OPENING REMARKS: Chairman Bart Gray Jr. opened the meeting and expressed appreciation for those in attendance. ROLL CALL: Commissioners: Elliott, Goodsell, Belden, Payne, Dornblaser, Gray, Piggee, Davis and Herbold were present. PRESENT nine (9). ABSENT (0). Chairman Gray declared a quorum. Others present for the meeting were City Engineer Duane Reel, Code Enforcement Officer John New, Mylissa Founds of the Engi-neering Department, petitioners and interested citizens. The press was not present for the meeting. PUBLIC HEARING: 7:30 P.M. - PART OF PLOT 5, AFB MAIN GATE DEVEL- OPMENT NORTH OF NIXON STREET, EXCEPT FOR THE W. 120 FT. FROM R-3 to C-3 Petitioner: Doug Wilkinson for Mary Jo DiGuiro through Dupree Co., Jacksonville, Arkansas Mr. Wilkinson said that the request for rezoning is based on the future land use of the parcel, that there are no immediate plans with regard to what will be placed there. He said that there is a dedicated street but no plans at this point to complete the street. The amount of property owned by Ms. DiGuiro was not determined. It was determined that there will be access to the parcel, that it would not be landlocked. City Engineer Reel pointed out that in recent rezoning, a 120 ft. buffer zone was left and that the same is true in this rezoning request. No negative comments were made with regard the rezoning. Commissioner Davis moved, seconded by Commissioner Piggee that a recommendation be sent to the City Council for the rezoning of Plot 5, AFB Main Gate Dev., North of Nixon Street except for the W. 120 ft. from R-3 to G-3. MOTION CARRIED. Commissioner Belden voted Nay. The Public Hearing was closed at approximately 7:40 p.m. APPROVAL AND/OR CORRECTION OF MINUTES: Regular Planning Commission Meeting of March 11, 1991 Commissioner Elliott moved, seconded by Commissioner Piggee that the minutes of the March 11. 1991 Regular Planning Commission Meeting be APPROVED. MOTION CARRIED. CITY OF JACKSONVILLE, ARKANSAS REGULAR PLANNING COMMISSION MEETING May 13, 1991 7:30 P.M. - 8:10 P.M. REQUESTS TO SET UP PUBLIC HEARINGS: No requests were submitted. REQUESTS TO APPROVE BUILDING PERMITS: a. Petitioner: Jim Green: Office Building on North First St. Chairman Gray introduced Mr. Green's request. A sketch of the construction proposed for the lot located on North First Street was presented by Mr. Green. Commissioner Kenny Elliott voiced that he had a problem with the sketch in that there is no detailed plan, nothing to tie the proposal as far as a legal description is concerned, elevations with regard to engineering drawings or flood plain information. After a lengthy discussion in which Mr. Green explained that the flood zone does encompass about five of the eleven acres in the Stonewall Subdivision he plans to develop. He said that the proposal before the Commission is speculation adding that the drawing being viewed and the proposed construction portion lies within the flood zone. Mr. Elliott voiced that he feels a more detailed plan should be submitted before the Commission approves a building permit; that no flood plain information is included in the proposed construc- tion. Other members of the commission agreed that more detailed infor- mation, consisting of drawings by Mr. Green's engineer should be presented before a decision is made. Commissioner Belden pointed out that this is a small portion of the major development and that more information should be pre- sented. City Engineer Reel said that he viewed this proposal as a sort of sketch plat adding that he would like to see an overall proposal of the development.. Commissioner Davis agreed that with proper information a building permit could be issued; a legal description, engineering drawings, setbacks, flood plain information, parking etc. Mr. Gray suggested that the item be brought back with engineering drawings for action at the next Regular Planning Commission Meeting. Mr. Doug Wilkinson presented a letter which grave him permission to present the rezoning request granted earlier in the meeting. CITY OF JACKSONVILLE, ARKANSAS REGULAR PLANNING COMMISSION MEETING May 13, 1991 7:30 P.M. - 8:10 P.M. b. Kerr McGee Shortstop at 120 Marshall Road by Petitioner Midstate Distributing, Inc. It was pointed out by Mr. Rick Kent that the side yard setback as requested, adjacent to the Waffle House, is ten feet instead of the required fifteen feet required by ordinance. He related that the building is not in the flood plain and explained the layout as presented to the Planning Commission. Commissioner Belden moved, seconded by Commissioner Dornblaser that the building permit request of Kerr McGee be approved. MOTION CARRIED.
