94 JULY 11.docCITY OF JACKSONVILLE, ARKANSAS REGULAR PLANNING COMMISSION MEETING JULY 11, 1994 7:00 P.M.  7:35 P.M. OPENING REMARKS: ROLL CALL: Commissioners: Rudy Reid, Art Brannen, Tad Green, Lester Piggee, Leslie Belden and Jack Patton answered ROLL CALL. Commissioners Connie Foster and Jim Dornblaser were absent. Chairman Elliott answered ROLL CALL and declared a quorum. PRESENT SIX (6), ABSENT TWO (2). Others present for the meeting were City Attorney Robert E. Bamburg, City Engineer Duane Reel, Deputy City Clerk Susan Goings and petitioners. APPROVAL AND/OR CORRECTION OF MINUTES: Commissioner Piggee moved, seconded by Commissioner Patton that the minutes of the June 13, 1994 Regular Planning Commission Meeting be APPROVED. MOTION CARRIED. DEVIATION IN AGENDA: PUBLIC HEARING: 7:00 P.M. Brown Addn„ Blk 2, Lots 7-11 Chairman Elliott opened the public hearing at approximately 7:03 p.m. Commissioner Green excused himself as a commissioner and a voting member of the commission to speak to the item of business. City Engineer Reel was recognized by Chairman Elliott to address the request of Mr. Tad Green regarding the rezoning of Lots 7, 8, 9, 10 and 11, Blk. 2, Brown Addition to the City of Jacksonville, Arkansas. He pointed out that the location of the lots are on the west side of James Street bounded by C1 lots on the south side and Second Baptist Church property on the north side. He related that the City does not have a problem with the request. Mr. Green asked that the Commission rezone Lots 7, 8, 9, 10 and 11 to C-1. He pointed out that the request falls within the area targeted by Metroplan for commercial zoning. He related that his intent is a development for quiet, professional office space. Commissioner Belden moved, seconded by Commissioner Reid that the rezoning request of Mr. Tad Green regarding Lots 7, 8, 9, 10 and 11 to C-1 classification be recommended to the City Council. MOTION CARRIED. REQUEST TO SET UP PUBLIC HEARINGS: No requests were submitted. 1 CITY OF JACKSONVILLE, ARKANSAS REGULAR PLANNING COMMISSION MEETING JULY 11, 1994 7:00 P.M.  7:35 P.M. REQUEST TO APPROVE BUILDING PERMITS: a. Bible Baptist Church Development Plan 3301 North First St. City Engineer Reel voiced that the property is adjacent to the Family Life Center already constructed at the address, that all setbacks are met and that the development scheme adheres to what was submitted several years ago. He said that he does not have final approval from the Water and Wastewater Utilities but that a problem is not anticipated. He added that the City has no problem with the request. Commissioner Piggee moved, seconded by Commissioner Belden that the building permit request of Bible Baptist Church be approved as submitted pending positive report from the Water and Sewer Departments. MOTION CARRIED. b. STONEWALL SUBDIVISION PHASE VI / LOT 503 City Engineer Reel said that the lot is one of three which face Stonewall Drive. He said that all the utilities are in and available to the three lots, that the City has no problem with issuing a building permit for any of the three. Commissioner Belden moved, seconded by Commissioner Piggee that the building permit request of Steve Fikes and Alma Gibson regarding Lot 503, Stonewall Subdivision Phase VI be granted. MOTION CARRIED. REQUEST TO APPROVE PLATS: a. Final plat Stonewall Subdivision Phase VI City Engineer Reel related that a plat presented to the Commissioners before the June meeting had lots in the flood plain that were not designated with an "f". He pointed out that Mr. Green has had another plat prepared which does have the lots in the flood plain designated with an "f". He said that letters from the Water and Wastewater Utilities are forthcoming and that tests have been made regarding streets which should be completed within the next ten days. Mr. Green related that all the lots have been filled in efforts to get them out of the flood plain. He said that he will be working with FEMA to get the lots removed from the flood plain. There was discussion regarding the exact lots with the consensus being that those which are in the flood plain are lots 484, 485, 486, 487, 488, 489, 490, 491 and 492. 2 CITY OF JACKSONVILLE, ARKANSAS REGULAR PLANNING COMMISSION MEETING JULY Il, 1994 7:00 P.M.  7:35 P.M. There was discussion regarding common areas. Mr. Green stated that his intent is to leave a portion behind the lots along the railroad track for natural growth making a visual and acoustical block. The 25' building line for lots 506, 495 and 494 was pointed out by Commissioner Brannen and during the discussion it was noted by City Engineer Reel that if the house on the lot faces Stonewall Drive, the setback must be 35' and if not the 25' setback is applicable. Commissioner Brannen moved, seconded by Commissioner Piggee that the FINAL PLAT of STONEWALL PH VI be APPROVED with the following stipulations: (1) letters of approval are received from the Water and Wastewater Utilities, (2) that lots 484, 485, 486, 487, 488, 489, 490, 491 and 492 be designated with an "f" identifying them as being in the flood plain and (3) that the streets be completed and accepted by the City Engineer. MOTION CARRIED. b. Lot-Split/Jenny Lynn Subdivision Lot 12 City Engineer Reel stated that the subdivision is on the east side of Northeastern Avenue and immediately adjacent to the south property line of the Episcopal Church which has recently been built. He noted the location of the lot as being the southernmost one in the subdivision. On a map before the Commission, Mr. Reel pointed out the location of the lot and noted that a house built by Mr. Brian Boroughs occupies the north portion. He said that Mr. Boroughs has found a house, which he would like to build with square footage that will fit on the southernmost portion without interfering with the gas easement. Commissioner Green moved, seconded by Commissioner Patton that approval be given for the splitting of Lot 12, Jenny Lynn Subdivision, making it Lot 12A and Lot 12B, at the request of Mr. Brian Boroughs. Commissioner Brannen abstained from the voting process. By a voice vote, THE MOTION CARRIED. REPORT: MAIN STREET COMMITTEE A brief report of the last meeting was given by Mrs. Leslie Belden. She related that efforts are being made to obtain grants, to participate in the Mums, Music and Muscadine Festival and to get the participation of the property owners along Main Street. 3 CITY OF JACKSONVILLE, ARKANSAS REGULAR PLANNING COMMISSION MEETING JULY 11, 1994 7:00 P.M.  7:35 P.M.
