AN ORDINANCE ESTABLISHING REGULATIONS FOR THE SUBDIVIDING AND PLATTING
OF LAND; PROVIDING FOR SUBMITTING PLATS FOR APPROVAL; DESCRIBING PRO-
CEDURES ;.SETTING FORTH PLAT REQUIREMENTS AND FEES FOR APPROVAL, SUB-
DIVISION DESIGN STANDARDS, AND MTROVENENT REQUIREMENTS; PROVIDING
PENALTIES FOR VIOLATION HEREOF; AND REPEALING ALL OTHER ORDINANCES Ott
PARTS OF ORDINANCES IN CONFLICT HERTWITH TO THE EXTENT OF SUCH CONFLIT.
SECTION 1. PURPOSE AND AUTHORITY, JURISDICTION
1,1 Purpose and authority
To further promote and secure the health, safety, and general welfare
of the present and future citizens of the Jacksonville, Arkansas,
planning area; to help insure logical community growth; to assist and
cooperate with subdividers in planning their subdivisions; the follow-
ing Regulations for the subdividing of land within the Jacksonville,
Arkansas Planning Area, are adopted, in pursuance of the authority gran-
ted by the Legislature of the State of Arkansas in Act 166 of 19570
t.2 Jurisdiction
These Regulations shall apply to all forms of subdividing and ibt-
apiiting as defined in Section 10 hereof and shall be applicable to
all lands within the City of Jacksonville and certainunitcorporated
areas of Pulaski, Faulkner, and Lonoke Counties within five miles of
the City of Jacksonville, as shown on the Jacksonville City Planning
Commission Planning Area!Nrap.
SECTION 2. PROCEDURE FOR SUBDIVISION PLAT AND LOT -SPLIT PLAT APPROVAL
24 Subdivision Plat
2.11 General
To obtain approval of a proposed subdivision by the Planning Commission,
the subdivider shall prepare and submit to the Planning Commission a
Sketch Plat, a Preliminary Plat, and a Final Plat of the tract or
parcel of land proposed to be subdivided.

2.12 Sketch Plat
The Sketch Plat shall be presented to the City Engineer et least seven
days prior to the meeting at which consideration is requested., The
City Eegineer shall enter the date of receipt on the Plat.
2.13 Preliminary Plat
2,0131 Procedure
After the Planning Commission has approved the Sketch Plat, the sub-
divider may proceed with the preparation of the Preliminary Plat. The
Preliminary Plat and the completed Preliminary Plat Check -List shall
be presented to the City Engineer at least seven days prior to the
meeting at which initial consideration is requested. Preliminary
improvement plans may also be presented at that time. The City Engineer
shall enter the date of receipt on the materials submitted.
. ' 2.132 Review by County Planning Board
Before the Planning Commission may give conditional approval of a Pre-
liminary Plat for a Subdivision that is located in the unincorporated
parts of the Jacksonville Planning Area, the Planning Commission shall
dubmitea copy of the Preliminary Plat and all necessary supporting
docueents to the County Planning Board for its consideration and roe
port. Such report shall be made to the Planning Commission within 20
days from the time it is received by the County Planning Board, unless
further time is allowed by the Planning Commission.
2.133 Reservation of Land for Public Facilities
Prior to the conditional approval of the Preliminary Plat, the Planning
Commission may require reservation of appropriate ares for school
sites, parks, playgrounds, or other public facilities shown on the
Comprehensive Plan. For a period of not more than 90 days.
2.13b Planning Commission Action
When the Planning Commission find that a preliminary Plat, together
with improvement plans, meets all the requirements of these Regulations
it shall approve such Plat by placing a stamp of Preliminary Flat
Approval upon the Preliminary Plat. The stamp of Preliminary Plat
Approval shall. r=ead: "This plat has been given preliminary plat appro-
val only, and has not been approved for recording as a public record."
Such stamp of approval shall bear the signatrues of the Chairman and
Secretary of the Planning Commission. Where the Planning Connnissfon.
finds that a Preliminary Plat meets all of the requirements of those
Regulations, but improvement plans are not yet complete, it gray approve
such Plat subject to approval of the improvement plans by the City
Engineer within 60 days following plat approval.
2.1$ Time Limit on Planning Commission Action
The Planning Commission shall approve, conditionally, or disapprove
such Preliminary Plat within 45 days from the date of receipt thereof,
or the Preliminary Plat shall be deemed approved, unless tho subdivider
stipulates in writing to the City Engineer that additional time is
allowed. If disapproved, the Preliminary Plat shall be rottrned to the
subdivider with a written stetonent as to the reasons for disapproval.
In the case of plats including land located outside the City of. Jacksonville
the period shall be 60 days.
2.136 Distribution
Two copies of the approved or conditionally approved Preliminary Plan
shall be filed in the office of the City rlmginoor, and one copy shall
be conveyed to the sub - divider.
2.137 Authorization to Prepare Final Plat
Receipt of an approved or,conditionellk approved copy of the Preliminary
Plat together with an approved copy of the improvement plans, shall
constitute authorization of the Planning Commission for the sub - divider
to proceed with the preparation of tho Final Plat, the installation of
improvements, and the staking out of lots and blocks.

