REGULAR PLANNING COMMISSION MEETING

OPENING REMARKS:
Acting Chairman Gray opened the meeting and expressed appreciation
for those in attendance.
ROLL CALL:
Commissioners: Rudy Reid, Connie Foster, Lester Piggee, and Jack
Patton answered ROLL CALL. Acting Chairman Bart Gray Jr. also
answered ROLL CALL and declared a quorum. PRESENT five (5),
ABSENT (4).
Others present for the meeting were City Attorney Robert E.
Bamburg, Deputy City Clerk Susan Davitt, Computer Technician
Mylissa Founds and petitioners.
APPROVAL AND/OR CORRECTION OF MINUTES:
Commissioner Piggee moved, seconded by Commissioner Patton that
the minutes of the April 10, 1995 Regular Planning Commission
Meeting be APPROVED. MOTION CARRIED.
PUBLIC HEARINGS:
REQUEST TO SET UP PUBLIC HEARINGS:
Request to rezone Lot 000, Block 005 of the Edgewood Subdivision
to the City of Jacksonville
Acting Chairman Gray related that Ben Gary Inc. and owner David
Spicer are requesting the rezoning of Lot 000, Block 005 of the
Edgewood Subdivision, adding that Mrs. Margaret Mantooth was
representing the petitioner. He related that the current zoning
is residential and that the request is for a C-2 zoning.
Mrs. Mantooth briefly related where the property is located and
reiterated the petitioners request.
Commissioner Foster moved, seconded by Commissioner Piggee to set
a public hearing for the next regularly scheduled Planning
Commission meeting on June 12, 1995, regarding the rezoning of Lot
000, Block 005, of Edgewood Subdivision to the City of
Jacksonville from R-1 to C-2 . MOTION CARRIED.
Request to rezone property located at Valentine Road
Acting Chairman Gray related that at a previous meeting of the
Planning Commission the item of business was deferred until the
petitioner could be present.

Mr. Oldridge stated his desire to request a public hearing with
regard to the rezoning of the property to a C-1 zoning.
He related that he is planning to purchase the property and build
a heating and air conditioning service shop contingent upon the
rezoning.
Acting Chairman Gray informed Mr. Oldridge that the present owner
of the property would need to request the rezoning either alone or
jointly. He requested a letter of record from the owner of the
property. He related that the public hearing could be scheduled
stipulating that the letter be presented in a timely manner so
that the property can be properly advertised.
Commissioner Reid moved, seconded by Commissioner Patton to set a
public hearing for the next regularly scheduled Planning
Commission meeting on June 12, 1995, stipulating receipt of a
letter of intent from the owner requesting the rezoning from R-0
to C-1 of the following legally described property: Part of the
Southeast Quarter (SE 1/4), Section 36, Township 3 North, Range 11
West, and Partof the Northeast Quarter (NE 1/4), Section 1,
Township 2 North, Range 11 West, Jacksonville, Pulaski County,
Arkansas, being more particularly described as follows: Commencing
at the NE corner, Section 1, T-2-N, R-11-W; thence N 89 degrees
07' W, 1554.65 feet to the point of beginning; thence S 53 degrees
30' w, 219.60 feet; thence N 36 degrees 30" W, 348.23 feet; thence
n 53 degrees 30' E, 250.00 feet to the East right-of-way of
Valentine Road; thence S 36 degrees 30' E, along said right-of-
way, 348.91 feet; thence S 53 degrees 30'W, 30.40 feet to the
point of beginning: Containing 2.0' acres, more or less. The
owners presence at the public hearing was also requested in the
motion. MOTION CARRIED.

DISCUSSION: Annexation of various areas and the Jacksonville
Municipal Code Chapter 17.20.060 regarding Culdesac length.
City Engineer Reel related that because of the numerous requests
for variances for culdesac length, it has previously been
discussed changing the ordinance setting the requirements. He
related that in discussions with the Fire Chief it was pointed out
that with regard to a 1,000 foot culdesac, adequate fire
protection would need to be provided to the end lots. He stated
that the developer would be responsible for placing adequate

border lines to acomodate for installation of a fire hydrant 500
feet from the end of the

