ORDINANCE # 10E-A -
AN ORDINANCE TO AMEND SECTION 4, SECTION 6 and SECTION 8, Will
ORDINANCE N0. 43, AND TO DELETE SECTION 4 of VW
NONBER 1 TO ORDINANCE NUMBER 43.
DE IT ORDAINED AND ENACTED 8Y THE CITY COUNCIL OF THE CITY OF JACHSONFIILS,
ARKANSAS:
SECTION 1. That Section 4 of Ordinance Number 43, the entire said sectio
reading:
"That, whenever it is necessary to make a new connection to a water
main, or water distribution pipe, In order to supply water to a customer
there shall be a minimum charge of Seven and One -Halt Dollars ($7.50),
or actual cost whichever is the greater sum for each such conneotion or
tapping of the pipe belonging to the Water & Sewer Department,"
be amended by the following:
"That, whenever it is necessary to make a new connection to a water
main or water distribution pipe, in order to supply water to a customer,
there shall be a minimum charge of $60.00 inside oity and $100.00 outside
city or actual coat, whichever is the greater sum for each such connection
or tapping of the pipe belonging to the Water & Sewer Department."
SECTION 2. That Section 6, Paragraph 3 of Ordinance Number 43, the entire
said paragraph reading: 1
"That a minimum charge of $7.50 or actual cost whichever is the greater
sum per connection shall be made for each new connection into the existing
or future sewer systems, provided that the term new connection shall refer to
connections made after uncovering the existing or future sewer pipes as distinct
from connections made at the tiros of installation or before backfilling over
a newly laid sewer main."
BE ANSNDED BY THE FOLLOWING:
°That a minizmw charge of $35.00 shall be made for each new connection
into the existing or future sewer systems."
Provided that this'foregoing amendment shall completely replace paragraph 3,
of Section 4, Ordinance 43.
SECTION 3. That Paragraph 2, amendment number 1 to Ordinance Number 43, dated
April. 5, 1956, be deleted entirely.
SECTION 4. It is hereby declared that the provisions of Section 8, Paragraphs
1 and 2 are hereby incorporated in and made a part of this Ordinance.
SECTION 5. This Ordinance being necessary for the immediate preservation
of the public health, peace and welfare, an emergency is declared to exist

and this Ordinance shall be in full force and effect from and after its
passage and approval.
It is further declared that if any of the provisions of this
ordinance or applications thereof to any person or circumstances is held
invalid, such invalidity shall not affect other provisions or applications
of the ordinance which can be given effect without the invalid provisions
or applications, and to this end the provisions of this ordinance is
declared to be severable.