2.138 Completion of Improvements
The subdivider, after conditional approval of tho Preliminary Plat, shall
complete all improvements required under these Regulations.
2.14 Final Plat
2.1111 fl toriala to be Submitted to the City Engineer
The subdivider shall present the following materials to the City Engineer
at least seven days prior to the meoting at which consideration is re-
quired:
a. The original tracing of the Final Plat.
b. Plana for all improvements required under these Regulations,
such plans to bear the approval of the City Engineer.
c. The proposed protective covenants, if any.
The "as built•' specifications and "as built" original tracings of the
paving, water, sanitary sewer, and drainage plans shall be presented to
the City Engineer as soon as the improvements are completed. The City
Engineer shall enter the date of receipt on these materials.
2.142 Time Limit on Planning Commission Action
The Planning Commission shall approve or disapprove the Final Plat
within 45 days of receipt thereof; otherwise said Final Plat shall be
deemed to have been approved, and the certificate of said Commission
as to the date of submission of said Final Plat for approval and as to
the failure to take action thereon within such time shall be sufficient
in lieu of approval. In the case of plats including land located out-
side the City of Jacksonville, the period shall bo 60 days.
2.143 Acceptance of Public Dedications
Before the Final Plat is recorded in the office of the Circuit Cleck and
Ex- Officio Recorder, the subdivider shall submit the Plat to the Gitfr L•
Council, if the subdivision is located inside the city limits of Jackson-
ville or to the County Judge, if the subdivision is located outside the
city limits, for it /his acce=ptance of public dedications. Until the
public dedications and improvements have been accepted by the County Judge
or the City Council, any plat shall not be eligible to be recorded.
2.144 Time Limit on Submission of F .4 Plat
The Final Plat of the proposed subdivision shall be submitted to the
Planning Commission for final approval within one year of the date on
which the Prelirainaay Plat was approved. If not submitted for fItt
within such tire, the Preliminary Plat shall be considered as having
been abandoned, unless the Planning commission agrees to an extension of
time. The .Final Plat shall be filed in tho Office of the Circuit Clerk
and Ex- Officio Recorder within six months after approval by the Planning
Commission; if not filed within such tine, said approval shall be con -
sidered as having been voided.
2.145 Final Plat Approval for Portion of Subdivision
If the Subdivider requests percussion to develop only a portion of the
property for which the Preliminary Plat was approved, the Planning
Commission rmy grant approval of a Final Plat for said portion alone.
2.2 Lot -Split Plait
2.21 General
2.211 Approval by Planning Comission Agent
Tho Planning Conmission, may empower the city Engineer or other city
administrative officer to approve by endorsement, on behalf of the Planning
Corm:nsion, Lot -Split Plans that meet all of the requirements for Lot -
Split Plats as set forth in these Regulations.
2.212 Referral to Planning Commission
Whenever a subdivider desires to create a lot - split, he shall present
the Lot -Split Plat to the designated Agent of the Planning Commission.
If said Agent disapproves the Lot -Split Plat because said Plat does not
meet all the requirements set forth in these regulations for Lot -Split
Plats, or if an adjoining property owner protests the Lot -Split Plat
within five days after said Plat has been presented, then said Agent
shall refer the Lot -Split to the Planning Commission for consideration.
2.213 Report to Planning Commission

All Lot -Split Plats approved by the Planning Commission Agent shall be
reported to the Planning Commission at its Next regular scheduled meeting.

