00 APR 10.doc CITY OF JACKSONVILLE, ARKANSAS REGULAR PLANNING COMMISSION MEETING APRIL 10, 2000 7:00 P.M. - 8:00 P.M. OPENING REMARKS: Chairman Brannen opened the meeting at approximately 7:00 p.m. expressing appreciation for those in attendance and requested roll call. ROLL CALL: Commissioners: Ken Nabors, Bart Gray, Dean Wilborn, and John Hardwick answered ROLL CALL. Chairman Brannen also answered ROLL CALL and declared a quorum. PRESENT five (5), ABSENT (3). Others present for the meeting were City Engineer Reel, Mr. Tommy Bond, Mr. Tommy Dupree, Mr. Harold Crook, Patriot Reporter Peggy Koury, petitioners and interested citizens. APPROVAL AND/OR CORRECTION OF MINUTES: Commissioner Nabors moved, seconded by Commissioner Wilborn that the minutes of the 13 March 2000 Regular Planning Commission Meeting and the 28 March 2000 Special Planning Commission Meeting be APPROVED. MOTION CARRIED. PUBLIC HEARING(S) a. REZONING of 1801 Braden Street Chairman Brannen related that the petitioner has requested the item for rezoning be withdrawn. CONDITIONAL USE of R-3 in C-2 zone/910 Military Road At this time, Chairman Brannen delayed the public hearing regarding the requirement for a member majority vote. REQUEST TO APPROVE PLATS: PRELIMINARY PLAT of DBSS Development North Pulaski County. Petitioner Dana Nixon Representative Mr. Tommy Bond related that the 90-acre development is located 4,500 feet beyond the AICUZ zone east of Batesville Pike and north of Runyon Acres. He stated that the development consist of 29 parcels of 3 acre lots. He related that the streets would be development to County and North Little Rock standards and the water service will be provided by North Pulaski Water Users Association, sanitary sewer will be septic tanks. In response to a question posed by Commissioner Gray, Mr. Bond related that they would construct the street with 8” of sub-basin. CITY OF JACKSONVILLE, ARKANSAS REGULAR PLANNING COMMISSION MEETING APRIL 10, 2000 7:00 P.M. - 8:00 P.M. City Engineer Reel related that the development exceeds minimum design requirement from the City of Jacksonville. Commission Nabors moved, seconded by Commissioner Hardwick to approve the Preliminary Plat of DBSS development. MOTION CARRIED. b. PRELIMINARY PLAT of Triangle Park Development Petitioner Preston Robinson Representative Mr. Tommy Bond related that the vicinity of the area is General Samuels and Redmond Road in the Northeast quadrant adjacent to the Little Rock Air Force Base. He stated that the 40 acre development will consist of eight lots with public rights-of-way and easements for utility access and pointed out a separate fire protection system regarding the utility plan. He stated that the development will remain under one owner who will develop the property as demand presents. In response to question posed by Commissioner Gray, Mr. Bond related that the street being constructed between lots 3, 4 and 5 is necessary because the majority of access to the building will be from a street to the north of lot 5. Discussion ensued and it was noted that street layout and completion of the lots as presented is designed to generate traffic to Redmond Road instead of General Samuels since it is a major street and Redmond Road to the north end has less traffic. Mr. Bond then related that the development would begin with lot 1 and continue one lot at a time, as demand requires. Commissioner Gray questioned if the development plan as presented should be considered a sketch plat following with lot 1 and the street as a preliminary plat. Mr. Bond related that the utility layout locks in the design plan but added that the development will most likely be completed in phases beginning with the northern most street and moving south. Commissioner Gray suggested that before it returns as a final plat it could be phased by lot and partial street in preliminary plats. CITY OF JACKSONVILLE, ARKANSAS REGULAR PLANNING COMMISSION MEETING APRIL 10, 2000 7:00 P.M. - 8:00 P.M. Mr. Bond stated that the LRAFB has declared the railroad as surplus, adding that efforts are being made to close the railroad located within the property. He stated that if successful the street parallel to the railroad will be relocated to the current location of the railroad. Discussion ensued as to the condition of the railroad track located on Base property and Commissioner Gray noted for that reason the plat should be considered a sketch plat which will allow flexibility versus a preliminary plat. Mr. Bond stated that