ORDINANCE NO. •> .�
AN ORDII'dANCE ESTABLISHING THE POSITION OF CITY ENGINEER;
PRESCRIBING HIS QUALIFICATIONS, DUTIES, SALARIES; SETTING
OUT OTHER NATTERS RELATING THERETO; DECLARING AN EMERGENCY
TO EXIST, AND FOR OTHER PURPOSES.
WHEREAS, it has become apparent to the members of the
City Council of the City of Jacksonville, Arkansas, that a
qualified engineer' s technical ability and know how are needed
for the ongoing and supervision of sewer and drainage projects,
Inspection of public works, surveying of public grounds,
inspection of sub -divisions, and other purposes; and
WHEREAS, it is necessary for the immediate preservation
of public health, safety, morals and welfare of the citizens of
Jacksonville, that such need be met and corrected;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF JACKSONVILLE, ARKANSAS, THAT:
SECTION 1. That there is hereby created the position of

City Engineer at a salary of d ( l�j
Dollars per year, payable on a twelve-month basis, at the rate of
c-\ Seven Hundred ll %50.00) Dollars per month, payable monthly from
the City Water Department; which sum shall be prorated at the
end of the fiscal year on a percentage basis among the City General
Fund, the Water Department, and such other departments for which
the Engineer shall perform work.
SECTION 2. That tools, equipment, secretarial assistance,
transportation and office space shall be furnished by the City.
That a vehicle, and necessary egpenses in maintaining and
operating such vehicle; together with all equipment, tools, instru-
ments, secretarial assistance and office space, as shall be neces-
sary for the performance of the duties prescribed hereinafter, to
be used.by said City Engineer and/or his department shall. be pro-
vided by and owned by the City of Jacksonville, Arkansas. Such
expenditures shall not exceed $3,500.00 per annum.
SECTION 3. That the qualifications for such City
shall be that he"be a competent, qualified, registered Civil
and at all times after being hired that he be a resident and
elector of the City.

SECTION �4. DUTIES. That the duties of the City Engineer
shall include, but not be limited to the following:
A. Surveying and marking out the lines and grades of all streets,
alleys, lanes, parks, market places or other public grounds of the
city; the surveying of all lots, blocks or parcels of land when
commissioned to do so by the City when such are necessary for the
City, or any of its departments;
B. The inspection of all plats and bills of assurance and all
other data as requested by the City planning Commission in com-
pliance with its regulations and sub -division ordinance;
C. The making of all necessary inspections to insure the compli-
ance with Building, Plumbing, Electrical, Zoning, Sub -division
and other ordinances of the City; either by his personal. observa-
tion or by that of any agent delegated by him to make such inspection;
D. The investigation of progress of any Improvement Districts which
may be organizing or constructing improvements within the corporate
limits. That said City Engineer be and he is hereby given author-
ity to require of any improvement district the filing of general
plans and detailed plans at any time with the City C1erV;
E. He shall plan, survey and superintend the construction of all
sewer and drainage systems of the entire city, make all necessary
profiles, cross-sections and estimates for, access and pro -rate the
costs to the individual property owners.
F. That he shall inspect all public works, see that they are placed
on proper grants, and when found so, issue proper certificates of
acceptance of same, on payment of proper fees for benefit of city
treasury.
G. That he shall draw all ordinances, or provide adequate descri-
ptions and technical data to the City Attorney, fixing the grades
of streets and sidewalks and submit the same to the Mayor and City
Council to act upon.
H. He shall prepare and keep as part of the records of his depart-
ment one Plat Book for the recording of all surveys, plats and
other records of whatever kind or character and other engineering
data, and one Certificate Book dor the issuance by the City Engineer
of Certificates of the Recording of such surveys and plats.
I. He shall perform such other duties as shall be prescribed by
the Mayor necessary to effectually carry out the intent of this j
Ordinance and subsequent ordinances.
SECTION 5. That all applications for the position of
City Engineer shall be submitted to the Mayor, who be and he is
hereby authorised to select the most qualified person to such
position, subject to the confirmation of such appointment;;by the
City Council.
SECTION 6. That at no time during the holding of such
position shall the City Engineer perform any services in con-
flict with the duties of his position with the City, of Jacksonville,
for any person, firm or corporation within the corporate limits of
the City of Jacksonville; such action on his part, shall constitute
grounds for removal.
SECTION 7. At any time after said City Engineer shall have
been employed by the City for a period of at least one (1) year,
he shall be entitled to one (1) week's vacation with pay. At any
time after said City Engineer shall have been employed by the
City for a period of at least two years, lie shall be entitled to
two (2) weeks vacation with pay.
SECTION $. Failure to perform any of the duties herein
prescribed, or hereafter prescribed by the Mayor and/or the City
Council; or failure to conform to the provisions of Section 6
hereof; shall constitute Immediate grounds for removal. It shall
take the affirmative vote of two-thirds of the elected Council to
cause such removal: and upon such action the City Clerk shall
give written notification to the City Engineer of such action
thirty (30) days in advance of the termination date.
SECTION 9. In the event the City Engineer sheuld determine
to quit his position, it shall. be necessary for him to give thirty
(30) days written notice of such intention to the Mayor, prior to
his intended termination date.
SECTION 10. It is hereby declared that an emergency exists
in the city's need for a qualified, registered, civil engineer; and
In order that peace, harmony, health, safety, morals and welfare of
the citizens be preserved and maintained, that it is necessary that
this Ordinance be adlpted, and that a City Engineer be hired immediately,