3.2 Fees -
At the time of submitting each of the respective plats to the secretary of
the. Planning Commission, or other designated agent, the following fees shall.be
payable to the City Clerk, City of Jacksonville:
a. The Preliminary Plat fee shall be $10.00.
b. The Final Plat fee shall be $10.00, or $.50 per lot plus

$5.00, whichever is larger.
• . c. The Lot -Split Plat fee shall be 32.00.
SECTION 4. SUBDIVISION DESIGN STANZARf
4.1 Suitability of Land
Land subject to 0o ng or opographically unsuitable for residential
occupancy and which the Planning Commission considers unsuitable for sub-
dividing shall not be platted for that use or any other use that may in-
crease danger to health, life, or property, or aggravate erosion or flood
hazard. If such land is in the proposed plat, this land shall be set aside
for such uses as will not be affected by periodic flooding or unsuitable
topographic conditions unless adequate corrective measures are formulated
by the developer and approved by the Planning Comrmiission,
4.2 Streets
4.21 Relation to Adjoining Street System
Whenever practicable, there shall be a minimum of 600 feet between inter-
sections with a major thoroughfare.
4.22 Street Alignment
The radii of curvature shall not be less than 400 feet on the centerline
of major throughfares, 200 feet for collector streets and 45 feet for local
streets.
4.23 Street Intersections
4.231 Angle of Intersection
In general, streets shall be laid out to intersect one another at right
angles, and a curve may be used in approaching an intersection to bring
about this result. No street shall intersect another street at an angle
of less than sixty (60) degrees.
• 49+232 Street Jogs
Street jogs shall be avoided. There shall be a minimum of 125 feet between
the centerlines of street intersections. The Planning Commission may require
that streets be connected by a curve or diagonal line in such manner that
a smooth flow of traffic and the elimination of traffic hazards are assured.
_l.24 Street Right-of-Way Widths

Where an existing or proposed throughfare is shown in the Jacksonville
Comprehensive Plan, right -of -way widths shall be shown on said plan.

Cul-de -sacs shall terminate in a turnaround with a property -line radius of
not less than fifty (50) feet.

4.26 Access from the Rear of Throu h Lots

thoroughfare abutting on the rear lot lines of a single tier of lots, it
may require the subdivider to dedicate the right of access to the thorough-
fare from the rear of the lots.

4.3 Alleys_
4.31 - Width
All alleys shall have a minimum width of twenty(20) feet.
4.32 Alignment
Aburpt changes in alignment or dead -ends shall be aveided.
4.33 Radii at Turns
"T" or "L" shaped alleys shall have a radius of not less than ten feet at
the point of intersection.
4.34 Opening and Grading
All alleys shall be opened and to a grade approved by the City or City Engineer
4.4 Blocks
4.41 Width
Blocks shall be two tiers of lots in width, except where it is necessary
to provide only one tier of lots in order to overcome unusual topography
or other physical conditions. Where a single tier of lots is permitted,
the Planning Commission may require a planting screen easement along the
rear lot lines.
4.42 Length
Blocks shall have a minimum length of 300 feet and a maximum length df
1,300 feet; measurements shall be between property lines and not between
street centerlines.
4 � 5 Lots
X4.51 Conformance with Other Ordinandes
Lob dimanstons and setback lines shall conform to the Zotng Ordinance and/
or Set back Ordinance of the City of Jacksonville;
4.52 Alignment of Side Lot Lines
Side Lot lines shall be at right angles or radial to street ltnrs.
4.53 Lots With Private Sanitary Facilities
In subdivision inhere eae 'lot'is.not"t3'be served by a:public water supply
or sanitary sewers, each lot shall be of sufficcnt size to conform to the
State Board of Health specifications and standards for septic tanks and /or
individual water supply systems.
4.54 Large Lots
When a proposed subdivision involves lots of one -half acre or more in area,
consideration shall be given to any reaubdiving that might take place, with
proper provision being made for such street extenulion as may be necessary.
4.6 Easements
4.61 General
Where alleys are not provided or may not be used for that purpose, ease-
ments of not less than eight (8) feet on single lots; and not less than a
total of ten 110) feet on lots back -to -back, within any subdividion, shall
be provided at the rear or side of the lots for poles, wires, conduits,
storm sewers, sanitary sewers, gas 11090 water mains and lines or other such
similar purposes.