modifications to the plan would be brought back to the Planning Commission, adding that the main point is approval of the geometric design so that water and sewer can be constructed. In response to a question from Chairman Brannen, Mr. Bond agreed to the acceptance as a sketch plat if the basic geometric design is approved. He stated that he would submit lot development in preliminary plat phases. Discussion ensued and it was noted that the Master Sidewalk Plan does not address industrial areas, adding that the focus was pedestrian access. It was noted that most industries secure their grounds. Chairman Brannen related that previous landscaping from the developer has been more than adequate. Commissioner Gray moved, seconded by Commissioner Hardwick to approve the plat as an overall sketch plat and a preliminary plat for lots 1, 2, 3, and 4 of Triangle Park Development. MOTION CARRIED. REQUEST TO APPROVE BUILDING PERMITS: REQUEST/STREET OR ALLEY CLOSING: GENERAL: UPDATE Landscaping Ordinance Committee Commissioner Hardwick moved, seconded by Commissioner Nabors that additional landscaping information as provided by Mr. Bond be reviewed for discussion at a later time. MOTION CARRIED. CITY OF JACKSONVILLE, ARKANSAS REGULAR PLANNING COMMISSION MEETING APRIL 10, 2000 7:00 P.M. - 8:00 P.M. Mr. Bond stated that there will be a committee meeting before the next regularly scheduled Planning Commission meeting. DRAFT ORDINANCE for Modular, Mobile and Manufactured Homes City Attorney Bamburg presented a draft of definitions regarding Manufactured, Mobile, Modular Homes and Permanent Foundation. He related that under this proposal zero lot line development will be moved to R-4, creating R-5 for Modular Homes, R-6 for Manufactured Homes and R-7 will be Mobile Home Subdivisions and R-8 is Mobile Home Parks. He said that those zoning classification will be added to the zoning table providing for the minimums or the guidelines for each zone. In response to a query from Commissioner Hardwick, City Attorney Bamburg related that mobile homes prior to 1976 were not included for placement in mobile home parks because of non-compliance with HUD guidelines. Commissioner Hardwick suggested that the verbiage pertaining to the footings being “below the frost line” be added because of requirement for financing. Discussion ensued regarding the inclusion of footing requirements in the Southern Building Code, City Engineer Reel agreed that it should be added to the “Permanent Foundation” definition. Mr. Bond said there are State laws regarding specific requirements for the anchoring and tying down of manufactured and modular homes. City Attorney Bamburg suggested that provisions could be mimicked in the ordinance table for zoning requirements along with the requirement to underpin. City Attorney Bamburg stated that he would present recommendations in ordinance form for the May regularly scheduled Planning Commission meeting. NORTHEAST PUMP STATION: Chairman Brannen noted that the Wastewater Department has provided information regarding the Northeast Pump Station which is on file for future reference. CITY OF JACKSONVILLE, ARKANSAS REGULAR PLANNING COMMISSION MEETING APRIL 10, 2000 7:00 P.M. - 8:00 P.M. RESUME AGENDA: Chairman Brannen opened the public hearing at approximately 7:40 p.m. Mr. Bart Gray Jr., related that he is the representative of Winrock Homes and ERC Properties the proposed buyers of approximately ten acres located at the corner of Woodbriar and Military Road. He related that the area is currently zoned C-2 and the conditional use request is for R-3. He related that ERC properties is a major multi-family developer, adding that information has been made available along with pictures of the type of development being proposed. He related that the site plan will be presented to the Planning Commission depicting the flow of traffic and other development plans. He stated that it would be developed in two phases with six acres in the first phase. He related that the development will be based on controlled access predominately off Military Road which would not be invasive into the Woodbriar Subdivision. He stated that it would be a major residential development of this area of Jacksonville. He related that the developer has been awarded financing considerations, but must close on the property in a timely manner to benefit from those considerations. He asked that the Planning Commission consider a special meeting for a vote that would determine the