93 FEB 8.docCITY OF JACKSONVILLE, ARKANSAS REGULAR PLANNING COMMISSION MEETING February 8, 1993 7:00 P.M. – 8:10 P.M. OPENING REMARKS: Chairman Bart Gray Jr. opened the meeting, welcomed those in attendance and requested ROLL CALL. ROLL CALL: Commissioners: Jack Patton, Lester Piggee, Jim Dornblaser, Paul Payne, Tad Green, Art Brannen and Rudy Reid were present. Commissioner Foster was absent. Chairman Gray also answered ROLL CALL and declared a quorum. PRESENT eight (8). ABSENT one (1). Others in attendance for the meeting were City Attorney Robert E. Bamburg, City Engineer Duane Reel, Code Enforcement Officer Wayne Cox, Deputy City Clerk Susan Goings, Receptionist of the Engi-neering Department Terry Hartley, former Commissioners Jim Davis and Kenny Elliott, petitioners and interested citizens. PRESENTATIONS: At this time Chairman Gray presented plaques to Commissioners James Davis and Kenny Elliott for their respective years of service on the Planning Commission and the Board of Adjustment. DEVIATIONS IN AGENDA: Public Hearing 7:00 p.m. Chairman Gray opened the Public Hearing at approximately 7:10 p.m. and invited participation from those who would like to speak either pro or con. Mr. J.C. James the representative for the owners of the property, Mr. John Shields and Mrs. Gladys Smith, related that rezoning the parcel to R-3 is the request before the Planning Commissioners. He further related that the property consists of 1.18 acres and meets setbacks and all other requirements of the Jacksonville Municipal Code. He stated that the property has no proximity to other single family residents and that proposed construction for the parcel is for a first class multi-family complex. One point that Mr. James made was that this would upgrade the quality of housing for that parcel and presented a picture of debris rela-ting to a previous transfer at the residence. Mr. T.P; White representing property owners in opposition to the rezoning presented for consideration a petition with seventy-one (71) signatures. He further related that in reference to the Comprehensive Development Plan, produced by Metro Plan and rati-fied by the City Council, that the property in question is best suited for R-1 zoning with the commercial line not going any further west. Mr. White concluded by asking that the request for rezoning be denied. CITY OF JACKSONVILLE, ARKANSAS REGULAR PLANNING COMMISSION MEETING February 8, 1993 7:00 P.M. - 8:10 P.M. Chairman Gray asked if anyone else would like to speak pro or con for the rezoning. Mr. Joe Douglas proposed buyer for the property on Gregory stated that his proposed plan for the multi-family complex was set up with only one access on Gregory Street, adding that this design was in consideration for the traffic flow which he did not feel would be congested from the proposed 4 individual units containing four apartments each. Chairman Gray requested that Mr. Douglas share the proposed construction plan with Mr. T.P. White and those present in oppo-sition to the rezoning who were unaware of the type of proposed construction planned. Mr. Lonnie Reed resident from the area stated that the proposed entry way on to Gregory would further complicate the difficulty of traffic at the top of the hill off Johnson Street on to Gre-gory Street. Mr. J.C. James related that he has been managing the property since the 1980’s adding that he has been called by the police on several occasions in regard to criminal activity surrounding the rental property. He stated that unsavory people have been the only ones to rent the residences which resulted in the property becoming more unsightly. He further related that the type of complex proposed would attract a more desirable neighbor than is presently residing there. Mr. Cecil Bradley from 1608 Johnson Street stated that the neigh-borhood was quiet and peaceful with mostly senior citizens who are opposed to the rezoning. Mr. White related that the present owner of the property has not maintained the property as he said he would adding that he had expressed interest in upgrading the property when he purchased it. Chairman Gray asked if anyone else wss interested in speaking either for or against the rezoning. At this time, approximately 7:32 p.m., he closed the public hearing. Commissioner Piggee requested to see a copy of the Land Use Map referred to by Mr. White in his presentation. City Engineer Duane Reel stated that the Land Use Map was adopted in the beginning of 1993 by the City Council and shows the area in question as residential. Commissioner Dornblaser posed the question to the opposition as