JUNE 12, 1995

OPENING REMARKS:
Chairman Brannen opened the meeting and expressed his appreciation to those in attendance and Commissioner Gray who chaired the previous meeting.
ROLL CALL:
Commissioners: Rudy Reid, Connie Foster, Jim Dornblaser, Kenny Elliott, Bart Gray, Jr., Lester Piggee, Leslie Belden and Jack Patton answered ROLL CALL. Chairman Brannen also answered
ROLL CALL and declared a quorum. PRESENT nine (9), ABSENT (0).
Others present for the meeting were City Attorney Robert E. Bamburg, Deputy City Clerk Susan Davitt, and petitioners.
PUBLIC HEARINGS:
a. Request to rezone property located at Valentine Road
Chairman Brannen opened the public hearing at approximately 7:03 p.m.
Mr. Jerry Oldridge spoke on behalf of the request informing the Commission that the owner of the property Mr. Dub Mitchell who was present for the meeting has offered to sell the property
for the purpose of operating a heating and air conditioning shop.
Mr. Dub Mitchell owner of the property related that there is a title problem with the property that will be taken care of before the sale is completed.
Chairman Brannen closed the public hearing at approximately 7:05 p.m. and invited comment from the Planning Commissioners.
Commissioner Dornblaser clarified that the adjacent area is zoned residential and inquired as to how the request is related to the comprehensive plan.
Commissioner Gray related that the revisions to the land use plan established a commercial zone along Hwy 161, 300 feet wide on each side adjacent to the right-of-way lines.
General discussion ensued and it was the consensus of the Commission that the property is within these guidelines and that the request does not follow in keeping with the land use plan.

Commissioner Belden moved, seconded by Commissioner Dornblaser to deny the request to rezone the property located at Mayfair and
Valentine Road. A ROLL CALL VOTE WAS TAKEN: Commissioners
Elliott, Reid, Foster, Gray, Dornblaser, Piggee, Belden, and Patton voted AYE. (9) voted AYE. (0) voted NAY.
b. Request to rezone Lot 000, Block 005 of the Edgewood Subdivision to the City of Jacksonville
Chairman Brannen opened the public hearing at approximately 7:10 p.m.
Mr. David Spicer related that the property is not coordinated for residential development since the only access to the property is from the frontage road. He then related that the property
is surrounded by ditches on all sides, which he stated he would fill in at considerable cost.
In response to a question posed by Chairman Brannen, Mr. Spicer related that drainage concerns would be addressed by the City Engineer who has already surveyed the property with regard
to drainage.
Commissioner Elliott asked what the intended use of the property would be if it were rezoned to C-2. It was related by Mr. Spicer that he has not decided at this time adding that it
would be in coordination with the Mr. Gray's real estate office.
Chairman Brannen closed the public hearing at approximately 7:16 p.m.
Commissioner Dornblaser stated he was not in favor of rezoning which would not be in keeping with the comprehensive land use plan without knowing what the intended use would be.
Further discussion ensued as to the different uses permitted within a C-2 zoning and concerns for the residential area which it backs up to. It was noted that the property would be
better suited for commercial use than residential, adding that a lower commercial zoning would protect the surrounding residential area.
Commissioner Belden pointed out that the use of the land is well suited for commercial adding that a lower commercial zoning would be more ideal for the surrounding residential area.

Commissioner Dornblaser pointed out what Metroplan had related with regard to blind rezoning and establishing land use policies. He stated that while it may be suited for commercial
development, not all C-2 uses are suitable to be backed up to a residential area.
Discussion ensued as to the permitted and conditional uses of a C-2 zoning classification which may be objectionable to the surrounding residential area. It was noted that the area
consisted of almost 1/2 acre.
Commissioner Belden asked if the petitioner would be agreeable to a rezoning of the area to a C-1 zoning classification instead of the requested C-2.
Discussion ensued as to the permitted uses in a C-1 zoning classification and concerns with regard to future development if sold while zoned C-2.
Mr. Spicer related that at a later time he may develop the area for a real estate office. After reviewing the list of C-1 permitted uses, Mr. Spicer stated that a C-1 zoning would be
acceptable.
Commissioner Piggee moved, seconded by Commissioner Belden to approve a rezoning of the property to a C-1 zoning classification. A ROLL CALL VOTE WAS TAKEN: Commissioners: Elliott,
Reid, Foster, Piggee, and Belden voted AYE. Commissioner Gray abstained. Commissioners: Dornblaser and Patton voted NAY. (5) voted AYE. (2) voted NAY. (1) ABSTAINED.

DISCUSSION: Recommended revisions of the Jacksonville Municipal Code.
City Engineer Reel reviewed the following recommended changes as follows:
* exact verbiage will be determined by the City Attorney for ordinance presentation.
Permitted uses, Chapter 18, of a higher zoning classification would become conditional uses and subject to approval by the Board of Adjustment.

