00 OCT 09.doc CITY OF JACKSONVILLE, ARKANSAS REGULAR PLANNING COMMISSION MEETING OCTOBER 9, 2000 7:00 P.M. - 7:40 P.M. OPENING REMARKS: Chairman Brannen opened the meeting at approximately 7:00 p.m. expressing appreciation for those in attendance and requested roll call. ROLL CALL: Commissioners: Bart Gray Jr., Lester Piggee, Dean Wilborn, and John Hardwick answered ROLL CALL. Chairman Brannen also answered ROLL CALL. PRESENT five (5), ABSENT (2). Others present for the meeting were City Engineer Whisker, Alderman Kenny Elliott, Mr. Tommy Bond, Mr. Duane Reel, Patriot Reporter Peggy Koury, petitioners, and interested citizens. APPROVAL AND/OR CORRECTION OF MINUTES: Commissioner Wilborn moved, seconded by Commissioner Hardwick that the minutes of the 11 September 2000 Regular Planning Commission Meeting be APPROVED. MOTION CARRIED with Chairman Brannen voting AYE. PUBLIC HEARING(S) a. CONDITIONAL USE and REPLAT of property at 603 Marion Street Chairman Brannen opened the public hearing at approximately 7:02 p.m. Pastor Johnny Walker related the desire to construct a church on Marion Street, City Engineer Whisker added that he had informed Mr. Walker that lots 16 and 17 would need to be replatted to accommodate construction, adding that being zoned C-3 a church is listed as a conditional use of that zone. He related that the church owns all five parcels on Marion Street. With no one to speak in opposition, Chairman Brannen closed the public hearing at approximately 7:04 p.m. Commissioner Piggee moved, seconded by Commissioner Wilborn to approve the Conditional Use for the proposed church and replat of lots 16 & 17. MOTION CARRIED with Chairman Brannen voting AYE. b. Rear Yard Setback for Bethel Baptist Church Chairman Brannen opened the public hearing at approximately 7:05 p.m. Mr. Charles Corneilus related that the Planning Commission addressed the item in 1996, but added that the building has been redesigned since that time. He stated that the Planning Commission had approved a 3-foot side yard variance, 8-foot rear yard variance, and a parking waiver. He stated that with the design change the side yard variance and parking waiver are no CITY OF JACKSONVILLE, ARKANSAS REGULAR PLANNING COMMISSION MEETING OCTOBER 9, 2000 7:00 P.M. - 7:40 P.M. longer needed, but the 8-foot rear yard variance is still requested. He stated that the building has a 21-foot setback from the property line, but added that to accommodate an air conditioning system at the rear of the building they are requesting an 8-foot variance from the 20-foot required setback. City Engineer Whisker stated that he and the Fire Marshall have reviewed the proposed plot plan and are not opposed to the requested variance. Chairman Brannen noted a letter provided from Mr. Billy Hall that grants additional parking if needed. With no one to speak in opposition, Chairman Brannen closed the public hearing at approximately 7:07 p.m. In response to a question from Commissioner Hardwick, Mr. Corneilus stated that the original plans required 75 parking spaces. He then related that the existing property can supply 30 spaces, and the property directly across Garland Street has space for 30 more vehicles, adding that permission was granted by Mr. Hall to utilize parking where the church rents office space. He stated that together there would be no problem providing 100 parking spaces. Mrs. Hall was present to verify the letter of permission. Commissioner Gray moved, seconded by Commissioner Wilborn to grant a building permit with 8-foot setback variance at 112 North Jeff Davis. MOTION CARRIED with Chairman Brannen voting AYE. REQUEST TO APPROVE BUILDING PERMITS: a. Bethel Baptist Church 112 North Jeff Davis Permission for a building permit was granted in the public hearing process regarding the setback variance request. b. 3505 North First Chairman Brannen noted that as per the previous Planning Commission meeting it was requested that the entire property be included in one metes and bounds description. Mr. E. Ray Smith related that entire tract of property is now all-inclusive in the request for a building permit. Discussion ensued and it was related that the property is a proper metes and bounds with established utilities. CITY OF JACKSONVILLE, ARKANSAS REGULAR PLANNING COMMISSION MEETING OCTOBER 9, 2000 7:00 P.M. - 7:40 P.M. City Engineer Whisker related that Shane Drive will remain as an undedicated street that does not belong to the City. Commissioner Gray stated that if in the future should any of the property be subdivided by Mr. Smith or any adjacent property owners, improvements would be required to bring the street to