OPENING REMARKS: Chairman Bart Gray Jr. opened the meeting and requested ROLL CALL. ROLL CALL: Commissioners: James Davis, Jim Dornblaser, Tad Green, John Herbold, Paul Payne, Kenny Elliott and Bart Gray Jr., Chairman, were present. Commissioner Lester Piggee came in at approximately 7:33 p.m. Commissioner Mark Goodsell was absent. PRESENT seven (8). ABSENT (1). Chairman Gray declared a quorum. APPROVAL AND/OR CORRECTION OF MINUTES: Regular Planning Commission Meeting of October 14, 1991 Commissioner Elliott moved, seconded by Commissioner Payne that the minutes of the October 14, 1991 Planning Commission Meeting be APPROVED. MOTION CARRIED. REQUESTS TO SET UP PUBLIC HEARINGS: Chairman Gray voiced a request from petitioner Byron McKimmey that the following legally described parcel, All that portion of the NW 1/4, SE 1/4 of Section 25, T3N, R11W, that lies East of U.S. Highway 67167 rightofway, Pulaski County, Arkansas, be rezoned from R1 to M1. Commissioner Elliott moved, seconded by Commissioner Davis to set a public hearing for the request of Mr. Byron McKimmey to be considered at the Regular Planning Commission Meeting scheduled for December 9, 1991, at 7:30 p.m. MOTION CARRIED. A REQUEST TO SET A PUBLIC HEARING WAS PRESENTED BY FIRST ELEC TRIC, 901 NO. FIRST STREET, JACKSONVILLE, ARKANSAS. The request to rezone a parcel located between 901 North First Street and 1204 North First Street from C1 to C3 was presented to the Planning Commission. After discussing said request, it was the general consensus of the Commission that the petitioner go before the Board of Adjustment with a request for a variance to use the parcel as a "po1e yard". Commissioner Davis moved, seconded by Commissioner Dornblaser, that a public hearing be set for the next Regular Planning Commission Meeting scheduled for December 9, 1991, at 7:30 p.m. contingent on whether or not a Board of Adjustment request materializes from the First Electric Co. request. MOTION CARRIED. REQUESTS TO APPROVE BUILDING PERMITS: Arkansas Federal Credit Union, 2414 Marshall Rd. Jacksonville, AR City Engineer Reel noted that parking spaces, as required by Jacksonville Municipal Code, are adequate. He pointed out that CITY OF ,JACKSONVILLE, ARKANSAS REGULAR PLANNING COMMISSION MEETING November 12, 1991 7:30 P.M.  8:15 P.M. approval could be given contingent upon Water and Sewer Department approval, stating approval of the geometrics of the request-ed building permit which requests no variances from the Municipal Code. Commissioner Davis moved, seconded by Commissioner Piggee that the building permit request of Arkansas Federal Credit Union, 2414 Marshall Rd. be APPROVED contingent upon Water and Sewer Department approval. MOTION CARRIED. The following item was presented after the agenda was prepared. A preliminary plot plan was submitted for a residence to be built at 901 Stanphil Rd. for Mr. Danny Shillcutt. It was determined that the parcel is a portion of land whose previous owner was Mrs. Ann Wood. Engineer Reel said that this is the second lot which has been before the Commission from the parcel owned by Mrs. Wood with a building proposal. He said that at some point in time, a preliminary plat would have to be requested from the property owner. It was stated by the contractor, Don Meek, that Mr. Shillcutt purchased the land from Mrs. Woods brother and that Mrs. Woods owns the surrounding land. It was stated that the rouse would set forty feet back from the property line. City Engineer Reel said that all utilities are available. He related that if approval is given for this construction, it should be stipulated that no others will be approved unless a plat is submitted regarding the remaining parcel of ground owned by Mrs. Woods. City Engineer Reel related that the plot was a portion of a lot owned by Mrs. Woods daughter and that she has deeded it to her son Mr. Shillcutt. Commissioner Davis moved, seconded by Commissioner Herbold that the building permit be granted with the stipulation that a SUBDIVISION PLAN be submitted in December at the Regular Planning Commission Meeting with occupancy delayed until a FINAL PLAT is approved. MOTION CARRIED. RYE OFFICE MACHINES It was pointed out by City Engineer Reel that the front setback CITY Of JACKNONVILL1, ARKAMBAO REGULAR PLANNING COMMISSION MEETING November 12, 1991 7:30 P.M.  8:15 P.M. for the proposed construction at 201 South Jeff Davis is not listed on the plot plan but that it meets code requirements. City Engineer Reel said that Water and Sewer Department approval is pending and that minimum code requirements are met in the C2 zoning. It was pointed out that a waiver is needed for the five ft. side yard and the five ft. rear yard setbacks as requested in the plot plan. It was noted by City Engineer Reel that parking is adequate. Commissioner Dornblaser moved, seconded by Commissioner Davis that the request for a building permit as presented by Rye Office Machines, 201 South Jeff Davis, with a waiver for a five ft. rear yard and a five ft. side yard be APPROVED subject to Water and Sewer Department approval with proper fire wall ratings being met. MOTION CARRIED. ALLEY OR STREET CLOSINGS: Stone Street (one block long located between No. Oak and No. Elm St.) City Engineer Reel voiced that the street is shown on the origi-nal plat of the City of Jacksonville but that it was never uti-lize for any form of traffic nature, that at this time mobile homes sit on it and that the property owner is maintaining it. He added that for all practical purposes, it way never there. Commissioner Elliott moved, seconded by Commissioner Piggee that a recommendation be sent to the City Council to close Stone Street between No. Oak and No. Elm Streets. MOTION CARRIED. Park Street/Henry Addition City Engineer Reel related that the street was never utilized and that a petition was received from residents in the area that the street be closed. After discussion regarding the lots affected by the closing, it was requested that City Engineer Reel verify ownership of Lot 51 and the possibility of it being landlocked in the event the street is closed. Commissioner Elliott moved, seconded by Commissioner Piggee to recommend to the City Council the closing of Park Street/Henry Addition contingent upon Lot 51 not being landlocked with common ownership with Lots 50 and Lot 52. MOTION CARRIED. NONAGENDA: Viewing of a map from Metroplan regarding land use. CITY OF JACKSONVILLE, ARKANSAS REGULAR PLANNING COMMISSION MEETING November 12, 1991 7:30 P.M.  8:15 P.M. It was explained by Chairman Gray that upon approval of the land use map by the Planning Commission, a public hearing would be set by the City Council and the plan presented to the public for comment with final approval by the City Council. Each Commissioner was provided a copy of the map for study and action at the next regular meeting of the Planning Commission.