I.62 Easements for Water Courses When a subdividion is traversed
by a water course, c annel, stream or creek, the subdivider shall provide an
easement sufficient for maintenance.
11.7 Conformance with Official Mans
nera
All subdivision Plats shall conform to all official plans currently in effect.
4.72 Reservation of Land for Public Purposes
The pl arming Commission may require the subdivider to reserve for public
acquisition that land which is within the bondaries of the proposed subdivision
that is indicated for public use on an officially adopted plan, Such re-
servation may extend over a period of not more than 90 days from the time
the public body responsible for the acquisition of said land is notified
of the developer's intent. Such notification of intent shall be deemed to
have been given at the time of the submission of the preliminary plat.
SECTION 5. SUBDIVISION IMPROVEMENT REQUIREMENTS
5.1 General
The subdivider is put on notice that within the subdivision he shall at
his own expense pave all streets, install sidewalks, sanitary sewers, street
signs, and storm drainage improvements, as required by these Regulations.
The City may either (a) require installation of water lines, and/or (b)
install water lines at developers expense.
g.2 Street Improvements in Residential Sections
5.21 General
All roadways shall be paved and curbs and gutters installed according to
the following specifications:
a. Street Grades
1) Where a subdivision abuts and existing or proposed street
that is designated as a major street in the Jacksonville
Comprehensive Plan and/or Major Street Plan and a paving
width or standard cross- section has been established for
snnh.otrnet the subdivider shall:
a) inat„ll. paving, including curb and gutter, in accord-
ance with such established width or cross - section up
to a maximum width of 36 feet, face -to -face df curb,
except as provided in sub - paragraph 2) below, or,
b) contribute the equivalent in cash to a fund establish-
ed by the City or County depending upon the location
of the subdivision; said fund shall be used only for
installation of street improvements on said major
street abutting the subdivision.
2) Where a frontage road is required on a major street abutting
a subdivision, the subdivider shall be required to install paving, includ-
ing curbs and gutters, on the frontage road, in accordance with the estab-
lished width or cross - section for such frontage road.
3) Where a street is not shown as a thoroughfare on the Jack-
sonville Comprehensive Plan and /or Major Street Plan, but is designated
as a collector street by the Planning Commission, the Width of paving
shall be 36 feet, face -to -face of curbe.
4) On local streets in single - family residential areas, the
minimum width of paving shall be 27 feet, face -to -face of curb
5) On all other streets, including local streets in multi-
family residential areas, commercial areas, and industrial areas, the
required width of paving shall be established by the Planning Commission.
b. Crab Radii
1) Street intersections involving major streets and highways
shall have a minimum street corner radius of 20 feet at the curb line,
or edge of pavement, if there is no curb.
2) Radius of the outer curb in a cul-de -sac turnaround shall
be not less than 45 feet at the curb line. Radius of the inner curb shall
be such that the width of pavement from back of curb to back of curb shall
not be less than 27 feet.

