AN AiDPNANCE CANCELLING THE AGREEMENT BETWEEN
TAE H. J. HENRY ESTATE, INC., AND THE CITi OF
JACESO ?NIECE, ARKANSAS, PROVIDER; FOR THE OPEN*
INS AND DEDICATION OF AN ALLEY IN BLOCK 211.
CITY OF JAC3SONVIILE. ARKANSAS. •
WHEREAS, on or about the 9th day of April 1953 the M. J. Henry Estate, Inc., filed
its Petition with the City Clerk of the City of Jnokmnville, Arkansas, requesting that
an alloy located in Bleak 24 in the City of Jacksonville. to vacated cal abondoaedi
sal,
WHEREAS, pursuant to the statutes of the State of Arkansas and the ordinances of
the City of Jacksonville, Arkansas, the alley situated in Block 24 of the City of
Jacksonville nue subsequently vacated and abandoned; and,
WHEREAS, on or about the 10th day of July, 1953 the M. J. Henry Estate, Inc.,
entered into an agreement with the Weyer and City Council of the City of Jacksonville,
Arkansan, which agreement provided that at the request of the City Council the M. J.
Henry Estate, Inc., would take such legal steps that might be necessary to open and
dedioate to the public an alley to be located immediately north and west of the alley
in Block 24 previously oloaed by the ordinance of the City of Jacksonville; and.
WHEREAS, the M. J. Henry Estate, Inc., is the owner of all of Block 24 lying north
and west of the alley previously vacated and abandoned; end,
WHEREAS, the Petitioner, the M. J. Hoary Estate, Inc., by ite Petition filed with
the City Clerk of the City of Jacksonville. Arkansas, on the day of
1956 ask for an Ordinanoe to be passed vitiating and canceling such a greements and,
WHEREAS, it would be to the best interest of the M. J. Henry Estato,'Ino., the Mayor
and City Counoil of the City of Jacksonville and the public generally that said egreemeht
be vitiated and cancelled,
NOW, TNERFORE,
BE IT ORDAINED BY THE CITY COOIICII. OF THE CITY OF JACKSONVILLE: •
Section 1. Tho agreement entered into by end between the M. J. Henry Estate, Inc.,
and the Mayor and City Cannot' of the City of Jacksonville, Arkansas, on July 10. 1953.
wherein the M. J. Henry Estate, Inc., agreed at the request of the City Ceuabil that it
would take such legal stops as might be necessary to open and dedicate a public alley
to be located immediately north and west of the alley in Block 24 previously oloaed by the
Ordinance of the City Council of the City of Jacksonville, be and the same is hereby
vitiated, oenoolled and held for naught. -
Section 2. This Ordinance shall be in full force and effeot from and after its
passage.
