OPENING REMARKS:
ROLL CALL:
Commissioners: Rudy Reid, Connie Foster, Art Brannen, Tad Green, Lester Piggee, Paul Payne, Jack Patton answered ROLL CALL. Commissioner Dornblaser was absent, Chairman Gray declared
a quorum. PRESENT EIGHT (8), ABSENT (1).
Others in attendance for the meeting were City Attorney Robert E. Bamburg, City Engineer Duane Reel, Deputy City Clerk Susan Goings, Computer Tech. Mylissa Founds, Receptionist of the
Engineering Department Valencia Hardy, Mr. Akridge other petitioners, and interested citizens.
DEVIATION IN AGENDA:
CLOSING A PORTION OF NATCHEZ TRACE:
Chairman Gray introduced the item of business and declared the public hearing open at approximately 7:02 p.m., inviting those of the public who would like to speak in favor of the closing.
Mr. Jack Danielson of 100 Quapaw related that his desire is to create a visual and sound buffer from the Highway traffic with scrubs. He stated that he had no objection to a public
access for the bridge located adjacent to the proposed property to be closed.
Mr. Joe Honeycutt of 105 Chickasaw stated that the only objection to the closing would be if the footbridge was cut off from public access. He related that the bridge is the only access
to Northeastern for the children to walk or ride bikes to school other than along T.P. White service road. He then related that the speed limit of 45 mph is not observed by the cars
using the service road making it too dangerous for the children to use this road as a method of travel and that the 1/4 mile distance from Tecumseh Trail to Northeastern has no sidewalk
or shoulder to the road.
City Engineer Reel related that research shows that the street is dedicated to the ditch with no legal easement for the property south of the bridge, adding that the property owner has
granted access from the bridge to Northeastern contingent on future development of the property.
Chairman Gray closed the public hearing at approximately 7:07 p.m. and opened the discussion among the Planning Commissioners.
During general discussion, it was related that the owner of the property south of the ditch is Bart Gray Realty Company.

Chairman Gray related that if the street were closed, as requested, the Planning Commission could include in the action a 10 ft. easement granting public access to the bridge.
City Engineer Reel related that a utility easement would need to be retained through this easement, and the public could have access to the bridge with possible relocation of the sidewalk
on the south side in regard to any future development there.
Commissioner Piggee moved, seconded by Commissioner Payne to recommend to Council closing a portion of Natchez Trace and granting a ten-foot easement down the center of Natchez Trace
to the bridge maintained for public access. MOTION CARRIED.
Questions arose from Mr. Joe Honeycutt as to the location of the easement in regard to the location of the bridge.
Chairman Gray explained that technically when the closing of a street occurs, it is divided equally between the prospective property owners adding that he did not feel that this would
present a problem with Mr. Danielson allowing the east side of the street to be used as the public access way.
RESUME AGENDA:
APPROVAL AND/OR CORRECTION OF MINUTES:
Commissioner Brannen moved, seconded by Commissioner Payne that the minutes of the October 11, 1993 Regular Planning Commission Meeting be APPROVED. MOTION CARRIED.
REQUEST TO SET UP PUBLIC HEARINGS:
Chairman Gray introduced the request (s) to set a public hearing for the regular scheduled Planning Commission meeting of December 16, 1993 in regard to the lots 18, 20, 21, 22, 23,
24, 25, 26 and 30, Block 2 Brown Addition to the City of Jacksonville requested rezoning from R-1 to C-3.
Commissioner Brannen moved, seconded by Commissioner Foster to set a public hearing at 7:00 p.m. for the next regular Planning Commission meeting on December 13, 1993 as requested to
rezone lots 18, 20, 21, 22, 23, 24, 25, 26 and 30, Block 2 Brown Addition from R-1 to C-3. MOTION CARRIED.
Chairman Gray introduced the request by Leroy Akridge to have a portion of the property on Stanphill Road rezoned from R-0 to R-1.

