SPECIAL PLANNING COMMISSION MEETING
NOVEMBER 21, 2002
5:30 P.M. – 6:05 P.M.
OPENING REMARKS:
Chairman Brannen opened the meeting at approximately 5:30 p.m.
expressing appreciation for those in attendance.
ROLL CALL: Commissioners: Susan Dollar, Chad Young, Glen Keaton, and
Tammy Green, answered ROLL CALL. Chairman Brannen also answered ROLL
CALL. PRESENT five (5), ABSENT four (4).
Others present for the meeting were City Engineer Whisker, Mr. Barry
Williams, Mr. Bill Edwards, Mr. Tommy Lassiter, Mr. Jim Green, members
of the press, interested citizens, and petitioners.
APPROVAL AND/OR CORRECTION OF MINUTES:
Commissioner Keaton moved, seconded by Commissioner Young that the
minutes of the 14 October 2002 Regular Planning Commission meeting be
APPROVED. MOTION CARRIED.
PUBLIC HEARING(S):
BUILDING PERMIT(S): FAMILY DOLLAR STORE/Hwy 161 & Tricky Lane
Mr. Bill Edwards stated the property is located at the southeast
corner of Tricky Lane and Hwy 161. He stated the building will face
Hwy 161. He related the property consists of the vacant lot and the
lot behind it that a house located on it. He stated that the site
plan meets all codes as provided by City Engineer Whisker regarding
parking, grading, and drainage requirements.
City Engineer Whisker stated that the driveway requirements do not
exactly fit, but added that the developer has placed the driveways to
the edge of the property as far as possible. He stated that they are
combining two driveways. He related that the property is directly
across from the City Auto & Paint Body Shop, adding that the developer
plans to demolish the structure located behind the corner lot. He
stated that the developer proposes curb and gutter with asphalt
paving, and an inlet on the south side of the property to catch and
move water through a pipe to the north existing inlets on Tricky Lane.
He related that there would be a grass strip behind the sidewalk on
Tricky Lane, Hwy 161 and then by the driveway on south side of the
property entering from Hwy 161.
Commissioner Green moved, seconded by Commissioner Keaton to approve
Building Permit for Family Dollar Store on Hwy 161 & Tricky Lane.
MOTION CARRIED.
REQUEST TO APPROVE PLAT(S): a. FINAL PLAT Jacksonville Plaza Addition
Representative Barry Williams with Thompson Engineering stated that
the construction is finished and the owner is ready to obtain
occupancy, adding that they have met all utility requirements and
other requirements as directed by City Engineer Whisker and are asking
for final plat approval so that the plat can be filed and recorded.

City Engineer Whisker stated that the building is completed and the
two out parcels are ready for construction with the final platting.
Chairman Brannen expressed his ongoing concern regarding the exit
situation making a left hand turn onto John Harden.
Mr. Williams stated that it is imperative to the development to be
able to have access in the manner that the driveway is constructed.
Mr. Tommy Lassiter addressed Chairman Brannen’s concern, stating that
he feels traffic will quickly learn that access to the left will be
easier through the traffic signal at Wal-Mart. He related that he has
made many turns from the exit and has noted that there are times when
the traffic is backed up, but noted that at those times people will
more than likely go to the Wal-Mart traffic signal or make a right
hand turn back to the James Street overpass. He stated that the
traffic situation is tough, but doubts that the shopping center has
added much to that. He related that he feels many of the shoppers are
from the Wal-Mart Supercenter, adding that so far it has worked quite
well and there have not been any complaints from the four stores that
have opened.
Commissioner Young moved, seconded by Commissioner Dollar to approve
Final Plat of the Jacksonville Plaza Addition as presented. MOTION
CARRIED.
b. FINAL PLAT: Collenwood Subdivision Phase IV
Chairman Brannen questioned if all work had been completely finished.
Mr. Green stated that it had to the best of his knowledge.
City Engineer Whisker stated that he was under the assumption that Mr.
Green would have the lake area completed at the time of the final plat
of Phase IV. He related that the final grading is being done now,
pointing out that a 5 foot section of flume has been left out in order
to move equipment back and fourth across the lake and that there is
one pipe left to be installed at the south end of the property next to
Colonial Drive. He related that both items are not included in the
final plat; however, the pipe is responsible for draining the property
from Phase IV. He then stated that both utilities have given him a
letter and Mr. Green has provided a written letter of warranty for the
streets. He stated that he does not feel that the flume part is a
problem, saying that it is just a philosophical difference regarding
if that area should be platted with the rest of the property when he
is finished or should it be a secondary item to the final plat. He
stated that his recollection was that all the property would be
submitted as compete with the Final Plat of Phase IV.
Chairman Brannen questioned when the lake area would be completed.