meet City standards. Commissioner Gray moved, seconded by Commissioner Hardwick to accept the metes and bounds building permit as presented. MOTION CARRIED with Chairman Brannen voting AYE. c. Pathfinder Administrative Building 901 Redmond Road Mr. Caradine related that the Administrative Building is Phase II of the Pathfinder complex. He stated that it will be located south of the Skill Training Center, adding that water and sewer is served from improvements regarding construction of the Skill Training Center completed approximately one and a half years ago. City Engineer Whisker related that the property is not located in the flood plain, adding that it is adjacent to Main Street with an access point of 300 feet from the intersection of Redmond Road. He stated that he believed the Fire Marshall has reviewed most of the plans and is requesting that approval be contingent on acceptance from the Fire Marshall and himself. It was noted that the Fire Marshall has reviewed the plans and a letter would be forthcoming. Commissioner Gray moved, seconded by Commissioner Hardwick to grant a metes and bounds building permit as requested subject to approval from the Fire Marshall and City Engineer. MOTION CARRIED with Chairman Brannen voting AYE. Commissioner Gray complemented the facility, saying that it would be a good addition designated for the west end of Main Street. c. Shopping Center proposed at 2650 John Harden Drive City Engineer Whisker related that there had been discussion regarding the pipe that runs underneath the property, but does not foresee a problem. He stated that the property can provide ample parking, but is required by code to have two loading areas. Discussion ensued as to the addresses of the businesses located in the area and it was decided that the address of the proposed development would be checked for accuracy. Chairman Brannen questioned drainage concerns regarding the build up of land between the proposed development and the adjacent business. Mr. Preston Robinson pointed out a drainage ditch at the rear of the property to address any concerns. Commissioner Gray moved, seconded by Commissioner Hardwick to approve the building permit as requested with requirement of two loading zones as per the City Engineer. MOTION CARRIED with Chairman Brannen voting AYE. Mr. Tommy Bond stated that there is ample room for a loading zone at the rear of the building, which is 400 feet in length with a drive area surrounding the building. REQUEST TO APPROVE PLATS: a. PRELIMINARY PLAT and PROPOSED ANNEXATION/Oak Ridge Ranch Subdivision Mr. Tommy Bond stated that there is no requested action for the plat or proposed annexation, but is being presented as an informational item for discussion before the annexation procedure begins. He related that the lots adjacent to Maddox Road has a church on lot 5, which is adjacent to a residence on lot 4. He then related that lot 3 is vacant and lots 2, 17, 18, 19, have homes. He stated that he has visited each of the homes and left information regarding the annexation and asking for a response. He related the effort to include everyone that might want to be annexed into the City. He stated that without response from the homeowners they are proposing annexation of the development and the access road leading into it. He reiterated that the developer wanted to offer the Planning Commission an opportunity for input. He then relate that the Toneyville feed store owner does not want to participate in annexation into the City. Commissioner Gray explained that part of the annexation process is a request from the property owner to be annexed followed with an overview and recommendation from the Planning Commission to the City Council regarding the annexation request, adding that the City Council will forward the request to the County Judge and Quorum Court for acceptance regarding withdrawal from the County. He related that in review of the proposed subdivision, the Planning Commission felt the development should be annexed into the City. He mentioned developer cost regarding infrastructure of water and sewer. He then stated that the annexation would be good for the future development of Jacksonville. CITY OF JACKSONVILLE, ARKANSAS REGULAR PLANNING COMMISSION MEETING OCTOBER 9, 2000 7:00 P.M. - 7:40 P.M. Mr. Bond agreed, saying this is the reason it has been brought before the Planning Commission for review regarding thoughts and suggestions. He related that the mobile home park on Maddox Road had not been contacted regarding annexation efforts, but all other adjoining property owners except owners of the vacant lots were contacted. He stated