A tract of land located in the Southeast Quarter (SE 1/4) of Section 29, T-3-N, R-10-W, in the City of Jacksonville, Pulaski County, Arkansas
Commencing at the Southeast Corner of Section 29, T-3-N, R-10-W; thence North, 478.7 feet; thence West, 666 feet; thence North, 628.6 feet to the point of beginning; thence N 83
degrees 21' 01" W, 319.0 feet; thence S 03 degrees 29' W, 140.24 feet; thence N 84 degrees 52' 19" W, 169.0 feet; thence N 03 degrees 29' E, 25.0 feet; thence N 84 degrees 52' 19" W,
150.0 feet to the east right-of-way line of Stanphill Road; thence N 03 degrees 29' E along said east right-of-way line, 272.12 feet; thence S 81 degrees 54' 28 " E, 828.0 feet; thence
S 04 degrees 44; 43" W, 127.3 feet to the point of beginning; Containing 3.58 acres, more or less.
Commissioner Brannen moved, seconded by Commissioner Piggee to set a public hearing at 7:00 p.m. for the next regular Planning Commission meeting on December 13, 1993 as requested to
rezone a portion of the property on Stanphill Road from R-0 to R-1. MOTION CARRIED.
REQUEST TO APPROVE BUILDING PERMITS: Preliminary Plot Plan Braden and John Harden Drive
Mr. Tim Lemons from Bond Consulting Engineers, Inc. related the desire for two waivers with regard to the Plot Plan as presented. He stated that the proposed building is 3600 square
feet which will require eighteen parking spaces while the Plot Plan shows sixteen parking spaces to the east of the building. He related that the land west of the building is an existing
parking lot used by the hospital for overflow parking and that a 16 foot sidewalk extending west is proposed as part of the Plot Plan. He requested a waiver for the eighteen space parking
requirement as well as a setback waiver from 50 foot to 36 feet for C-3 zoning. He related the need for the setback waiver in order to facilitate a 3600 square foot building with room
for a 25 foot expansion without compromising part of the parking lot. He stated that while asking for a setback waiver the average depth between the right-of-way line and the building
will be 52 feet.
Chairman Gray stated that currently on the lot is a building with a setback of 52 feet.

Commissioner Foster moved, seconded by Commissioner Reid to APPROVE the request for a building permit with a setback waiver of fourteen foot and a variance with regard to 16 parking
spaces instead of 18 parking spaces. MOTION CARRIED.
REQUEST TO APPROVE PLATS: Preliminary & Final Plats/First Place Commercial, Phase I Stonewall Subdivision
Mr. Tim Lemons related that previously the Planning Commission had approved a building permit for lot one with a meets and bounds legal description. He stated that the owner would like
to plat the property at this time including the next two lots. He related that he had conferred with the City Engineer with regard to an easement
shown to the east of the property which has been removed from the corrected copy with an F for Flood zone designation being added
to lots one, two and three.
Commissioner Brannen moved, seconded by Commissioner Piggee to APPROVE the Preliminary and Final Plat/First Place Commercial, Phase I, Stonewall Subdivision.
Chairman Gray inquired as to utility acceptance for the lots of the Preliminary and Final Plats.
City Engineer Reel related that there is acceptance for water on lot one and along North First Street with acceptance for the sewer also.
At this time MOTION CARRIED.
Chairman Gray expressed that there will always be an opportunity for conflict of interest on the Commission. He then related that at the last Planning Commission meeting he had explained
that the Company he is affiliated with is the owner of a tract of land which is adjacent to Natchez Trace and stated that there is no advantage or disadvantage to the closing of Natchez
Trace. He reiterated that he was prepared to abstain in the voting process if it were to become necessary. He said that he appreciated the acknowledgement of rights of ownership by
the city with regard to the land, adding that he did not think the land would be developed in the immediate future. He related that if it were to develop the meaning of the side walk
may change at that time.
After a short discussion it was related that at present a conflict of interest does not exist.
