OPENING REMARKS:
Chairman Brannen opened the meeting and expressed his appreciation
to those in attendance.
ROLL CALL:
Commissioners: Rudy Reid, Connie Foster, Jim Dornblaser, Bart
Gray, Jr., Lester Piggee, and Jack Patton answered ROLL CALL.
Commissioner Elliott came in at approximately 7:15 p.m. Chairman
Brannen also answered ROLL CALL and declared a quorum. PRESENT
EIGHT (8), ABSENT (1).
Others present for the meeting were City Attorney Robert E.
Bamburg, City Engineer Duane Reel, Deputy City Clerk Susan Davitt,
and petitioners.
APPROVAL AND/OR CORRECTION OF MINUTES:
Commissioner Dornblaser moved, seconded by Commissioner Reid that
the minutes of the May 8 and June 12 Regular Planning Commission
Meetings be APPROVED as presented. MOTION CARRIED.
REQUEST TO SET UP PUBLIC HEARINGS:
REQUEST TO APPROVE BUILDING PERMITS: Remodel and Expand Existing
Structure/corner of Bailey & Main Streets (previously Baskin
Robbins)
Mr. Scott Farrell represented the item of business requested by
Mr. Harry Daugherty.
He presented a layout of the proposed construction at the corner
of Bailey and Main Streets. He said that the existing space will
be remodeled and additional space, as indicated on the drawing
presented to the Commission, would be added to the west side of
the existing structure. He pointed out that there would be ten
spaces for parking in the rear of the building, a sidewalk on the
west side and a garden area, with a low retaining wall
approximately two (2) feet to thirty (30) inches high, in the
front of the building. He pointed out that the metal encasement of
the existing building and the proposed metal addition would be
covered in brick veneer. He noted that the use of the structure
is designed to accommodate quite office activity.
There was discussion regarding two power poles on the west side of
the building and how traffic was complicated with use of the

parking lot on the west side of the existing building. He said
that parking as proposed will solve problems with cars backing
into Bailey Street.
City Engineer Reel explained that the low wall encasing the garden
area will not obstruct visibility.
Words of commendation were expressed from the Commission regarding
the proposal to upgrade Main Street with the construction as
proposed.
After a question by Commissioner Gray regarding the widening of
Bailey Street, City Engineer Reel explained that at this time the
existing building would have to be acquired as right of way if
such a situation existed.
Commissioner Dornblaser moved, seconded by Commissioner Foster
that the building permit requested by Mr. Harry Daugherty to
remodel and expand the existing building at the corner of Main and
Bailey Streets with variance of the side yard granted also.
MOTION CARRIED UNANIMOUSLY.
REQUEST TO APPROVE PLATS: PENNPOINTE PHASE II (Condominium
Complex)
City Engineer Reel pointed out that there are variations from the
Jacksonville Municipal Code with regard to R-5 zoning in the
Preliminary Plat as presented. He noted the following in the
Code: 25 foot wide lots, 25 foot front yard, 25 foot rear yard
plus the building is not to take up more than fifty (50) percent
of the lot.
He pointed out that looking at this type of development in the
Memphis, Dallas and Little Rock areas, that lots are more square
allowing less yard which is desirable for persons desiring the
kind of housing afforded in the condominium concept. He said that
2,000 minimum to 3,500 foot homes are being proposed with an
island for excess parking and a common park area for persons in
the subdivision. He said that basically the concept is what zero
lot line calls for adding that the lots are wider and not as deep
as required by ordinance.
He said that a fifteen foot walk is designed to go around the
entire lake which will accommodate those who desire to use it.

There was general discussion regarding the width of the street,
the width of the culdesac as proposed, accessibility for fire and
police protection, busses, and garbage service as well as utility
easements.
Mr. Penn noted that the culdesac is to have a forty-five (45) foot
radius and a twenty (20) foot street.
Commissioner Bart Gray questioned whether or not there would be
joint ownership in the development of lots which are zoned R-5.
He questioned the sale of lots and the responsibility of the City
with regard to streets and the extra parking.
Mr. Penn voiced that whatever the City feels is fair would be
acceptable in the development.
There was a general discussion regarding the liability of the City
in the event a gate is constructed across the street as a private
ingress and egress. Accessibility for police, fire, garbage pick-
up, and bus service was also discussed.
It was pointed out that the Fire Department would need a sixty
foot radius to turn the ladder truck around as culdesac length and
radius was discussed. Mr. Reel said that he did not feel there
would be a problem with the development as proposed.
Commissioner Dornblaser voiced that he felt there needs to be
clarification regarding a twenty (20) foot street one way, versus
a twenty-seven (27) foot street, adding that a Bill of Assurance
should be submitted as well. He said that accessibility of bus
service for school children was also a concern.
Discussion ensued again as to the accessibility of a card gate
entrance with regard to the fire, police and garbage. It was
suggested that the property owners may want to maintain a common
general ownership of the property and the streets since public
streets are dedicated to public use. Consensus was that
neighboring cities may offer insight into handling this type of
development with regard to public use and safety concerns for the
residents.
City Engineer Reel responded to a question posed by Commissioner
Dornblaser by relating the main street in the development is 28
ft. wide narrowing to 20 ft. as it goes around the park area. He
stated that it would need to be designated with a sign requiring
traffic to turn right upon entering the development. He related