5.21 General (Cont'd)
3) .MRadii of curbs at street corners, other than major streets
and highways, shall not be less than 20 feet.
4) All street corner radii shall be shown on street improvement
plans.
d. Pavement Types Shall be Either:
1) Portland cement concrete pavement five inches thick laid an
two inches and cushion with a subgrade compacted to 95 percent Standard
Proctor. Concrete to be 3500 Psi, 5.5 sack mix or
2) Asphaltic concrete (hot mix -hot laid) pavement two inches
thick wearing surface Type B or G on a six inch stabilized aggregate base
course with a six inch compacted sub - grade. The above asphaltic concrete
street shall have a Portland Dement concrete curb and 18 inch concrete
gutter.
Detailed plans, specifications, and mote of application.. shall be on file
in the office of the City Engineer for inspection by, or use by any persons
concerned with such types of pavement.
5.3 Sidewalks
5.31 Where Sidewalks are Required
5.311 In Certain Subdivisions
Sidewalks shall be required on both sides of the street in all subdivisions
having lots with an average lot width of 100 feet or less or an average
lot area of less than one -forth acre.
5.312 Along Certain Thoroughfares
Sidewalks maybe required in conjunction with any major thoroughfare where
the Planning Commission deems sidewalks essential for public safety.
5.32 Minimum Width and Location of Sidewalks
All sidewalks shall be a minimum width of 42 inches and a distance of not
less than one foot from the property line.

Street signs shall be installed aceerdine to the strvet sign specifications
of the City of Jacksonville.
5.5 Storm Drainage and Flood Plains
5.51 General
All land development shall be related to the surrounding drainage pattern
with provisions made for proper storm drainage facilities.
5.52 Minimum Runoff
Minimum runoff shall be determined by the Berkli - Zegiler, the National
Method, or an equivalent formula with conventional runoff factors, using as
a minimum a rainfall rate of two inches per hour.
5,53 Acceptance for Maintenance
Lands, Lakes, Ponds, creeks, and similar areas shall be accepted by the
public for maintence only if they are related to ad may logic-
ally become a part of a recreational park, area, or similar public use.
5.54 Water in Stub Streets and Cul -de -sacs
In all instances, provisions shall be made for adequate storm drainage
and drainage structures to prevent water from standing in the ends of
stub streets or cul -de -sacs.
5.55 Diversion of Water from Natural Course
If storm water is to be diverted from its natural course, the construct-
ion plans shall include:
a. A sketch showing the existing waterway and the location of the
proposed channel change, and a page 11

b. Profile of existing wateroeourse.
5.6 Sanitary Sewers
Sanitary sewers shall be installed to serve each lot in all subdivisions
when connections are to be made immediately to a community disposal system
or a public sewerage system. Where such connection to said system is not
to be made immediately, puns shall be prepared for future development and
installation of a sewerage systeleto serve each lot, and those parts of such
system which will be in the paved portion of streets and alleys shall be
installed before the area is paved.
5.? Water Lines
Water lines shall be installed to serve each lot in all subdivisions*
where connection to a community eater system or public water supply is
not to be made immediately, plans shall be pm pardd for future instal-
lation of a water distribution system to serve each lot, and those parts
of such system which will be in the pave portion of streets and alleys
shall be installed before the area is paved,
5.8 Mo .numents
Concrete monuments, four inches in diameter or four inches square and
30 inches long with one -half inch metal reinforcing rod running the length
of the monument shall be placed with the top flush to the ground at all
quarter section points within or on the boundary of the subdivision. Metal
rods three - fourths inches in diameter and 24 inches long placed flush with
the ground shall be placed at each corner of every block or portion of
a block, at points of curvature and points of tangency on street lines,
at each angle point on the boundary of the subdivision, and at all lot
corners. In situations where conditions prohibit the placing of markers
in the locations prescribed, offset markers will be permitted, The exact
location of all markers shall be shown on the Final Plat, together with
accurate interior angles, bearings, and distances.
SECTION 6. VARIANCES AND EXCEPTIONS
Whenever the tract to be subdivided is of such unusual size or shape
or is surrounded by such development or unusual condition that the strict
application of the requirements contained in these Regulations would result
in real difficulties and substantial hardships or injustices, the Planning
Commission may vary or modify such requirements so that the subdivider is
allowed to develop his property in a reasonable manner, but so, ai the same
time, the public welfare andinterests of the City and County are protect-
ed and the general intentand spirit of these Regulations are preserved.
Such variances may be granted only by the affirmative vote of a majority
of the Planning Commission members present.
SECTION 7 VIOLATION AND PENALTY
Any person, firm or corporation' who shall violate the provisions of these
regulations or fail to comply substantially therewith or who shall violate
or fail to comply substantially with any order or regulation made there-
under, or who shall build in violation of any detailed statement of spec-
ification of plans submitted and approved thereunder, or any certificate
or permit tented thereunder, shall, for each and every violation or sub-
stantial non-compliance respectively, be deemed guilty of a misdemeanor,
and upon conviction thereof shall be fined in any sum not less than $25.00
nor more than $1,000.00, and each and every day that such violation or
substantial non - compliance shall exist shall be deemed a separate offense.
SECTION 8 AMENLE4ENTS, RULES, APPEALS
The City Council may amend these Regulations in accordance with Section
6, Act 186 of the 1957 Arkansas State Legislature.
8.2 Rules
The Planning Commission may adopt rules for the administration bi
these Regulations to the extent that .much rules are not in conflit with
these Regulations.

