AN ORDINANCE TO REQUIRE SOLICITORS, PEDDLERS,
HAWKERS, ITINERANT MERCHANTS, VENDORS OF MER-
CHANDISE AND /OR SERVICES, TO GUARANTEE PER-
FORMANCE OF SERVICE, DELIVERY OR MERCHANDISE
AND THE QUALITY THEREOF, AND TO DESIGNATE TEE
CHIEF OF POLICE AS ADMINISTRATIVE OFFICER.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JACKSONVILLE,
ARKANSAS: -
SECTION 1. Solicitors of book and magazine subscriptions, as
well as itinerant peddlers, hawkers, merchants, vendors of merchan-
dise and /or services shall enter into a bond with good and suffi-
cient surety to the City of Jacksonville, Arkansas, for the use
' and benefit of any person damaged by a breach thereof, as herein-
after provided, to insure performance of services, delivery of
merchandise and proper application of monies received.therefor.
SECTION 2. This bond shall be made in advance of any active
soliciting, peddling, hawking, or vending contemplated herein and
must be in an amount, approved by the Chief of Police of Jackson-
ville, Arkansas, which is found as fact, after considering the
sums of money likely to be involved or the value of services to
be rendered or merchandise delivered, to be adequate to protect
the public against fraud or dishonest dealing. However, this
bond shall not be in an amount less than Five Hundred Dollars
0500.00). A fee of Five Dollars ($5.00) shall be paid to the
city by each person making such a bond, to defray the cost of
administering this ordinance. The fees so collected shall be
deposited in the City General Fund.
SECTION 3, The bond shall be payable to the City of Jack-
sonville, Arkansas, for the use and benefit of any person dam-
aged by the breach thereof.
SECTION 4. L person damaged by a breach of the bond pro-
vided for herein is entitled to recover on the bond the amount
of his damages proved plus costs in a civil action in any court
having jurisdiction.
SECTION 5. In no event shall the amount required be more than
is necessary to effectuate the purposes of this ordinance.
SECTION 6. In addition to complying with the provisions of
this ordinance, any person, firm or corporation shall pay the
Privilege Tax required by City Ordinance,
SECTION 7. The Chief of Police of Jacksonville, Arkansas is

empowered to administer the provisions hereof.
SECTION 80 A parson who violates any provision of this or-
dinance shall be fined not less than Ten Dollars ( *10.00) nor
more than One Hundrld Dollars ($100,00) or imprisoned for not
more than thirty days or both. Each violation is a separate
offense.
SECTION 9. If any provision of this ordinance or the applica-
tion thereof to any person or circumstance is held invalid,, such
invalidity shall not affect the other provisions or applications
hereof which can be given effect.
SECTION 10. It has been found and is declared by the City
Council of Jacksonville, Arkansas, that dishonest practices of
irrespdnsible itinerant solicitors, peddlers, hawkers, merchants,
vendors of merohandise and /or services have resulted in frequent
and substantial financial lessee to the people of Jacksonville
Arkansas, and that there is urgent need for correction of this
evil; that enactment of this ordinance will provide for more
efficient regulation of the activities of such persons. Therefore
an emergency is declared to exist, and this ordinance being
necessary for the preservation of the public peace, health and
safety, shall take effect from the date of its passage and ap-
proval.