culdesac. He further related other items that need addressing
in ordinance changes: 1) making it unlawful to pour concrete in
gutters for the purpose of smoothing driveway entrances; 2)
making it unlawful to install athletic equipment at the back of
curbs which encourages children to play in the street and impedes
traffic.
Discussion ensued as to standards and conditions with regard to
setting culdesac length. It was related that geometrics would
largely determine a variance request for more than 1,000 feet. It
was noted that the addition of 500 feet in culdesac length would
not increase evacuation problems.
Chief Hibbs related that the last evacuation did not cause a
problem with regard to culdesac areas. He stated that the
problems
mentioned in association with culdesacs were caused from cars
being parked along the curb, making it difficult for fire and
sanitation trucks to turn adequately.
City Engineer Reel related that the Planning Commission might want
to consider increasing the width of culdesacs between 30 to 33
feet which would solve the problem. He related that the present
radius of culdesacs does not facilitate the Fire Department ladder
truck, adding that Fire Chief Ezell has requested that the
Planning Commission investigate the possibility of increasing the
paved area in a culdesac to a 100 foot radius. He then related
that this would also solve damage problems to the culdesacs made
when heavy trucks have to turn sharp to get around the culdesac.
Discussion ensued involving subdivision regulations and proposed
changes. City Engineer Reel volunteered to gather further data
for consideration before it is presented in ordinance to the City
Council inviting input from the Commissioners.
Acting Chairman Gray related that reports regarding annexation of
four areas surrounding the City has been submitted to the Planning
Commission and are described as Valentine and Wooten Road area,
Graham Road, Military Road, Loop Road to the County line, north of
the Air Base which includes Peters Road, Roderweis Road over to
Centennial, and an area by the back gate of the Air Force Base.
Chief Hibbs referred to his written report with regard to the
proposed annexations. He stated that he would also like to
discuss an area located along Vandenburg which has caused some

confusion over jurisdiction. He related that the security police
on base are sometimes forced to call the county or state police
because some areas on base are not located inside the city limits.

City Attorney Bamburg related that this not only creates
difficulty for the security police and city police but also for
the courts with prosecution. Other situations which cause
jurisdiction difficulty were cited by Chief Hibbs.
Discussion ensued over a joint effort with the Air Force and City
regarding annexing the entire Air Force base. It was related by
Chief Hibbs that the annexation of the base property would not
require any additional force or expense and that military law
would continue to supersede the city law with regard to military
personnel requiring assistance only when civilians are on base.
He then related that with regard to the proposed annexation of the
south, east, and west areas the Police Department would be able to
use zones already in place without additional budgeting. He
stated that the annexation of these areas is seen by the Police
Department as a matter of cleaning up and simplifying city limit
lines.
It was noted that the fire coverage would have to be addressed by
Fire Chief Ezell.
Public Works Director Skip Spears presented his report, stating
that with regard to development in the City it has already reached
the point with current subdivisions that another sanitation truck
will need to be added in a year or two. He discussed the revenues
for sanitation operation and the possibility of an increase in
Sanitation cost next year. He related that the west area will
have no impact on current collection until it is further
developed, adding that the Valentine area in the south is on
Tuesday's route and would not be significant with regard to time.
He stated that two-thirds of the City is currently being offered
recycling service however adding another truck will need to be
considered should the EPA require mandatory recycling. He related
that with regard to the Street Department the proposed north
annexation will have a large impact on mowing, ditch work, and
mosquito spraying, while the roads are in fairly good shape. He
related that the Wooten Road and Valentine Road will require
significant drainage attention because it lies in a low, flat area
which is in the flood plain. He noted the problems with beaver
control and required mosquito spraying in the area. He related
that the west and south area could be incorporated into the Street
Department system with little impact but that Wooten Road and the
northern area would create significant increases. He related that

the Animal Control Department would experience difficulty with
regard to regulations that have not previously applied to citizens
in the northern area.

City Engineer Reel related that an increase in manpower would be
needed in the Code Enforcement Department.
Breakdowns on cost and services were discussed with regard to
annexation. Public Works Director Spears related that the
revenues collected from annexation would not be as significant as
the cost to incorporate these areas. He then related that fee
increases with regard to Sanitation are projected with future
growth in mind in order to prevent raising fees annually.
Commissioner Foster requested clarification with regard to the
budgeting for a recommendation of annexation to the City Council.
Acting Chairman Gray related that the Planning Commission is the
first phase for annexation. He stated that it is a matter of
cost/benefits; cost to the current citizens and benefits to all
citizens in the future. He pointed out that it is the
responsibility of the Planning Commission to analyze annexations
and make recommendations to the City Council.
Discussion ensued as to the operation and preparation of the
annual budget as well as the decision making process with regard
to expenditures for proposed annexation.
Acting Chairman Gray related that he feels personally that a great
deal of consideration needs to be given to the question of equal
service for all citizens. He related that the issue of water and
sewer has not been dealt with yet, giving the Planning Commission
other considerations and need for additional information.
City Engineer Reel related that areas with no present population
should be considered for annexation for cost reasons. He
mentioned the Metropolitan Trust property between General Samuels
and Bayou Meto going toward Harris Road. He pointed out that the
taxes would drop under annexation for that piece of property
because of the difference between City and County taxes.
In response to a question posed by Commissioner Foster, Chief
Hibbs related the nature of team work between County and City
Police with regard to areas located in the Jacksonville City
limits and Lonoke County.

various departments.