ADDITION: 2.32.050 Meeting Representation:
The Jacksonville Planning Commission has the authority to require petitioner or representative of petitioners to be present at Planning Commission meeting in order for submitted item
of business to be heard by Commission.
ADDITION: 12.24.100 Curbs and Gutters:
Placing of playground equipment at the back of curb to encourage
adults and/or children to play in street is prohibited.
Placing of concrete or any other obstruction that would interfere with the normal drainage pattern in gutter to smooth entrance to driveway is prohibited. Fine of $100.00.
ADDITION: 12.24.110 Streets and Sidewalks:
Sidewalks are to meet all A.D.A. requirements. Must be held off the back of curbs a minimum of three feet.
ADDITION: 12.24.120 Storm Drainage:
Piling of leaves, branches, etc. on top of or inside drop inlets or drainage ditches is prohibited.
AMENDMENT: 15.12.030 Residential construction:
New construction or substantial improvements of any residential structure shall have the lowest floor, including basement, elevated *at least 1' above the base flood elevation. A registered
engineer, architect, or land surveyor shall submit certification to the city engineer that the standard of this selection, as proposed in section 15.16.030 is satisfied.
AMENDMENT: Non residential construction:
New construction or substantial improvements of any commercial, industrial or other nonresidential structure shall either have the lowest floor (including basement) elevated *at least
1' above
the base flood level or, together with attendant utility and sanitary facilities, be designed so that below the base flood level the structure is watertight with walls substantially
impermeable to the passage of water and with structural components having the capability of resisting hydrostatic and hydrodynamic roads and effects of buoyancy. A registered professional
engineer shall develop and/or review structural design, specification, and plans for the construction, and shall certify that the design and methods of construction are in accordance
with accepted standards of practice as outlined in this subsection. A record of such certification which includes the specific elevation (in relation to mean sea level) to which such
structures are flood proofed shall be maintained by the City Engineer.

AMENDMENT: 15.12.050 Manufactured Homes:
c. Require that all manufactured homes to be placed or substantially improved within Zones Al-30, AH and AE on the community's FIRM be elevated an a permanent foundation such that the
lowest floor of the manufactured home is at*least 1' above the base flood elevation; and be securely anchored to an adequately anchored foundation system in accordance with the provision
of Section B(4) of this Article.
ADDITION: 15.12.080 Standards for Subdivision Proposals:
If property is to be filled to raise above the Base Flood Elevation developer is to submit all required forms to FEMA with proof of submittal at time of presentation of Final Plat.
AMENDMENT: 17.12.140 Final plat - Time limit on submission.
The final plat of the proposed subdivision shall be submitted to the Planning Commission for final approval within one year of the date on which the preliminary plat was approved. If
not plat shall be considered as an extension of time. *with regard to fees paid or additional fees required and plat submittal. The final plat shall be filed in the Office of the Circuit
Clerk and ex officio recorder within six months after approval by the Planning Commission. If not filed with in such time, said approval shall be considered as having been voided.
17.16.010 Plat Requirements and Fees:
ADDITION: #13 Lots located in a designated flood hazard area is to be designated with an "F" in conjunction with the lot number.
DELETION: #21 Location and dimensions of all proposed water lines and fire hydrants.
DELETION: #22 e. Certificate of City Council and/or county judge acceptance of easements & dedications:
ADDITION: #22 e. Bill of Assurance. (reg. w/ Final Plat)
DELETION: #23 Marginal lines encircling the sheet. All lettering, signatures and seals shall be within the margin. (Preliminary and Final Plat)
17.16.020 Information to be submitted with plats:
DELETION: #7 Four copies of the estimate of cost of:
a. Sanitary sewers;
b. Water lines, valves and hydrants;

ADDITION: #9 twelve blue-line prints of the proposed plat drawn to a scale acceptable to the City Engineer. (Sketch, Preliminary and Final)
Three certifications needed to clarify what the city requires on plat submittals need to be added to the Jacksonville Municipal Code Book. (Exhibit A of these minutes.)
17.20.060 Cul-de-Sac and Dead-end Streets:
There was a general discussion with the consensus of the Commission that City Engineer Reel bring a recommendation to the next meeting on the 26th of June for consideration.
AMENDMENT: b. Turnaround. Cul-de-sac shall terminate in a turnaround with a property line radius of not less than *sixty feet.
ADDITION: 17.20.150 Street name and Subdivision - Generally:
Partial phasing of subdivisions will not be allowed (i.e. - Phase I-A, B, C, etc.). No subdivision name is to be changed after Final Plat approval without the approval of the Planning
Commission.
17.20.190 Erosion Control Plan:
ADDITION: Contractor, Developer, Landscaper, individual, or any other person involved in excavating or filling operations must submit and adhere to an Erosion Control Plan acceptable
to the City Engineer. Erosion Control Plan is to be maintained during the entire length of the project.
18.04.160 Conditional Uses:
There was a general discussion with the consensus of the Commission that conditional uses be further reviewed to include recommendations from the Planning Commissioners and discussed
at the regularly scheduled meeting in July.
City Attorney Bamburg related that each of the zoning classifications would need to be thoroughly reviewed.
Commissioner Belden asked that a history of request be reviewed to provide a better understanding of the types of requested variances.

AMENDMENTS: 18.68.050 Dimensional requirements:
It was discussed at the last meeting to change building setbacks to being determined by the street classification rather than by zoning...(i.e. - Residential Streets - 25', Collector
Streets - 35', Minor Arterial Streets - 40'.
It was noted by the City Attorney that after passage from the City Council that citizens in violation of these additions and amendments would be given a period of time to conform to
code.
Chairman Brannen commended the Planning Commissioners for their efforts with regard to progressive changes over the last few years.