8.3 Appeals
In the event a subdivision plat is disapproved by the Planning Commission,
the applicant for approval may petition the City Council for a hearing
upon said Planning Commission action. After said hearing the City Council
upon a majority vote of the members may approve the subdivision or take
other action consistent with the provisions of these Regulations.
SECTION 9 ENFORCEMENT AND VALIDITY
9.1 Enforcement -- Recording
After the efgective date of these Regulations, no deed or other instru-
ment of tranfer for land located within the city limits of Jacksonville or
the unincorporated part of the Jacksonville Planning Area shall be acoepted
for record by the Circuit Clerk and Ex- Officio Recorder UNLESS:
A. said deed or other instrument of transfer is to a lot or parcel
platted and on file in the Office of said Recorder; or
b. Said deed or ether instrument of transfer is accompanied with
a plat approved by the Planning Commission; or
c. Said deed or other instrumehtof transfer conveys (5) five or
more q square acres of land.
9.2 Enforcement -- Buildings
After the efdective date of these Regulations, the building inspector
shall not issue building pebmits for any structure on any lot in a sub-
division for which the plat has not been approved and recorded in the manner
prescribed herein; and further unless said building to be constructed
shall front upon en a lot ona street shown on an approved land subdivision
plat, or a street legally established by the city, or on a formerly exist-
ing public street.
9.3 Enforcement Utilities
No utility, whether publicly or privately owned, shall provide, extend or
authorize the extension of services to any lot, building structure or lo-
cation within Jacksonville, or the unincorporated part of the Jacksonville
Planning Area unless:
a. The lot, building ur otruvt,ure was established before the
adoption of land subdivision rules and regulations; or

b. The Plat of the location has been approved by the Planning
Commission and filed and recorded in the office of the circuit Clerk
• and Ex- Officio Recorder;or
e. The plan for the proposed service by the utility has been approved
by the Planning Commission as provided for herein.
9.4 Enforcement -.. Streets
The City of Jacksonville is hereby prohibited from accepting, improving,
grading, paving, or lighting any street and from laying or authorizing the
laying of any water mains, sewers, or other utilities in any street except
an existing public street, a street shown on an approved land subdivision
plat, or a street legally established by the city of Jacksonville.
9.5 Validity
Should any section or provision of these regulations be declared by a court
of competent jurisdiction to be invalid, such decision shall not affect the
validity of these Regulations as a whole nor any other section, paragraph,
clause, provision, or portion of these Regulations.
SECTION 10 DEFINITIONS
Alley Minor ways which are used for utility easements and vehicular
service access to the back or 'side of property abutting on a street.
Building Set -Rack Line: A line parallel to the street right -of -way, indi-
eating he limit beyond which buildings or structg may not be
erected.

