0122 t" tie r O RDINANCE Nd ti f L Cr AN ORDINANCE OPENING UP A STREET KNOWN AS SHARP STREET FROM NINA STREET ACROSS THE JACKSONVILLE AND NORTH WESTERN RAIL- ROAD RIGHT OF WAY AND JOINING IN TO THE JACKSONVILLE CITY PARK ROAD; PROVIDING FOR THE RAILWAY COMPANY TO BEAR THE EX- PENSE OF THE STREET ACROSS ITS RIGHT OF WAY, PROVIDING FOR THE CITY TO BEAR THE OTHER FT/PENISES AND FOR OTHER PURPOSES. WHEREAS Mayor Harden has notified the Missouri Pacific Railroad Company of the City's intention to contruct this street by letter of March 30, 1961; therefore: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JACKSONVILLE, ARKANSAS: Section 1. That a Street running South from Nina Street known as Sharp Street across the Jacksonville North Western Rail- road right of way and joining the City Park Road iu hereby estab- lished. Section 2. That the Missouri Pacific Railroad Company is hereby ordered and directed to construct that part of this Street that is on their right of way. That a certified copy of this ordinance shall be mailed to the Missouri Pacific Railroad Company. Section 3. That the City of Jacksonville will construct the parts of this Street not on the Railway Company's right of way system and bear all the costs arising therein. Section L . That if the .Missouri Pacific Railway Com- pany does not begin construction of this street across this right of way within thirty (30) days after the passage of this ordinance they shall be in violation of this ordinance; be guilty of a mis- demeanor; and shall be subject to a fine of up to Fifteen (015.00) Dollars per day, with each separate day constituting a separate offense. Section 5. If any part or parts of this ordinance is held to be void, it shall not affect the validity of the remainder, but the remainder shell stand. Section 6. WHEREAS, the opening of this Street is very necessary for t e sP ety and welfare of the City of Jacksonville, Arkansas, and being necessary for the immediate preservation of the public peace, .health and safety, and for the purpose of gaining access to the City Park of the City of Jacksonville, Arkansas, an emergency is hereby declared to exist and this ordinance shall be in full force and effect from and after its passage.
