OPENING REMARKS: Chairman Kenny Elliott opened the meeting and
requested ROLL CALL.
ROLL CALL:
Commissioners: Kenny Elliott, Art Brannen, Tad Green Paul Payne, Jim Dornblaser, Bart Gray Jr., James Davis and Frank Dowd were present. Mr. Lester Piggee was out of town on a business
trip. PRESENT eight (8). ABSENT (1). Chairman Elliott declared a quorum.
Others in attendance for the meeting were City Engineer Diane Reel, Receptionist/Computer Technician of the Engineering Department Mylissa Founds, petitioners and interested citizens.
APPROVAL AND/OR CORRECTION OF MINUTES:
Regular Planning Commission Meeting of January 1, 1992
Commissioner Payne moved, seconded by Commissioner Dowd that the minutes of the January 13, 1992 Planning Commission Meeting be APPROVED. MOTION CARRIED.
REQUESTS TO SET UP PUBLIC HEARINGS:
REQUESTS TO APPROVE BUILDING PERMITS:

DEVIATION IN AGENDA:
Chairman Elliott deviated from the agenda due to the fact that it was not time to open the public hearing.
REQUEST TO APPROVE FLATS:
PRELIMINARY PLAT of FIRST PLACE COMMERCIAL ADDITION, PHASE I (STONEWALL SUBDIVISION) (Petitioner: Jim Green)
City Engineer Reel was recognized to address the plat. He point- ed out that drives were moved so that they will match the exist- ing streets as you come in on the west side of North
First Street and that access off of Center St. is a drive which serves three lots on the east side of the subdivision and an access drive parallel with Center St. serves the lots in
the corner of the of the addition adding that there is still an access easement on lot three making it virtually useless except for parking..
He said that 1ots have been adjusted to meet the minimum requirements of zoning in the area.

Chairman Elliott pointed out that the access easements were questioned as they appear on the plat at the last meeting. He related that the Planning Commission suggested at that 1ots
two and three be combined to bring them into compliance with code regulations and that it was requested that the access easement be on the front of the lots.
Engineer Reel stated that the access as shown on the plat is not quite opposite Poplar Street and that the excess shown to be 176 ft. from the right of way line of Center Street lines
up with Willow Street. He said it seemed more appropriate geometrically to have the streets in 1ine with existing streets than to have an offset at that point. He said that location
of the drive probably would not cause a back up of traffic at the intersection.
Commissioner Brannen questioned the possibility of eliminating one access into the subdivision.
City Engineer Reel explained that Lot 5 would access off the easement opposite Willow St., Lot 4 off the access opposite Poplar adding that, no access would be granted off North First
Street onto Lots 4; 5, 6 and 7. He related that the only accesses designated on the plat onto North First Street cuts Lot 3 in half and the other is between Lots 5 and 6. He pointed
out that Lot 1 is served by an access easement shown on Lot 2 and 3, Lot 4
is served by the access easement shown on Lot 3, Lots 5 and 6 are served by the access shown to be in1ine with Willow Street and Lots 7, 8 and 9 served by the access off Center Street.
Commissioner Gray noted that easements are shown on the Prelimi-nary Plat versus construction of streets.
Mr. Green voiced that the access easements are really private drive easements, they are not dedicated streets. He said they are proposed to give legal access to lots which they affect.
Commissioner Dornblaser voiced that he would like to see Lots 2 and 6 modified.
Mr. Green said that reasons regarding ownership have determined tile layout of those particular lots.
Chairman Gray said that he would 1ike to see the entrance across frost Willow Street be put back to the fifty foot building line and the street built off Center Street completed to
Lot 9.
Mr. Green voiced that the plat is his concept of what he would 1ike to see done, not what may actually be done. He said that he has a problem pre-determining for the commercial occupants.

