SPECIAL PLANNING COMMISSION MEETING
APRIL 13, 2000

OPENING REMARKS:
Chairman Brannen called the special Planning Commission meeting and
public hearing to order at approximately 12:15 p.m.
ROLL CALL: Commissioners: Ken Nabors, Bobby Lester, Dean Wilborn,
and John Hardwick answered ROLL CALL. Chairman Brannen also
answered ROLL CALL and declared a quorum. PRESENT five (5), ABSENT
(2).
Others present for the meeting were City Engineer Reel, and
Petitioner Mr. Bart Gary Jr.
PUBLIC HEARING(S)
CONDITIONAL USE of R-3 in C-2 zone/900-910 Military Road
Mr. Gray presented a survey of the 10-acre tract located at the
corner of Woodbriar Drive and Military Road. He reviewed the uses
of C-2 zoning and added that there was no opposition to the
th
conditional use request regarding the April 10 public hearing. He
stated that the Winrock Development Company and ERC properties are
the proposed buyers of the property. He then related that ERC
properties is a multi-family developer for apartment complexes. He
stated that the general scope of multi-family housing would be more
neighborly than a C-2 zoning use. He related that one of the
opportunities under C-2 zoning is a conditional use that allows for
construction of multi-family or other housing. He related that the
construction project will be similar to the Timberwood project on
South Hospital Drive, which was granted a residential conditional
use in a commercial zone. He stated that the ten-acre property
will be sold in two phases and that the first six-acre phase has
financing allowing ERC properties to build apartments. He related
that ERC properties would submit a site plan/construction plan to
the Planning Commission for their review and decision as to the
lay-out of the site. He stated that the variance will allow ERC
properties to complete the purchase and begin the development
process. He stated that the variance would be granted to ERC
properties and if they do not purchase the property or build
apartments then the variance becomes void. He then stated that at
that point the zoning stays with the land and the current ownership
of Winrock Development.

Commissioner Lester moved, seconded by Commission Wilborn to grant
an R-3 conditional use to ERC Properties regarding property located
at 900-910 Military Road. MOTION CARRIED.
ADJOURNMENT:
Commissioner Nabors moved, seconded by Commissioner that the
meeting be adjourned at approximately 12:25 p.m.
