OPENING REMARKS: Chairman Kenny Elliott opened the meeting, welcomed those in attendance and requested ROLL CALL. ROLL CALL: Commissioners: Jim Davis, Art Brannen, Jim Dornblaser, Lester Piggee, Paul Payne and Jack Patton were present. Commissioner Green was absent and Commissioner Gray arrived at approximately 7:05 p.m. Chairman Elliott also answered ROLL CALL and declared a quorum. PRESENT eight (8). ABSENT (1). Others in attendance for the meeting were City Attorney Robert E. Bamburg, City Engineer Duane Reel, Receptionist/Computer Technician of the Engineering Department Mylissa Founds, Deputy Clerk Susan Goings, petitioners and interested citizens. APPROVAL AND/OR CORRECTION OF MINUTES: Regular Planning Commission Meeting of November 9, 1992 Commissioner Brannen moved, seconded by Commissioner Piggee that the minutes of the November 9, 1992 Planning Commission Meeting be APPROVED. MOTION CARRIED. REQUESTS TO SET UP PUBLIC HEARINGS: No requests were presented. REQUESTS TO APPROVE BUILDING PERMITS: No requests were presented. PUBLIC HEARING 7:00 P.M. Request to rezone from R-1 to C-1 parcel located at 10016 South Hwy 161. Chairman Elliott opened the public hearing at 7:02 p.m. Chairman Elliott invited City Engineer Duane Reel to speak con- cerning the rezoning. City Engineer Reel stated that the rezoning would be consistent with the revised land use plan accepted in 1992. Mr. Mike Wilson address the Commission on behalf of the petitio- ners Mr. and Mrs. Norwood. Mr. Wilson related that this is the second request for rezoning by the Norwoods. Mr. Wilson further stated that there were no objections to the rezoning of C-1 quiet commercial. The purpose of the rezoning request is to permit a beauty shop in the home of the Norwoods. Commissioner Payne inquired as to the three different tracks of land and which or all were requested in the rezoning. Chairman Elliott related that the legal description covered all three tracks with tract B being where the house is located. City Engineer Reel related that he did not foresee any traffic problems relating to the rezoning. Mr. Norwood related his intent to widen the drive to his home to accommodate customers. Commissioner Gray related that this parcel of land was subdivided in a meets and bounds description years ago when previously presented to the Planning Commission, and that it was never legally recorded. He stated that even with three different legal description of the land it is only one parcel of land and should be treated accordingly until which time it is subdivided and recorded. He further suggested that action by the Planning Commission address the parcels as one lot subdivision. Chairman Elliott closed the Public Hearing at approximately 7:05 p.m. and ask for discussion from the Commissioners. Commissioner Gray related that previously it was subdivided under the name of Manuel Subdivision for the purpose of creating a mortgage for the home. Chairman Elliott related the need to have the tract replatted as a one lot subdivision and recorded as such. City Engineer Reel related that at a later time they would have the option to replat the land and divide it into lots. Commissioner Gray related that the request for rezoning complies with the Land Use Map as approved by the Planning Commission and the City Council earlier in 1992. Commissioner Gray moved, seconded by Commissioner Davis to APPROVE the rezoning of the parcel of land addressed as 10016 So. Hwy 161 as requested by Mr. &. Mrs. Norwood from R1 to C1 with the stipulation that the three tracts of land be plated as a one lot subdivision, named Norwood Subdivision.
