SECTION 1.

That Southwestern Status Telephone Company, its successors or assigns, shall be and it is hereby grant-
ed the right in the City of Jacksonville, Pulaski County, Arkansas. to conduct the bueinees of furnishing
telephone service and any business lncicent thereto and to install, maintain, and operate a telephone system,
to maintain all construction coroistin; of polar., vdres, cables, and other fixtures and such other telephone
apparatus of whatever nature necessary for the rurnlshieil of telephone service on, along, acre's, over and
under all of the streets, avenues, alloys noel other public places of said City for the purpose of conducting
such business.
SECTION 2.
The term of this franchise shall be or the period of five (5) years, dating from the date of its
passage by the City Council.
P..ECTION 3.
That the poles, wire, cables and underground conduits and other apparatus used by Southwestern States
Telephone Company, its successors nr assigns shell, in tie conduct of its business to so placed and saietain-
ed at all Omen as not to interfere with the travel on or use of said streets, alleys aid public was o!" said
City, and the Southwestern Sta'.es Telephone Company, its successors or assigns, agrees also to held said City
of' .Jacksonville, Pulaski. County, Arkansas, free and harmless of any aai all damages arising from any abuse or
negligence of said grant in this regard.
SECTION h.
That Southwester States Telephone Company, its successors or assigns, shall at all times, attar the
granting of this ordinance, keep and - a;ntain its ple••t in first eller condition, act of Bad, and the public
enemy, strikes and other unavoidable accidents excepted, and stall render and furnish services to all in-
dividuals, firma, er ooroorntinns within the corporate limits of the City of Jacksonville, Pulaski County.
Arkansas. in accordance with reasonable rules and regulations and in compliance with the laws of the State
of Arkensao.

Xn eonetderat ion of three and one •half per cent (3 of the grass revenue derived from exchange station
rentals located within the City of Jacksonville, the said City a,*.rees that this oampensstion shall be for all

SECTION F.

Tiny rights herein granted shall he subject to all existing pollee ordinances at the City of Jaekscsvllle.

SECTION 7.
This tax will be effective April 1, •1955 and shall be due and payable quarterly la arrears.
SECTION A.
The amount of this tax or license imposed by this Ordinanoe shall be demand a debt due the City of
Jacksonroille, Arkansas.
SECTION 9.
Any person, firm or corporation violating any provisions of this Ordinance shall be deemed guilty of a
misdemeanor and upon conviction may be fined in any amount not less tin 410.00 and not more than $100•00
and each day shall constitute a separate ocfenso.
SECTION 10.
Southwestern States Telephone Company agrees to file with the Mayor of the City of Jacksonville,
Arkansas. its written acceptana:e of tht e Ordinance within 30 days after its approval.
SECTION 11.
This Ordinance shall be in force and effect from and after its passage and publioation•
