OPENING REMARKS: Vice Chairman Mark Perry opened the meeting and expressed appreciation for those in attendance and requested roll call. ROLL CALL: Commissioners: Rudy Reid, Dana Nixon, Bob Walker, John Hardwick, and Lester Piggee answered ROLL CALL. Vice Chairman Perry answered ROLL CALL and declared a quorum. PRESENT SIX (6), ABSENT (2). (ONE opening on the Planning Commission) Others present for the meeting were Chairman Bart Gray, as a petitioner, City Attorney Robert Bamburg, Deputy City Clerk Susan Davitt, City Engineer Duane Reel and Marci Wilson of the Engineering Department, OECD Director Frank Rowland, Aldermen Kenny Elliott and Bill Howard, Editor of the Jacksonville Patriot John Parham and Mr. J. C. James a local realtor. PUBLIC HEARINGS: 7:00 P.M. Vice Chairman Mark Perry opened the public hearing at approximately 7:03 p.m. Chairman Bart Gray, representing Arkansas Multi-Family Housing, LLC, related the following regarding the request for a variance from C-3 zone for R-3 use to construct a multi-family complex on South Hospital Drive: (1) Location for the proposed construction as the south three acres zoned C-2 legally described in Exhibit "A" of these minutes. (general location, across from Jackson Square Apartment complex and behind Mega Market in the Jackson Square Shopping Center) (2) Request; R-3 conditional variance with purchase of property pending (request void if denied) (3) Apartment complex containing 56 units, done in good taste, is planned with design criteria unfinished (if approved, a plot plan will be brought back to the Planning Commission for approval) (4) Arkansas Multi-Family Housing, LLC is primarily owned by a company that builds and develops apartments (at present approximately 6,000 apartment units under management in the central states, this endeavor being the first in Arkansas). (5) Financing presents urgency to bring the matter before the Commission. The Public Hearing was closed at approximately 7:08 p.m. by Vice Chairman Perry with no other comments pro or con from the audience. CITY OF JACKSONVILLE, ARKANSAS SPECIAL PLANNING COMMISSION MEETING JANUARY 29, 1998 7:00 P.M. - 7:12 P.M. Commissioner Piggee posed a question to City Engineer Duane Reel regarding any significant environmental impact upon the City of Jacksonville. City Engineer Reel voiced that it would not. He said they will fall in the same category with the apartments across the street, Jackson Square Apartments. Commissioner Rudy Reid questioned the action of the Board of Adjustment at their meeting Jan 28, 1998. Vice Chairman Perry related that the request for a dimensional variance for R-3 zoning in a C-2 zone was approved by the Board. Commissioner Reid voiced that the issue before the Commission is for a conditional use in a zone that has already been authorized and not for a zone change. Vice Chairman Perry pointed out that if the request is not granted to Arkansas Multi-Family Housing, LLC it will become null and void. Commissioner Piggee moved, seconded by Commissioner Nixon that the conditional request of Arkansas Multi-Family Housing, LLC, for R-3 use in a C-3 zone of South Hospital Drive, legally described in these minutes as Exhibit "A", be APPROVED. MOTION CARRIED with one abstention by Commissioner Walker. ANNOUNCEMENTS: ADJOURNMENT: Vice Chairman Perry adjourned the meeting at approximately 7:12 p.m. Respectfully, Lula M.