the outside of the street and leaving the inside area next to the
park un-curbed.
After discussing problems with delay of the project Commissioner
Gray offered consideration of acceptance for the lot layout,
adding that other concerns could be addressed as development
unfolded.
City Engineer Reel clarified development concerns with regard to
culdesac radius in phase I.
The Commission concluded that the object of present concern is the
lot layout leaving the parking area and culdesac radius for future
review.
Commissioner Gray moved, seconded by Commissioner Dornblaser to
approve the Preliminary Plat Plan as presented with the exception
of the parking area and the turning radius of the inner street
with further stipulations that the recorded final plat show a one
way circle with no on street parking. MOTION CARRIED.
Commissioner Gray suggested that Mr. Penn consider privatizing the
entire area which would grant leeway to present concerns held by
the Commission. He stated that if it is built and maintained
privately there would not be the concerns presently over public
access and use.
Discussion ensued as to the repercussions of privatizing the
streets. It was suggested that before he make his final decision
regarding the streets and common areas he seek legal advise.
PUBLIC HEARINGS:
DISCUSSION: Zoning Changes/Culdesac and Conditional Uses.
ZONING/CULDESAC
Chairman Brannen introduced discussion regarding culdesac length.
City Engineer Reel related that most property developed would
support a culdesac of 1200 feet. He suggested that the maximum
not be over 1200 feet reminding the Commission that no matter what
length is set, a variance will still be requested.
Commissioner Dornblaser related that he felt that the number of

houses to be developed and lot size needs to be part of the
equation given consideration to traffic flow.

City Attorney Bamburg related that he and the City Engineer had
discussed using 1000 feet unless the topography indicated or
provided for otherwise. He then related that this would give the
Planning Commission discretion where the topography of the land
would support a culdesac of 2000 feet in length without
stimulating concerns adding that in such a case the radius at the
end of the culdesac might be 80 feet. Factoring that in smaller
areas given safety and traffic flow concerns the Planning
Commission may warrant a shorter culdesac providing a basis for
determining proper culdesac length. He offered that from a legal
standpoint it would need to be done on a consistent basis. He
stated that a list of factors would need to be included in the
statement of culdesac length so that developers could be prepared
to address those issues as plats are prepared.
Commissioner Elliott reminded the Commissioners that whatever is
decided with regard to the length of a culdesac, decisions by the
Commission would have to be consistent.
There was general discussion regarding a number of dead end
streets which have been allowed in subdivision development in the
City.
Commissioner Dornblaser moved, seconded by Commissioner Foster
that culdesac length be designated 1,200 feet with considerations
given to the topography of the land, size of the lots, ingress and
egress and public safety. MOTION CARRIED.
ZONING/CONDITIONAL USE
City Engineer Reel explained that information from Metroplan has
brought attention to the existing Municipal Code and that he feels
the following changes in Permitted Use and Conditional Use areas
of the code should be changed. Said changes to the code (to be
heard by the Board of Adjustment) were presented as follows:
18.26.030 Conditional uses.
The conditional uses in the R-1A district are:
Any use permitted in R-0 and R-1 districts (deleted from
Permitted use)
18.28.010 Purpose for establishment.
The R-2 district is established to permit the developing of
two-family site built dwellings.

Commissioner Piggee moved, seconded by Commissioner Patton that
the recommendations as listed in these minutes be prepared by the
City Attorney and presented for final approval at the next regular
meeting of the Commission. MOTION CARRIED.
ANNOUNCEMENT:
Chairman Brannen related that a workshop with Metroplan will be
scheduled for September.
He also pointed out that he is scheduled to meet with Mayor Swaim,
Ms. Belden and Mr. Phil Sullivan on 19 July 1995 regarding
annexation.
ADJOURNMENT:
