OPENING REMARKS: Chairman Gray expressed appreciation for those in attendance and asked for roll call. ROLL CALL: Commissioners: Rudy Reid, Art Brannen, Tad Green, Paul Payne, Jim Dornblaser, Connie Foster and Jack Patton answered ROLL CALL Chairman Gray also answered ROLL CALL and declared a quorum. PRESENT (8) EIGHT, ABSENT (1). Others in attendance for the meeting were City Attorney Robert E. Bamburg, City Engineer Duane Reel, Deputy City Clerk Susan Goings, Receptionist Velencia Hardy, Computer Technician of the Engineering Department Mylissa Founds petitioners and other interested persons. DEVIATZOMIN AGENDA: PUBLIC HEARINGS: 7:00 P.M. a. Rezoning of Stonewall Phase VI from R-3 to R-0 Chairman Gray announced the item of business and opened the public hearing at approximately 7:02 p.m. Chairman Gray related that the petitioner is Jim Green and the item of business a request to rezone Stonewall Phase VI at the request of the Planning Commission. He further related the desire by the Planning Commission to have all the residential area in Stonewall zoned the same. Chairman Gray closed the public hearing at approximately 7:04 p.m. Commissioner Payne moved, seconded by Commissioner Foster to recommend APPROVAL to rezone Stonewall Phase VI from R-3 to R-0. MOTION CARRIED. b. Rezoning of a Parcel from C-3 to R-4 General Location: John Harden Drive between Evans Drive and Quince Hill Road. Chairman Gray opened the public hearing at approximately 7:05 p.m. Gloria Evans, the petitioner for the rezoning, related that the property is currently being used as a RV park adding that the property was zoned C-3 in 1973 at the request of Mr. and Mrs. Evans. There was no opposition presented in regard to the request from the General Public. Chairman Gray closed the public hearing at approximately 7:06 p.m. CITY OF JACKSONVILLE, ARKANSAS REGULAR PLANNING COMMISSION MEETING OCTOBER 11. 1993 7:00 P.M. - 7:30 P.M. Commissioner Foster inquired as to an ordinance passed concerning mobile home use and zoning. City Engineer Reel related that if a mobile home is present on property when it becomes a part of the City it is zoned R-0 with a non-conforming use and zoning can be changed. If the zoning is not changed and the property changes use it must conform to its zoning requirements. Mrs. Evans related that the property is for sale and the prospective buyer would like to maintain the current use of the property. Commissioner Foster inquired as to the advantage to the City to rezone the parcel for mobile home use. Commissioner Payne commented that adjacent to the property is a trailer park on one side with subsidized housing to the rear. Commissioner Patton related that the trailer park has always been kept up over the years. Commissioner Payne moved, seconded by Patton to recommend .the rezoning of the property known as the Evans Property and legally described in the minutes of September 13, 1993, from C-3 to R-4 to the City Council. ROLL CALL: Commissioner Reid, Green, Payne, Dornblaser, and Patton voted AYE (5) Commissioner Brannen and Foster voted NAY (2) MOTION CARRIED. RESUME AGENDA: APPROVAL AND/OR CORRECTION OF MINUTES Commissioner Brannen moved, seconded by Commissioner Dornblaser that the minutes of the September 13, 1993 Regular Planning Commission Meeting be APPROVED as presented. MOTION CARRIED. REQUESTS TO SET PUBLIC HEARINGS: Close/portion of Natchez Trace General Location: Northwood Acres Chairman Gray related that his company is owner of one of the adjacent properties but would not receive any benefit from any of the closed street. He stated that he would refrain from voting if it should be required. Commissioner Green asked if there were any development plans for the street in question. CITY OF JACKSONVILLE, ARKANSAS REGULAR PLANNING COMMISSION MEETING OCTOBER 11, 1993 7:00 P.M. - 7:30 P.M. City Engineer Reel related that the owners of the property on the south side of the drainage ditch granted permission to the City to build the sidewalk leading from Natchez Trace to the bridge crossing the ditch along Northeastern enabling school children from the area an alternative route going to Pinewood Elementary instead of on the freeway. He questioned the intent of Bart Gray Reality as to the property owned by them and the sidewalk under discussion. Chairman Gray related that for the children’s safety, Bart Gray Reality allowed a side walk to be built across the property in question adding that it was never meant as an easement. He further related that Bart Gray Realty is re-affirming their rights and ownership to the land, adding that there are no plans to remove the sidewalk. _He pointed out that the street easement is used to gain access to the sidewalk. Engineer Reel related that the sidewalk could be relocated using the easements for the ditch, the main thing being access from Quapaw to the bridge. Commissioner Brannen moved, seconded by Commissioner Dornblaser to set the Public Hearing for the next regular Planning Commission Meeting of November 8, 1993. MOTION CARRIED. REQUEST TO APPROVE PLATS: ANNOUNCEMENT Chairman Gray opened the floor regarding any comments that the commissioners may have in regard to the rezoning of the Grace Brown Addition. He related that Commissioner Brannen has been the representative from the Planning Commission in regard to attending the meetings held by the City Council. He further related that Commissioner Brannen had reported that the City Council had recently voted differently than recommended by the Planning Commission concerning the rezoning of the Grace Brown Addition. It was stated that the reason the Council approved the rezoning was due to the fact that no person objected to the rezoning at the Planning Commission Public Hearing or at the City Council Meeting. Chairman Gray voiced that the City Council is the final authority, noting that the job of the Planning Commission is to make recommendations to the City Council. He expressed appreciation to Commissioner Brannen for his excellent representation on behalf of the Planning Commission. It was remarked. how rarely the City Council has every voted differently than the recommendations of the Planning Commission.
