AN ORDINANCE AMENDING SUB - SECTION (A) 3 OF SECTIQN H
OF ORDINANCE NO. 36 OF THE ORDINANCES OF TDE CITY

TO BE CLASSIFIED AS "ROME OCCUPATIONS"; PROVIDING
EXISTING VARIANCES SHALL NOT BE EFFECTED; FINDING
THAT AN EMERGENCY EXISTS; AND FOR OTRER PURPOSES.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JACKSONVILLE, ARKANSAS:
SECTION 1. Sub - Section (A) 3 of Section 3 of Ordinance No. 36
of the Ordinances of the City of Jacksonville, Arkansas is hereby amended to
read as follows;
"3 (A) 3. Uses customarily incident to any of the above uses,
ineiuding Boma occupations. 'Home occupation''. is hereby defined as including
only the following occupations and.i'1'pe Physician; surgeon; dressmaker.
Provided, however, that home occupations mast be situated in the main building
and must have enema plate not larger than one square foot in area. Signs
pertaining to the lease, hire or sale of the premises or building or part
thereof, or Church or institutional bulletin boards may not encead,twalva (12)
square feet in area dnd may not be illuminated unless such sign is fitted with
an integral illuminating device as a part of the sige; provided, however, that
no advertising sign of any kind shall be permitted in a residential district,
except as hereinabove provided."
SECTION 2. Any business or commercial use of property which La
zoned residential which was begun as a home occupation before the passage of
tbia ordinance shall be permitted to continue after`the passage of this ordinan e.
Provided, however;' that after the passage of this ordinance, no building permit
shall be issued for the making of any structural change, addition or alteration
•` on property which is being used for business or commercial purposes and which
is located in a residential zone.
SECTION 3. It is hereby determined that at the present time Hamer
1I business and commercial establishments are being operated in the City of
Jacksonville in areas which are zoned for residential use only; and, further,

that there is an Umtata need to clarify and define the term "home occupation'
as used under the existing ordinances of the City of Jacksonville in order to
` eliminate confusion and to atop the continued and disorderly growth of business
and commercial establishments in residential areas within the said C1ty; now,
therefore, an urgency is hereby declared to exist and this ordinance being
necessary for the preservation of the public peace, health and safety shall
be in full force and effect from and after the date of its passage.
