95 DEC 11.doc CITY OF JACKSONVILLE, ARKANSAS REGULAR PLANNING COMMISSION MEETING DECEMBER 11, 1995 7:00 P.M. - 7:50 P.M. OPENING REMARKS: Vice Chairman Bart Gray Jr. opened the meeting and expressed appreciation for those in attendance. ROLL CALL: Commissioners: Rudy Reid, Jim Dornblaser, Kenny Elliott, and Lester Piggee answered ROLL CALL. Vice Chairman Gray answered ROLL CALL and declared a quorum. PRESENT five (5), ABSENT (3). Others present for the meeting were City Attorney Robert E. Bamburg, City Engineer Duane Reel, Deputy City Clerk Susan Davitt, Engineering Receptionist Marci Wilson, and petitioners. APPROVAL AND/OR CORRECTION OF MINUTES: Commissioner Piggee moved, seconded by Commissioner Dornblaser that the minutes of the November 13, 1995 Regular Planning Commission Meeting be APPROVED. MOTION CARRIED. REQUEST TO SET UP PUBLIC HEARINGS: (Latta Property Rezoning referred back to the Planning Commission by the City Council) Vice Chairman Gray stated that the City Council has referred to the Planning Commission a request to rezone from C-1 to C-2 a parcel of land owned by Mr. Buford Latta fronting on T.P. White Drive. He related that the request was modified by the petitioner after Planning Commission action in November and that the request presented to the City Council has not been properly advertised or posted according to legal process as determined by the City Attorney. He pointed out the need to follow proper procedure. Attorney Mike Wilson expressed that he and the petitioners understand the desire of the City to properly post the property and voiced that they will respect the delay. He pointed out that the request before the Planning Commission is to rezone to C-2 only the north 200 feet of one lot which is owned by Mr. Buford Latta. He noted that Mr. Andy West will request a public hearing before the Board of Adjustment regarding the operation of the business planned for the parcel. At this time, Commissioner Dornblaser moved, seconded by Commissioner Piggee that a public hearing be set for January 8, 1995 at 7:00 p.m. during the regular meeting of the Planning Commission to hear the request to rezone from C-1 to C-2 the north 200 feet of a parcel located from T.P. White Drive to 1000 Madden Rd. owned by Mr. Buford Latta. MOTION CARRIED. The legal description is included in these minutes as Exhibit (A). CITY OF JACKSONVILLE, ARKANSAS REGULAR PLANNING COMMISSION MEETING DECEMBER 11, 1995 7:00 P.M. - 7:50 P.M. REQUEST TO APPROVE BUILDING PERMITS: HOLIDAY INN City Engineer Reel voiced that all building line setbacks were met with no waivers being requested and adequate parking as required by the Jacksonville Municipal Code. Commissioner Elliott moved, seconded by Commissioner Dornblaser that the building permit request of Holiday Inn be approved as presented. MOTION CARRIED. REQUEST TO APPROVE PLATS: PRELIMINARY & FINAL PLAT of the CARMEN-JEWELL SUBDIVISION City Engineer Reel voiced that Mr. & Mrs. Jewell live out of town but have contacted his office regarding a Bill of Assurance which is forthcoming. Mr. Tommy Bond voiced that there are three lots being dealt with. City Engineer Reel explained that Lot 3 is not tied to any public thoroughfare noting that there are other pipe stem lots in subdivisions around town where access to property is allowed. He explained that an access easement consisting of a 25' stem from Toneyville Rd. back to a connection with Lot 3 actually becoming a part of that lot. He said that part of the easement would be a part of Lots 3 and 1 making access for Mr. Pearl and a service area with regard to utilities. Commissioner Kenny Elliott moved, seconded by Commissioner Piggee to approve the PRELIMINARY AND FINAL PLAT of the Carmen-Jewell Subdivision with the stipulation that the north 25' of Lot one (1) become a part of Lot 3 and that a Bill of Assurance be filed with the City Engineer. MOTION CARRIED. It was pointed out by Commissioner Elliott that building lines should be noted on the plat which was agreed to by Mr. Bond representing the petitioner. LONG FORD COMMERCIAL SUBDIVISION: PRELIMINARY AND FINAL PLATS Mr. Tommy Bond represented the item of business. Commissioner Elliott voiced that he felt that building lines and easements should be disclosed on the plat before the Commission. Mr. Bond agreed to the request and related that a Bill of Assurance has been filed. CITY OF JACKSONVILLE, ARKANSAS REGULAR PLANNING COMMISSION MEETING DECEMBER 11, 1995 7:00 P.M. - 7:50 P.M. Discussion ensued regarding Tract A. Mr. Bond related that City signs presently occupy that portion of land and that there is a possibility that Mr. Long may want to use the parcel for his signs. Commissioner Gray pointed out that Tract A is shown as not being a part of Lot 2. Mr. Bond agreed. Commissioner Dornblaser moved, seconded by Commissioner Reid that the PRELIMINARY and FINAL PLATS of Long Commercial Subdivision be approved as presented with the stipulation that the necessary setbacks and easements be added to the plats with the following friendly amendment to the motion: that the City be granted 60 days to determine whether or not it has any legal interest in Tract A. MOTION CARRIED. City Engineer Reel related that water and sewer approval is forthcoming and that the plat will not be signed until said approval is given. The consensus of the Commission was given on the statement by Mr. Reel. MAIN STREET REVITALIZATION: City Engineer Reel related, after a question by Commissioner Dornblaser that the Main Street Revitalization Committee has been combined with the Chamber of Commerce with formation of a different committee. City Attorney Bamburg stated that a non-profit organization group of property owners has been set up in relation to Economic Development and Chamber of Commerce efforts. A meeting scheduled by the Economic Development Department for Tuesday, 12:00 noon at Ramada Inn, 12 December 1995 was announced. Commissioner Dornblaser mentioned that annexation efforts have not been pursued and requested that efforts be resumed to which Commissioner Elliott agreed. Commissioner Dornblaser related that he favored further work on modifying Municipal Codes and requested that it become an item of business for the Planning Commission. City Engineer Reel stated that items could be brought to his attention and efforts to make proper changes will be brought before the Commission. Chairman Gray reminded the Commission of existing and upcoming vacancies and requested that suggestions for persons to fill those positions be passed on to Mayor Swaim.