to what compromise, if any, wound help in the development of this area wisely. Mr. T.P. White related that once the property is rezoned R-3, the property owner could proceed with any construction allowed under that zoning, not necessarily the proposed one brought before the Planning Commission. Chairman Gray pointed out that the parcel is legally described by meets and bounds. Chairman Gray explained the elements involved if it is not a recorded subdivision adding that it would give the Planning Commission more control over the development. City Engineer Duane Reel related that it was not .a recorded Plat and suggested that it may have been presented as a preliminary plat, but was never recorded. Commissioner Patton posed a question as to the care of the prop-erty. Code Enforcement Officer Wayne Cox related that the property was not downgraded enough to have enforced rehabilitation imposed on the owner as long as it is habitable. Mr. J.C. James in responding to a question about the traffic situation related that presently the property has three driveways and under the proposed construction it would have one, adding that he did not feel thus would cause a big difference in. the current flow of traffic. Commissioner Dornblaser related that the traffic was an important issue and that he shared some of the concerns. He further re-lated that under the proposed construction the 16 unit complex would carry the potential for up to 32 cars. Mr. T.P. White expressed that an R-3 type zoning would allow a lesser type property owner or renter adding that the opposition does not desire a downgrading of zoning. Commissioner Payne related that consideration would be given to the homeowners who have lived in the area for a number of years. Commissioner Reid stated that he also favors those living there who have signed the petition. Commissioner Brannen moved, seconded by Commissioner Dornblaser to DENY the request for rezoning from R-1 to R-3. MOTION CAR-RIED. Chairman Gray related that the motion could be forwarded City Council upon further appeal from the petitioners. RESUME AGENDA: APPROVAL AND/OR CORRECTION OF MINUTES: Regular Planning Commission Meeting of January 11, 1993 Commissioner Piggee moved, seconded by Commissioner Brannen that the minutes of the January 11, 1993 Planning Commission Meeting be APPROVED. MOTION CARRIED. APPROVAL AND/OR CORRECTION OF ANNUAL REPORT/1992 Annual Planning Commission Report for 1992 Commissioner Brannen moved, seconded by Commissioner Dornblaser to APPROVE as presented. MOTION CARRIED. REQUESTS TO SET UP PUBLIC HEARINGS: No requests were presented. REQUESTS TO APPROVE BUILDING PERMITS: No requests were presented. REQUESTS TO APPROVE PLATS: Prelim. Plat/Rebsamen Medical Sub. Mr. Tommy Bond of Bond Engineering related that the hospital acquired tie property adjacent to the Dr. Albert Johnson buil- ing. City Engineer Duane Reel related that the property is zoned C-3 adding that the 80 foot frontages are within the regulations for that zoned property. He further related the need possibly relocate a sewer line running through the center of the 1ot depending on plans for development. Chairman Gray stated that on behalf of the Hospital Commission and as a Planning Commissioner he appreciates the presentation of the land as a preliminary plat being that this is the proper step for further development. Commissioner Dornblaser moved, seconded by Commissioner Piggee to APPROVE the Preliminary Plat as presented. MOTION CARRIED. ADDITION TO THE AGENDA: UPDATE: LRAFB/CITY OF JACKSONVILLE, FIVE MILE PLANNING JURISDIC-TION City Engineer Reel related that the Little Rock Air Force Base made a presentation regarding the restrictions that fall in the flight zone at both ends of the runway, adding that all of this area falls into the county. He further related that he felt the count should take the lead in restricting development in this jurisdiction. It was pointed out by Chairman Gray that the City has no juris-diction in the county as far as zoning but there is a five mile planning area in which the city has input adding that it would be beneficial to have a joint meeting with the Pulaski County Plan-ning Board to find out where these areas overlap. COMMITTEE REPORT UPDATE: FOXWOOD DRIVE AND LOOP RD./PROPOSED CHURCH Commissioner Patton related that zoning requirements are not applicable where churches are concerned. He further related that the desire by the petitioners to build a church at this location no longer exists. INTRODUCTION: Chairman Gray introduced Mrs. Terry Hartley who is currently working in the City Engineers Office.
