94 SEPT 12.docCITY OF JACKSONVILLE, ARKANSAS REGULAR PLANNING COMMISSION MEETING SEPT. 12, 1994 7:00 P.M.  7:40 P.M. OPENING REMARKS: ROLL CALL: Commissioners: Rudy Reid, Lester Piggee, Leslie Belden and Jack Patton answered ROLL CALL. Commissioner Connie Foster came in at approximately 7:20 p.m. Vice Chairman Art Brannen answered ROLL CALL and declared a quorum. PRESENT six (6), ABSENT (4). Others present for the meeting were City Attorney Robert E. Bamburg, City Engineer Duane Reel, Deputy City Clerk Susan Goings and petitioners. APPROVAL AND/OR CORRECTION OF MINUTES: Commissioner Belden moved, seconded by Commissioner Piggee that the minutes of the August 8, 1994 Regular Planning Commission Meeting be APPROVED. MOTION CARRIED. (Vice Chairman Brannen voted AYE.) REQUEST TO SET UP PUBLIC BEARINGS: No requests were submitted. REQUEST TO APPROVE BUILDING PERMITS: Auto Zone 1606 N. First St. / Variance requested re: Rear Setback (map included in packet) City Engineer Reel voiced that Auto Zone has requested a building permit in the old Bomber Base Addition to the City of Jacksonville on the west side of North First Street immediately east of Jacksonville Dodge. He said that all things are in order pointing out that a variance is requested regarding a change from the ten (10) ft. rear yard requirement down to five (5) ft. He said that the City has no problem with the request and that it was passed on to the Fire Department adding that they had no objection to the request as long as the builders agreed to install a sprinkler system in the building to certain fire protection specifications. He said they did agree to the requirement of the Fire Department. He said that the original request included two units of access noting that after municipal code requirements were explained, the request was cut back to one drive which will be at the north end of their property. He noted that use of one driveway at Hardy's would be permissable with the City if agreed upon by the two businesses. He pointed out that construction completion would be about the same time that the widening of North First would be completed. Commissioner Belden moved, seconded by Commissioner Reid to APPROVE the building permit request of Auto Zone with a variance to a five (5) ft. rear yard setback granted. MOTION CARRIED. 1 CITY OF JACKSONVILLE, ARKANSAS REGULAR PLANNING COMMISSION MEETING SEPT. 12, 1994 7:00 P.M. - 7:40 P.M. The City Engineer related to the Commission that construction on the widening of North First Street is due to begin in February or March with completion in approximately eighteen months. Commissioner Belden noted that she is representing the City of Jacksonville in meetings held by Metroplan and that efforts are being made to improve transportation problems within the greater Pulaski County area going from Lonoke to Benton to Beebe to Conway. b. Gateway Apartments 403 Trickey Lane / Pathfinders Colleen Black related that upon completion of the facility located on Mulberry the units were filled. She related that the proposed Gateway Apartments will have thirteen units available for individuals with developmental disabilities and they expect them to be filled quickly. City Engineer Reel related that heavy rainfalls created erosion problems from Bailey Street to First Street and related that he asked the architects of the Gateway Apartments Project to design an erosion control plan to address the issue of drainage and erosion which would prevent this from occurring. He related that with regard to drainage for the Gateway Apartments there is a major drainage ditch on the east side and that on the south and north there are drainage ditches that supply Old Military Road. Commissioner Piggee moved, seconded by Commissioner Reid to approve the building permit requested by Pathfinders for Gateway Apartments at 403 Trickey Lane with the stipulation that an erosion control plan be implemented to the satisfaction of the City Engineer. MOTION CARRIED. REQUEST TO APPROVE PLATS: Final Plat/Northlake Subdivision Phase V/Petitioner Tommy Dupree Tim Lemons from Bond Engineering requested that the final plat be considered as a revised preliminary plat. He related that the preliminary plat had been approved years ago with construction progressing slowly. He stated that they would like to bring a final plat to the Commission next month when the construction is one hundred percent complete. Chairman Brannen pointed out that the previously approved preliminary plat consisted only of Phase V-A adding that Phase V-B may never have been approved at the preliminary plat stage and is now incorporated into the current plat of Phase V. 2 CITY OF JACKSONVILLE, ARKANSAS REGULAR PLANNING COMMISSION MEETING SEPT. 12, 1994 7:00 P.M. - 7:40 P.M. (Commissioner Foster came in at approximately 7:20 p.m.) Mr. Lemons confirmed that lots 169 through 173 and 194 through 201 are now being added to the preliminary plat. Chairman Brannen posed a question concerning the flood zone designation on lots 164 through 168. Mr. Lemons related that the lots have been filled, adding that they are in the process of having FHMA remove the lots from the flood plain. He related that it is his hope to have this taken care of at the stage of final plat presentation. He stated that the plat would be recorded with the flood zone designation if they were not able to have the lots removed in time for the final plat presentation. Discussion ensued as to what phase of the subdivision the plat before the Commission would be called. Planning Commission Secretary Lu Leonard clarified past action of the Planning Commission by reading minutes of May 12, 1986 regarding approval of Phase V-A which indicated the future development of Phase V-B. It was then agreed that with the development of Phase VI the present phase would be referred to as Northlake Subdivision Preliminary Plat Phase V. Discussion ensued as to the future development of adjacent property and the present status of the ingress and egress of Phase V with the possibility of a culdesac and a variance. City Engineer Reel related that the entire subdivision contains two avenues for ingress and egress that being Oneida and Indian Head leading to Sherwood. He related that Phase V was a part of the overall plan which has been approved and that future development might make Timberwolf a through street. Chairman Brannen requested confirmation that lots 163 through 173, 194 through 206, 226A and 227A are included in the Preliminary Plat Phase V. 3 CITY OF JACKSONVILLE, ARKANSAS REGULAR PLANNING COMMISSION MEETING SEPT. 12, 1994 7:00 P.M. - 7:40 P.M. Mr. Lemons agreed that they were and indicated that along with the Final Plat of Northlake Phase V they would present the Preliminary Plat of Northlake Phase VI. Commissioner Piggee moved, seconded by Commissioner Foster to approve the Preliminary Plat of Northlake Subdivision Phase V. MOTION CARRIED. SKETCH PLAT FOXWOOD PHASE X Chairman Brannen related that a sketch plat for Foxwood Phase X has been presented for action pointing out that a motion and second was in order. Commissioner Reid moved, seconded by Commissioner Patton to suspend the rules and place the Sketch Plat of Foxwood Phase X on the agenda as an item of business. MOTION CARRIED. (Commissioner Belden abstained from the voting process.) Mr. Tim Lemons represented the item stating that it is a continuation of the Foxwood Subdivision noting that lots in this phase are approximately eighty (80) ft. by one hundred forty- eight (148) ft. to one hundred sixty-seven (167) ft. with two culdesac streets. He said that existing utilities will meet code requirements. He noted that a preliminary plat will be presented in the month of October upon approval of the sketch plat. City Engineer Reel said that all minimum standard requirements as far as the lot sizes are concerned, streets, storm drains, water and sewer etc. will be addressed in the preliminary plat. Commissioner Patton moved, seconded by Commissioner Piggee that the SKETCH PLAT OF FOXWOOD PHASE X be APPROVED. MOTION CARRIED.