that the process will take approximately sixty-days regarding public notices and County considerations. Commissioner Gray stated that one question he would have involves adequate infrastructure, saying that as the process for annexation is worked through and development ensues part of the issue would be to make sure infrastructure for the subdivision and any future demands could be met. He pointed out future neighbors preferring to have City utilities. Discussion ensued and Mr. Bond stated that annexation could be requested by property owner or proposed by the City. He related that the driving force would be desired utilities, police and fire protection. He stated in his conversations with some of the property owners of the area there were mixed feelings, adding that the one property owner indicated that he did not want to be annexed into Jacksonville, and another property owner was interested mainly for the significant difference in fire insurance. Commissioner Hardwick noted that while the property is in the AICUZ zone, it is not in one of the clear zones and does not adversely affect the operations of the Air Force Base regarding density factors. Mr. Bond agreed, stating that the developer has met with Air Base Engineers as previously requested by the Planning Commission. Commissioner Hardwick voiced his support of the annexation, but questioned if the annexation would adversely affect the City’s fire rating. Mr. Bond related that water flow issues are being resolved. He stated that he met with the Water Commission regarding a new analysis. He explained one problem has been that Cabot uses approximately 14 hundred gallons a minutes on a sixteen inch line along Hwy 67. He related that Cabot’s demand lowers the area rating. He related that the flow is at 600 but needs to be at 1000. He stated that Cabot is going off line in six to nine months which should resolve some water issues, adding that then a new hydraulic model will be run showing that demand removed. CITY OF JACKSONVILLE, ARKANSAS REGULAR PLANNING COMMISSION MEETING OCTOBER 9, 2000 7:00 P.M. - 7:40 P.M. Commissioner Hardwick question responsibility of the developer to incur the cost of a stand pipe if the water pressure was not adequate, to raise the rating for the City. Mr. Bond stated that all issues would be addressed next month with the final/preliminary plat that will indicate the final design regarding water, sewer, streets, and storm drainage. City Engineer Whisker stated that the only adversity he observed is that a portion of the northern property is located in the flood plain. Mr. Bond stated that there are 12 lots that are shown to be in the flood plain. He explained that he may have estimated the flood plain elevation too high, because it is not determined for that area. He said that he took Jacksonville’s flood plain elevation from North First Street and raised it one-foot. In response to a question from Chairman Brannen, Mr. Bond stated that the access road will be the connection to Jacksonville City Limits, adding that it is hoped that some of those residence will want to be a part of the annexation. He then stated that Maddox Road would become a part of the City street system, pointing out the similar situation to Loop Road regarding parts of the street which is included in the City street system. Discussion ensued and it was determined that recommendation to the City Council would follow when specifics are worked through. Commissioner Hardwick suggested that the developer meet with the Fire Chief regarding water pressure concerns and any effect the annexation may have on the City’s fire rating. Mr. Bond stated that the information would be included on the preliminary plat. b. FINAL PLAT: JORDAN ACRES/Lots 1 through 25 Mr. Duane Reel representative for Jordan Acres development stated that the final plat is identical to the preliminary plat presented August 1998. He related that the developers are requesting approval with the stipulation that it not be presented to the City Council until the streets are completed and accepted by the City Engineer. He stated that hopefully the streets will be completed before the next scheduled Planning Commission meeting. City Engineer Whisker presented no objection, saying that letters of acceptance from Water and Sewer are forthcoming and that the Fire Marshall accepted the preliminary plat presentation. Commissioner Hardwick moved, seconded by Commissioner Piggee to accept the Final Plat of Jordan Acres lots 1 through 25 stipulating street acceptance from the City Engineer before presentation to City Council. MOTION CARRIED with Chairman Brannen voting AYE.
