published once a week for four consecutive weeks in a newspaper having a bona fide circulation in the city, with the last publication to be not less than ten days prior to the date of the election, and only qualified electors of the city shall have the right to vote at said election on said question. SECTION 5. That the results of said election shall be pro- claimed by the Mayor and his proclamation shall be published one time in a newspaper having a bona fide circulation in the city, which proclamation shall advise that the results as proclaimed shall be conclusive unless attacked in the courts within thirty (30) days after the date of such proclamation. SECTION 6. That a copy of this Ordinance shall be furnished the Pulaski County Board of Election Commissioners so that the necessary election officials and supplies may be provided. SECTION 7. That in the event of the approval of the tax levy by the qualified electors of the City of Jacksonville, Arkansas, that such steps be taken as are necessary to comply with the will of the people as expressed in said election.
