0127 • ORDINANCE NO. /3// AN ORDINANCE FOR TEE PURPOSE OF GRANTING TO THE CITY OF'JACKSON- VILLE WA'T.KH DEPARTMENT THE RIGHT TO CONSTRUCT, MAINTAIN AND OPERATE A WATER DISTRIBUTION SYSTEM WITHIN AN AREA KNOWN AS GREEN ACRES -- MADDEN ROAD AREA, TO AUTHORIZE THE COUNCIL TO LEND MONEY FOR THE CONSTRUCTION OF SAID DISTRIBUTION SYSTEM AND. TO COLLECT THE SAID LOAN. WHEREAS, a certain area within the city limits of the City of Jacksonville, Arkansas known as the Green - Acres -- Madden Road Area, presently is without water service_and proper fire protection; and, WHEREAS, THE City of Jacksonville Water Department has ac- orued a surplus within the general operating fund of such department and is,, at this time, financially able to construct, maintain and operate a water distribution system within the said area by advan- cing the sum of Five Thousand ($5,000.00) Dollars -to the patrons of said area, to be payable under the terms and conditions hereinafter set forth; and, WHEREAS, the City Counoil (City Water Commission) of the City of Jacksonville, Arkansas, has agreed that the repayment of said advance of moniss may be payable by each patron for water service at the rate of one ($1.00) dollar per month until the same has been paid in full; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JACKSONVITLE, ARKANSAS: THAT:. SECTION 1. The City of Jacksonville, Arkansas Water Depart- ment construct, from surplus funds derived from the operation of its municipal water system, and subject to all covenants and restrictions: of City Ordinances 43 * and all amendments thereto; extensions of water service into the area known as Green- Lof'ea -- Madden Road Area which is more fully described by Schedule A:, attached hereto and made a part hereof by this reference. ) SECTION 2. (A) Rates for water service in the area described in Schedule shall be those presently existing within all areas within said City of Jacksonville. (B) An additional charge of one ($1.00) Dollar per month per patron shall be made as part of the total coats for water service within said area, and shall be applied against the indebtedness of $5000 herein incurred. SECTION 3. The above schedule of rates shall be effective from the date of this Ordinance and shall be continued in effect • • until'suoh rates are raised or lowered in the manner provided by law. The additional charge of Ono ($1.00) dollar per month, per patron shall be ceased by Ordinance upon full return of the $5,000 (Five Thousand Dollars) being made to the city water department. SECTION 4. That all bills for charges for water service, which shall include the additional charge of $1.00 per month per patron referred to above, shall be computed and rendered monthly, and shall be due and payable on or before the 15th day following the date of billing. A ten (1O%) percent penalty oharge Shall be added to any bill not paid on or before the 15th day following the date of billing. If any bill is not paid by the 25th day following the date of billing, water service shall be discontinued and the premises shall be disconnected from the water system. Should any water service be so discontinued or disconnected, the bill involved must be paid in full with penalty and a service charge of One ($1.00) Dollar shall be made for restoring or reconnecting the water service. SECTION 5. The provisions of this Ordinance are intended to be separate and secerable, and the Holding of any portion hereof to be invalid, shall not affect the other portions. SECTION 6. For the reason that persons living within the area described in Schedule k are presently without water service and proper fire protection, and that these things are immediately needed for the preservation of public health, safety and welfare, an emergency is declared to exist and this Ordinance shall have full force and effect immediately after its passage.
