0101 OROINANCE N0. AN ORDINNCS PROVIDING FOR THE FURNMHING OF Fl v; FIGHTING FACILITIES OF THE CITY OF JACESONVILtJv FOR THE PROTECTION OF CERTAIN PROPERTY WCATE7) OUTSIDE OF THIS CITY LIMITS; PROVIDING REGULATIONS UNDER WHICH SAID FIRE FIGHTING FACILITIES WILL BE USED PROVIDING FOR A SCHEDULE OF CHARGES FOR SUCH PRO- TECTION; AND FOR OTTER PURPOSES. BE IT ORDAINED BY THE CITY COUNCIL OF TEE CITY OF JACHSONVIISA, ARKANSAS: SECTION 1. From and after the passage and approval of this ordinance any person, firm or corporation sdithin a radius of five (5) highway miles of any firs station of the City of Jacksonville, Arkansas, is granted the privilege of applying to the City Cowucil for limited fire fighting equipment protection. The City Council may at its discretion approve or reject any such application. If the City Council approves an application, the fire fighting facili- ties of the City of Jacksonville shall then be available to such applicant, but shall be available only upon the relieving conditions: 1. An agreement shall be signed by the applicant, which agreement shall state that the City of Jacksonville agrees to furnish only limited fire fighting equipment, and the applicant shall agree that any portion or 411 of this equipment. may be recalled at any time by the City when, in the judgement of the Chief of the Fire Department, such equipment is necessary for fire protection within the City of Jacksonville. Said agreement shall further provide that the City does not undertake to guarantee any fire fight- i.ng results, and offers only such reasonable equipment as is consistent with conditions prevailing at the time, and the applicant shall agree that no claims of any time or nature obeli ever be made against the City resulting from the use and/or operation of the equipment. 2. The applicant shall pay in advance to the City Collector an annual ready to serve fee bused on the assessed evaluation of the property covered by each application as is reflected by the county tax records according to the following schedule of rates: APPRASSED PROPERTY EVALUATION RATE 0 to °.25,000.00 $25.00 Each additional $25,O00.00 or fraction thereof $25.00 • • -2- 3. The sole purpose of this ordinance is offer service to separate properties of subject to fire damage, and the grouping of one or more properties shall not be allowed for the purpose of thin ordinance. 4. In addition to the above fee the applicant skull pay a nauage fee of Twenty -Fine Dollars ($25.00) per hour or fraction thereof for each fire fighting company Which responds to an alarm on the premises of the appli- cant, whether the alarm is false or comes as a result of a fire. Only one fire fighting company shan respond to an alarm an the premises of any applicant unless the applicant or its or his agent requests additional com- panies. The City shall not be bound to dispatch any equipment unless the equipment is available and is not needed at the time for fighting fire within the City Limits. 5. Failure of the applicant to pay any fee set out in this ordinance within ton days after receiving due notice from the City Collector shall void all agreements between the applicant and the City. SECTION 2. It is not the intent of the ordinance to cancel or void any Mutual Aid Program now in effect. SECTION 3. All ordinances or parts of ordinances in conflict herewith are hereby repealed, and this ordinance shall be in full force and effect from and after its passage and approval.