Circuit Clerk and Ex- Officio Recorder: The Circuit Clerk and Ex- Officio
Recorder ot Pulaski County, Arkansas, Faulkner County, Arkansas
or Lonoke County, Arkansas, whichever is applicable to the land
under consideration.
City Council: The elected governing body of Jacksonville, Arkansas
Collector Street A street which Eolletbs traffic from local streets and
carries it to one or more major throughfares, or to one or more
ptber collector streets.
Comprehensive Plan: A plan for the development of the Jacksonville Planning
area, prepared in pursuance of the authority granted by the
Legislature of the State of Arkansas in Act 186 of 1957.
County Judge: The county Judge of Pulaski, Faulkner, or Lonoke County,
whichever applicable.
Count Plannin Board: T he County Planning Board of Pulaski, Faulkner,
- no e aunty, Arkansas, whichever applicable.
County Quorum Courts The Quorum Count of Pulaski, Faulkner or Lonoke
County, whichever applicable.
Count Tax Collector's Certificate: A statement from the Pulaski, Faulkner,
or ono a ounty whichever applicable) Tax Collector certify-
ing that no property taxes on the land were due and payable as of the date
of the certificate, which date shall he not more than seven (7) days in
advance of the date of submittal of the final plat to the Planning Commission
for approval.
Cul- de -dac: A :street having one end open to an intersecting street and
being terminated at the other end by a Vehicular turnaround.
Easements A grant by a property owner to the public, a corporation, or
persons of the use of all or part of a parcel of land for specific purposes.
Final Plat: A map or chart of land subdivision giving in form suitable for
filing in the office of the Circuit Clerk and Ex Officio Recorder, necessary
affidavits, dedications, and acceptances, and containing a complete engineer-
ing description, including references to field markers, sufficient to
locate on the'ground all streets, alleys, blocks, lots, and other divisions
of the subdivision.
Improvements: Street graditg and surfacing; curbs and gutters; sidewalks;
water rains airs lines; sanitary and storm sewers; enlrerts, bridges, and
other utilities; and related items.
Jacksonville Planning Area: The City of Jacksonville and those unincok -
porated areas of Pulaski, Faulkner aid Lonoke Counties within five miles
of the Jacksonville City Limits, as shuwri on the Jacksonville fifty Planning
Commission Planning Area Map.
Local Street: Street intended primarily to provide access to abutting
property and carrying little or no thrvngh traffic; ordinarily a street
which is not a major thoroughfare or a collector street is a local street.
Lot: A portion of a subdivision or any parcel of land intended as a unit
of transfer of ownership or for development.
Lot -S lit: A subdivision which involves the dividing or redividing of a
ot or ots airrithin not more than one block of a recorded subdivision,
and which does not involve the dedicating, vacating, widening, narrowing,
or change of alignment of any thoroughfare, street, alley, or easement.
Lot -Split Plat: A plat describing a lot- split.
Lot - Splitting: Action of creating a lot - split.
Major Thoroughfare: A public way designated as a throughfare in the
Jacksonville Comprehensive Plan and /or the Major Street Plan.

area to be subdivided, the street layout, lots and blocks, and the general
nature of improvements.
Street: A public way from which the principal means of access to abuting

Subdivider: Any person, partnership, company or corporation desiring to
create, and /or creating, a subdivision or lot -split as defined in these
Regulations.
Sub- division: The division of a parcel of land into two (2) nr more lots
or parcels for the purpose of transfer of ownership ear building develop-
ment or, if a new street is involved, any division of a parcel of land;
provided that a division of land for agricultural purposes into lots or
parcels of five (5) acres or more and not involving a new street shall
not be deemed a subdivision. The term includes resubdivision and when
appropriate to the context, shall relate to the process of subdividing or
to the land subdivided.

SECTION 11. ENACTMENT
All ordinances and parts of ordinances in conflict herewith are hereby
repealed, and this Ordinance, being necessary for the public safety,
health and welfare of the citizens of Jacksonville, an emergency is here -by
declared to exist; and this Ordinance shall be in full force and effect
from and after its passage and publication as provided'bv law.