Mr. Green stated that assuming the weather holds, the lake would be
completed in the next ten days. He related that they still lack some
dress up work, mostly regarding seeding. He stated that the only
physical aspect is the pipe. He explained that a 12 or 15” pipe was
installed sometime around Phase I drained across a part of what is
proposed to be a park area, but had originally been proposed as a
grass swell. He stated that when the park was proposed they put a
pipe in, adding that because of the flatness of the area they had to
add another pipe beside it to carry water without backing up. He
related that the pipe was a temporary pipe they had for this phase,
which has just been dug out this week. He stated that the pipe is not
really a part of Phase IV, but that he and City Engineer Whisker have
talked about it during the construction of this phase.
Chairman Brannen questioned if Mr. Green would have another phase
after this one.
Mr. Green stated that Phase IV is the final phase of Collenwood
Subdivision, adding that when the lake is finished it will be deeded
over to the property owners association. He stated that the
construction end of the project for him will be finished.
Chairman Brannen questioned how long it would take.
Mr. Green stated it would be approximately a one-day job.
Chairman Brannen questioned if it would cause a problem if the item

were tabled until December 9 to ensure that all construction is
completed.
Mr. Green stated that it is more of a problem with the homebuilders
who want to get houses going while the weather is nice. He related
that he has promised them for a month that they would be done and then
they missed that deadline because of the rain and now he has told them
one week ago that it would be completed this last Monday and has not
been able to do that. He stated that it is a matter of construction
needs conflicting with the weather at this point. He added that he
never anticipated that the lake would be dealt with as a part of this
phase, saying that he had just never put the two together.
Commissioner Young stated that the plat could not be forwarded to the
City Council without everything having been completed.
City Engineer Whisker reminded the Commission that this would be the
final phase.

Chairman Brannen asked for a motion to table until December 9 in the
hope that everything will be complete as of that date.
Commissioner Dollar moved, seconded by Commissioner Green to table the
Final Plat of Collenwood PH IV until December 9, 2002.

Mr. Green stated that he does not believe that the records will
reflect anything dealing with Phase IV of Collenwood Subdivision that
has any mention or bearing what so ever to do with that lake project.
Chairman Brannen related to Mr. Green that he has put the Planning
Commission in a position that once the final plat is approve he could
walk away from the job without completing the construction. He stated
that the Planning Commission does not want to be put in the position
of granting approval prior to the completion of a project.
Mr. Green questioned what the lake area has to do with the
subdivision. He stated that a subdivision does not necessarily have
to have a lake.
Chairman Brannen questioned if the lake area is part of his
subdivision plan.
Mr. Green responded that it is part of his concept, not a part of any
plan that has been approved through the Planning Commission. He
reasoned that if he were not to finish the lake then the property
owner’s recourse would be through the court system.
In response to a question posed by Chairman Brannen, City Engineer
Whisker reiterated that to complete the project Mr. Green still needs
to put in the pipe, finish the flume and dress up of the lake area.
At this time, MOTION CARRIED.
ZONING FOR ANNEXED PROPERTY TO JACKSONVILLE
City Engineer Whisker stated that an enclosure in the packet is a
photograph regarding the area of South Jacksonville that needs to be
recommended for zoning. He questioned if the Southeast Annexation
should also be addressed for zoning.
City Attorney Bamburg clarified that the Planning Commission would
need to make a recommendation to the City Council regarding what
zoning classification should be set for the annexed areas. He noted
that the Planning Commission would host the public hearing and then
make recommendation to the City Council.
Commissioner Green moved, seconded by Commissioner Keaton to set a
public hearing for the regularly scheduled meeting in January 2003
regarding zoning classification of the south and southeast annexed
properties. MOTION CARRIED.
