b. REZONING: 1216 Military Road from R-1 to C-3

hearing.
Mr. Sammy Crook related the desire to place a car lot for the
requested location.
At approximately 7:06 p.m., Chairman Brannen closed the public
hearing.
Commissioner Gray related that the rezoning request is in conflict
with the Land Use Map which shows the property as residential. It
was noted that the Land Use Map would need to be amended to
consider the rezoning request.
Discussion ensued regarding the procedure to rezone from
residential to commercial.
Commissioner Piggee moved to recommend a change in the Land Use Map
regarding the rezoning request.
MOTION DIED FOR LACK OF A SECOND.
Mr. Sammy Crook questioned the possibility of a variance instead of
a rezoning.
Further discussion ensued and it was determined that a variance
could not be granted against the Land Use Map and that the use of a
car lot was not an allowable conditional use for R-1.
Commissioner Hardwick moved, seconded by Commissioner Corroum to
deny the request to rezone based upon the Land Use Map and the
current zoning of R-1. MOTION CARRIED.
In response to a question from Commissioner Piggee, City Attorney
Bamburg related that the process to change the Land Use Map is
multi-faceted task. He stated that the Commission would begin by
looking at the nature of the land and then determine if
modification is appropriate. He further related that a
recommendation from the Planning Commission would be brought before
2
the Council for vote to change the Land Use Map. He stated that if
the Land Use Map were amended, then the petitioner would need to
submit a rezoning request in compliance with that change.
