92 OCT 12.docCITY OF JACKSONVILLE, ARKANSAS REGULAR PLANNING COMMISSION MEETING October 12, 1992 7:00 P.M. – 7:25 P.M. OPENING REMARKS: Chairman Kenny Elliott opened the meeting and requested ROLL CALL. ROLL CALL: Commissioners: Jim Davis, Jim Dornblaser, Art Brannen, Tad Green, Paul Payne, Bart Gray Jr., and Jack Patton were present. Commissioner Lester Piggee was absent. Chairman Elliott also answered ROLL CALL and declared a quorum. PRESENT eight (8). ABSENT (1). Others in attendance for the meeting were City Engineer Duane Reel, Receptionist/Computer Technician of the Engineering Department Mylissa Founds, Deputy Clerk: Susan Goings, Engineer Tim Lemmons, Developer Jim Green, petitioners and interested citizens. APPROVAL AND/OR CORRECTION OF MINUTES: Regular Planning Commission Meeting of September 14, 1992 Commissioner Brannen moved, seconded by Commissioner Davis that the minutes of the September 14, 1992 Planning Commission Meeting be APPROVED. MOTION CARRIED. REQUESTS TO SET UP PUBLIC HEARINGS: Rezoning of 10016 So. Hwy 161 Petitioner: Harry A. and Margaret Norwood. City Engineer Duane Reel related that the area was located on the west side of Valentine Rd. Commissioner Davis noted that the item had been brought before the Planning Commission previously and Commissioner Gray further related that it is less than a five acre tract on a meets and bounds which needed approval from the Planning Commission before it could sell. Chairman Elliott recognized Mr. Harry Norwood. Mr. Norwood related that the property extended from Valentine Road to the Ceramic Shop which made up the three acres requested for rezoning. He further related that most of the area around the property is already zoned commercial. He stated that in 1990 he has ask for a variance which was been denied. Commissioner Davis moved, seconded by Commissioner Dornblazer to set the Public Hearing for December 14, 1992, during the regular Planning Commission Meeting which will be held at City Hall at 7:00 p.m. MOTION CARRIED. CITY OF JACKSONVILLE, ARKANSAS REGULAR PLANNING COMMISSION MEETING October 12, 1992 7:00 P.M.  7:25 P.M. REQUESTS TO APPROVE BUILDING PERMITS: No requests were submitted. REQUEST T0 APPROVE PLATS: a. Final Plat/Stonewall Subdivision Phase V Chairman Elliott recognized City Engineer Duane Real to address the item of business. City Engineer Reel related that Phase V of the Stonewall Subdivi-sion has basically been completed with exception of warranties to be signed by the owner and contractor. He further related that warranties on street construction and storm drainage has been signed. He added that the Water Department has given verbal approval for acceptance and the Sewer Commission would act on acceptance of the sewer lines in a meeting October 16, 1992. Mr. Reel stated that all requirements were met with the exception of the construction of side walks. He related that the owner has offered to escrow an amount determined by the City Engineer to guarantee the completion of the side walks. He related that he had reservations about building sidewalks before houses were built stating that he felt that construction beforehand would cause damage to side walks. He suggested that the side walk construction take place just prior to the close of each structure. Commissioner Gray voiced concerns regarding drainage in the subdivision and its relation to other streets on the east side of the railroad track. City Engineer Reel related that the natural drainage off the subdivision is toward the railroad tracks and stated that the drainage area would be improved at such time when construction of the apartment complex began. He further related that a project would finish paving a ditch from the railroad to the West Side of Cherry Court taking care of the drainage through that area and that improvements made by the developer would tie into the pro- posed project. He said the drainage ditch would take care of any excess water. Chairman Elliott inquired as to the Bill of Assurance which is on file in the office of the City Clerk. It was pointed out that the document submitted was in error and Mr. Green expressed that a corrected copy would be submitted to the Planning Commission. Commissioner Gray moved, seconded by Commissioner Green to Ap-prove the Final Plat of Phase V of the STONEWALL SUBDIVISION pending water and sewer approval along with a stipulation that meney be escrowed to cover sidewalk construction. MOTION CARRIED NONAGENDA ITEM: City Engineer Duane Reel introduced a letter from Mrs. Judy Houser received by the Engineering Department. He related the desire of Mrs. Houser to place a cemetery in tracts B-5 and B-6 in the Jacksonville Industrial Park area. A short discussion ensued with regard to the zoning laws. Commissioner Gray related his desire to see Mrs. Houser trade a different piece of land for this land if she desired to build a cemetery. It was the consensus of the body that the land is more valuable with industrial use as opposed to cemetery property.
