OPENING REMARKS: Chairman Bart Gray Jr. opened the meeting and expressed appreciation for those in attendance. ROLL CALL: Commissioners: Elliott, Payne, Dornblaser, Gray, Davis and Her-bold were present. PRESENT six (6). ABSENT (3). Chairman Gray declared a quorum. Others present for the meeting were City Engineer Duane Reel, Code Enforcement Officer John New, Mylissa Founds of the Engi-neering Department, petitioners and interested citizens. The press was not present for the meeting. APPROVAL AND/OR CORRECTION OF MINUTES: Regular Planning Commission Meeting o+ play 13, 1991 Commissioner Elliott moved, seconded by Commissioner Herbold that the minutes of the May 13, 1991 Planning Commission Meeting be APPROVED. MOTION CARRIED. REQUESTS TO SET UP PUBLIC HEARINGS: No requests were submitted. REQUESTS TO APPROVE BUILDING PERMITS: a. Petitioner: St. Stephens Episcopal Church Mr. David Sargent represented the item of business. City Engineer Reel voiced that all qualifications are met for a permit to be issued with regard to structure, setbacks, fire codes, plumbing and electrical codes. He pointed out that in each driveway off Northeastern Avenue, a pipe not less than twelve (12) inches in diameter will have to be installed. Commissioner Elliott moved, seconded by Commissioner Dornblaser that the building permit requested by St. Stephens Episcopal Church, to be constructed at the corner of Madden Rd. and Northeastern Avenue, be APPROVED. MOTION CARRIED. Chairman of the building committee, Mr. Bob Harris, presented an invitation to all commissioners to attend the ground breaking ceremonies, June 20 1991 at 7:00 p.m. b. Petitioner: Wright's Cabinet Shop Engineer Reel informed the commissioners that additional property has been acquired by Wright's Cabinet Shop on the north side of their existing property so they can add on to the north and west sides of their building. It was noted that the additional property was acquired by a swapping of property between Mr. Morden and Mr. J.C. George. Commissioner Paul Payne moved, seconded by commissioner Jim Davis to approve the building permit request of Wright's Cabinet Shop. MOTION CARRIED. A short discussion ensued with reference to the approximately six tenths of an acre of ground with a metes and bounds legal de-scription which passed hands without being brought before the Planning Commission. (Ref: City Code Requirement Chapter 1, that parcels under five (5) acres, legally described by metes and bounds, come before the Planning Commission) It was the consensus of the Planning Commission that the City Engineer write a letter to realtors, surveyors, engineers, ab- stracters and closing companies regarding the code requirement. c. Petitioner: Jim Green/North First Street City Engineer Reel voiced that Mr. Green refined the request submitted at the last Planning Commission Meeting and has cut it down to the properties that he needed to encumber the particular office building that he wants to construct because he was not able to make ant definite statements about future developments in the area. He said that the survey shows actual elevations in relation to the flood plain and the flood way. He said that there is a thirty foot easement on the north side of the property which is touched by one corner of the building. He said that the thirty feet comprises the flood way on the particular side of the ditch shown on the layout. He said there can be no improvements in a flood way pointing out that the flood plain extends beyond that and comprises the parking area and his building. He related that the finished floor elevation of the building has been set one foot higher (274) than the proposed one hundred year flood in that area which is 273. He noted that the parking area will have to be revised in that one parking space in the flood way will have to be deleted. It was pointed out that a one (1) hour fire wall or the setback required by city code be followed in the construction on the south side of the building Chairman Gray voiced that he felt clarification should be made with regard to the access to the building. Engineer Reel said that the drive, which is the responsibility of Mr. Green, is not part of the metes and bounds plot. CITY OF JACKSONVILLE, ARKANSAS REGULAR PLANNING COMMISSION MEETING June 10, 1991 7:30 P.M.  8:40 P.M. The commission discussed requesting a plat of the development as a whole. Engineer Reel said that it is difficult to come up with a development scheme when plans are incomplete. The consensus of the commission was: (1) that a ten foot right of way along the entire property line be requested, that the driveway and access easement be included as a part of the plans submitted (2) that a one hour fire wall be constructed on the south side of the building (3) that the one parking space in the f1oodway be deleted and (4) that the final plat, with the access easement included, be recorded as a legal subdivision before a certificate of occupancy is issued. Commissioner Davis moved, seconded by Commissioner Herbold that the building permit be approved as requested with the following stipulations: (1) that a ten foot right of way along the entire property line be requested, that the driveway and access easement be included as a part of the plans submitted (2) that a one hour fire wall be constructed on the south side of the building (3) that the one parking space in the flood way be deleted and (4) that the final plat, with the access easement included, be recorded as a legal subdivision before a certificate of occupancy is issued. MOTION CARRIED. REPLAT of LOTS 24,25,26,27,38 and 39 of OAK SHADOWS SUBDIVISI0N/PULASKI COUNTY A plat was viewed by the Planning Commission. Engineer Reel voiced that Oak shadows Subdivision was presented to the commission for Preliminary Plat approval in 1986. He related that the subdivision has one street onehalf mile long and that the commission suggested that approximately half way between the beginning and end that provision for access be made going south out of the subdivision. He said the plat was revised to show a fifty (50) ft. right of way for the street or road to be constructed going south. He added that the street was never constructed on the south side and that the proposal is to elim-inate that right of way that was asked for to the south and incorporate it into those two 1ots. He said that the four 1ots on the end are requested to be approved as replated with a culde-sac with allowance far an access easement going on to the west. It was pointed out by Mr. Tim Lemons of Band Consulting Engineers that the county will not accept the half mile street for maintenance unless the city recommends closing the fifty (50) foot right of way street access as requested in the plat present-ed to the Planning Commission in 1986. Commissioner Dornblaser moved, seconded by Commissioner Elliott that the replats of Lots 24,25,26,27,38 and 39 of Oak Shadows Subdivision be approved as requested with the stipulation that a fifty foot easement be included on the east side of Lot thirty-eight (38) between lots thirtyeight (38) and thirtynine (39) be included in the plat. MOTION CARRIED. NONAGENDA ITEM: City Engineer Reel presented a Proposed Development Scheme for the City of Jacksonvi1le. He said that Mr. Charles Randall will be at the next meeting to review the map with the commission. ADJOURNMENT: Chairman Gray adjourned the meeting at approximately 8:40 p.m..