Commissioner Gray suggested that the plat be considered a Sketch Plat versus a Preliminary Plat relating that single lots could be presented as Preliminary Plats as necessary.
City Engineer Feel explained the purpose of a sketch plat serves the purpose of following a particular concept with the privilege to bringing one or more lots with proposed changes as
long as the access shown on the sketch plat remains the same.
It was pointed out by Chairman Elliott that streets as proposed in the plat would not be ones that would be dedicated to the City of Jacksonville for maintenance.
City Engineer Reel contended that the owner of Lot 9 has to have a guarantee that he does have a viable access into that lot and that he sees where the drive up to the end of Lot 9 could
be required to be a city street, built to city specifications; commenting that the Commission may need to consider requiring the same of the developer.
There was more discussion with regard to lot access according to the plat anti the responsibility of street maintenance.
Mr. Green said boat the original proposal for the street oft Center Street was that it be a dedicated one but that it is not shown on this plat as such.
City Engineer Reel mentioned that there is a situation in the city at this time in an industrial complex; where streets mere taken over and they were not dedicated to the city for maintenance
and nova they are requested for maintenance and they are not built to city specifications which is causing conflict.
Chairman Elliott voiced that he felt the plat should be called a Sketch Plat and accepted as such.
City Engineer Reel voiced that access onto North First St. will not change and that access for Lots 6 & 7 will remain as shown on the plat.
Commissioner Payne moved, seconded by Commissioner Gray to ad-dress the plat presented by Mr. Green as a Sketch Plat of First Place Commercial Addition, Phase I, Stonewall Subdivision,
and approve it as is. MOTION CARRIED.
It was pointed out to Mr. Green that he can bring back, as a Preliminary and/or Final Plat, a 1ot or 1ofs without improve ments.

Chairman Elliott opened the Public Hearing at approximately 7:35 p. m.
City Engineer Reel voiced that with the rezoning, which is the last of a triangle between Spencer, Trickey Lane and Military Road, the entire block would be zoned C3.
Mr. Garth Travis, petitioner, was present to request that the rezoning be granted.
No person in attendance opposed the rezoning.
Commissioner Gray moved, seconded by Commissioner Brannen that the rezoning request of Mr. Garth Travis for a tract of land in the NE1/4, NE1/4, Sec. 31, T3N, R10W, on Trickey Lane.,
in the City of Jacksonville be rezoned from R3 to C3. MOTION CARRIED.
Chairman Elliott voiced that the request for rezoning will be recommended to the City Council at their meeting of February 20, 1992.
Chairman Elliott declared the public hearing officially closed a± approximately 7:38 p.m.
REZONING REQUEST TABLED DECEMBER 9, 1991
PETITIONER: Byron McKimmey/Request to rezone from R1 to M1 (Part of NW1/4, SE1/4, Sec. 5, T3N, R10W, adjacent to Dupree Park.)
Chairman Elliott asked for a motion to place the item before the Planning Commission for action.
Commissioner Gray moved, seconded by Commissioner Dornblaser that the rezoning request of Mr. Byron McKimmey to rezone from RI to M1 (Part of NW1/4, SE1/4, Sec. 25, T3N, R10W,
adjacent to Dupree Park, be removed from the table. MOTION CARRIED.
Chairman Elliott recognized Mr. Byron McKimmey.
He addressed the item and stated that he did attend the Park and Recreation Commission and that they did not see fit to accept his proposal regarding road construction and unanimously
turned down his request.

Mr. Robert Stroud, Chairman of the Park & Recreation Commission voiced that in looking into the request of Mr. McKimmey, it was determined that 133 trees would be 1ost which make up
almost the entire buffer between Dupree Park and the freeway. He said the vote was almost unanimous that it would not be in the best bene-fit of the community to rezone the property.
He said that he had sympathy for the position Mr. McKimmey is in relating that per-sons in the culdesac which would be affected were very unfavor-able to the request.
Chairman Elliott pointed out the location of the parcel for the sake of the new members.
Commissioner Gray voiced that access to the property creates extreme problems for the property which he said is nice property fronting the freeway.
Commissioner Gray moved, seconded by Commissioner Dornblaser that the request to rezone that Part of the NW1/4, SE1/4, Sec. 25, T3N, R13W, adjacent to Dupree Park, as requested by
Mr. Byron McKimmey, be DENIED. MOTION CARRIED.
An orientation for the members of the Planning Commission was set for Monday night, 7:00 p.m., February 24, 1992 at City Hall.
ADJOURNMENT:
Commissioner Dornb1aser moved, seconded by Commissioner Payne that the meeting adjourn at approximately 7:50 p.m. MOTION CARRIED.
ANNOUNCEMENT:
Chairman Elliott announced that a public hearing is scheduled for 7:15 p.m. during the Regular City Council Meeting of February 20, 1992, to give consideration to the Land Use Map which
the Planning Commission recommended for passage. He encouraged each Commissioner to attend the meeting.