continuance of the project. Discussion ensued regarding a portion of the property zoned R-3 and Mr. Gray related that by public knowledge the property has been considered R-3, but records did not completely support that zoning which is the purpose for the request regarding the entire ten acres. Mr. Bond related that his knowledge of the history of the property occurred in the 70’s with the development of the Woodbriar Subdivision, recalling that at the time there was consideration for the proposed zoning of R-3 regarding tract B, adding that he is reasonably sure it was not carried through. He stated that Winrock has held the corner property but later discovered that it had little commercial value. In response to a question from Commissioner Hardwick, Mr. Gray related that regarding the Land Use Map the overriding matter would be zoning and allowable digressive zoning. He clarified that for example manufacturing will allow certain Commercial but will not allow for any type of residential. CITY OF JACKSONVILLE, ARKANSAS REGULAR PLANNING COMMISSION MEETING APRIL 10, 2000 7:00 P.M. - 8:00 P.M. Mr. Bond related that recently the Planning Commission had denied a commercial request regarding property adjacent to the current property. Mr. Gray clarified that the request is not to change the zoning of the property but to obtain a conditional use. Chairman Brannen closed the public hearing at approximately 7:50 p.m. Commissioner Hardwick moved, seconded by Commission Wilborn to continue the public hearing at a special scheduled Planning Commission meeting of April 13, 2000 at 12:15 p.m. to be held at City Hall, #1 Municipal Drive, Jacksonville Arkansas. MOTION CARRIED. ADDITION TO AGENDA: Commissioner Hardwick moved, seconded by Commissioner Nabors to suspend the rules and place the topic of annexation on the agenda for discussion. MOTION CARRIED. City Engineer Reel presented aerial photos regarding property for proposal to annex. He stated that the first proposal of annexation is property located to west of Jacksonville, south of the LRAFB, in the Bayou Meto-Jackson Heights area. He then stated that the second property for annexation is located south of Jacksonville, adding that there would only be six residents involved in the proposed annexation south of Jacksonville. He stated that there are no residents in the proposed west annexation. He related that Mayor Swaim has encouraged the annexation. City Attorney Bamburg related that to accomplish the annexations legal descriptions will need to be submitted to the City Council for acceptance following the Planning Commission recommendation. He related that it would then need to be filed with the County along with a request of position of adjoining governing agencies. City Engineer Reel added that it is his understanding from Mayor Swaim that if the residents do not request annexation it will require an election. CITY OF JACKSONVILLE, ARKANSAS REGULAR PLANNING COMMISSION MEETING APRIL 10, 2000 7:00 P.M. - 8:00 P.M. He related that General Properties were previously approached for sale of property; however General Properties is not interested in the sale of property and has not been interested in development because of the lack of utilities. Mr. Bond related that he thought the owner of the west property has been working on a development of that property with Mr. Ron Tyme. He stated that it appears that the south area of Wooten Road and Valentine Road will be funded for a sewer project this summer. He stated that his knowledge is that funds will be available in June. He said that the area has utilities excluding the area from Thompsons Railroad Salvage past the Cemetery which has a minimal size water line; however, Wooten Road has a six-inch water line. He then related that North Little Rock services water up to the church located on the west side of the new overpass. He stated that because of this the north bound loop road is a reasonable dividing line for the City limits. Commissioner Hardwick moved, seconded by Commission Wilborn to recommend to the City Council the separate proposed annexations of areas west of Jacksonville and south of Jacksonville with legal descriptions forthcoming. MOTION CARRIED. Discussion ensued and it was determined that there would be little or no negative impact for the City of Jacksonville regarding these annexations. He then added that as far as water rates it would be a positive impact for the residents being annexed, adding fire protection will also be a positive.
