0102 ■ 4. 3 ORDINANCE NO. 102 ' i+ --,.i + AN commove HAZARDOUS TIN TO I I AND InN CORE IRESCIBING BEGUhA TIONS GOVERNING PROPERTY FROM FIRE AND EXPLOSION, BE IT ORDAINED BY DBE CITY COUNCIL OF THE CITY OF JACKSONVILLE, ARKANSAS: • SECTION 1. There is hereby adopted by the City Council of the City of Jacksonville, Arkansas. for the purpose of prescribing regulations governing condition hazardous , to life and property from fire or explosion, that certain made known as the Fire Prevention Code, Abbreviated Edition, reommmended by the National Board of Fire Underwriters, being particularly he �� �� pp I2 Y 1956 edition thereof end tie whole thereof. LAI/SA 4 of which uode not less than three (3) copies have been and now are filed in the fts U of the Clerk of the City of Jacksonville, Arkansas, and the mama are hereby adopt° aX � efts ed and inoorporated as fully as if set out at lbgth herein, and from the date on which this ordinance shall take effect, the Provisions thereof shall be controlling within the limits of the City of Jacksonville, Arkansas. SEC£ISBI 2. The code hereby adopted shall be enforced by the Chief cf the Fire Department. SECTION 3. Wherever the word " tiunioipallty" is used in the ocde hereby adopted, it shall be held to mean the City of Jacksonville, Arkansas. SECTION 11. The limits referred to in section 9014 of the code hereby adopted in which storage of flammable liquids in outside aboveground tanks is prohibited. and the limits referred to in sootion1104 of the code hereby adopted, in which built storage of ltouetied p'.roleum gas is restricted, are hereby established as follows: "The boundaries of such district are indicated upon the M of the City of Jaokson- villa, Arkansas, which is hereto attached and made a part of this ordinance as if fully described herein. SECTION' 5. The Chief of the Fire Department shall have power to modify any of the provisions of the node hereby e.dopted upon application in writing losses. or his duly authorized by the owner or agent, when there are practical difficulties in the way of carrying out the; strict letter of the code, provided that the spirit of the node shall be observed, public safety scoured, and substantial justice done. SEC TION 6. Whenever the Chief of the Fire Department shall disapprove ea applica- tion or refuse to grant a permit applied for, or when it is olaimed that the provisions of the code do not apply or that the true intent and meaning ef the code have been misconstrued or wrongly interpreted, and the applicant may app from the decision of the Chief of the Fire Department to the City Council of the City of Jacksonville, Arkansas, within thirty (30) days from the date of the deoinion appealed. ago 2 845 rdinanoe Bo. 102 SECTION 7. Any person who shall violate any of the provisions of the Dodo hereby adopted or fail to comply therewith, or who shall violate or fail to comply therewith, at .who shall violate orbit to comply with any order made thereunder, or who shall build in violation of any detailed statement of specifications or plans submitted and approved thereunder. or any certificate or permit issued thereunder, and from which no appeal has been taken, or who shall fail to comply with such an order as afflrnad or modified by the City Council of Jacksonville, Arkansas, or by a court of oompetent jurisdiction, within the tire fixed herein, shall severally for each and every such violation and nonoonplianee respectively, by guilty of s misdemeanor. punishable by.a fine of not less than 35.00 nor mare then E25.00. The imposition of one penalty for any violations or defects shall not excuse the violation or permit it to continue; and all mach persons shall be ronuired to oarroot or remedy such violations or defects within a reasonable time; and when not otherwise specified, each ten days that prohibited conditions are maintained shall constitute a separate offense. The application of the above penalty shall not be held to prevent the enforced removal of prohibited oonditiona. SECTION 8. All ordinances or parts thereof conflicting or inconsistent with the provisions of this ordinance or of the code hereby adopted are hereby repealed, and the City Couooil of the City of Jacksonville, Artaneaa, hereby declare that should any sostion, paragraph, sentence, ar word of this ordinance or of the code hereby adopted be doolared for any reason to be invalid, It is the intent of the City Council that it would have passed all other portions of this ordinance independent of the elimination herefrom of any such portion as nay be declared invalid. SECTION 9. For the inewdiate preservation of the public pease, health and safety an emergency is doolared to exist and this ordinance shall have full force and effect from and after its passage and approval.
