1278 i!0t!lG038428 85/18/2886 11:12:59 A" Filed & Recorded in Official Records of PAT O'BRIEN 000:1;:':6 ~'ULASKI COUNTY CIRCUIT/COUNTY CLERK Fees $11.88 ORDINANCE NO. 1278 (#11 - 06) I AN ORDINANCE ABANDONING A PUBLIC RIGHT OF WAY ON REAL PROPERTY LOCATED IN THE REBSAMEN MEDICAL SUBDIVISION, JACKSONVILLE, ARKANSAS (GENERAL LOCATION: REAL PROPERTY LOCATED AT THE CORNER OF JOHN HARDEN DRIVE AND MARSHALL ROAD, JACKSONVILLE, ARKANSAS); AND, FOR OTHER PURPOSES. WHEREAS, an older public right of way as morerarticularly described below, which lies between previously platted lots is no longer 0 use to the City. The existing easement property is no longer needed and serves no beneficial purpose either now or in the future for the City of Jacksonville, for additional, better located easements have been granted by the affected property owner(s); WHEREAS, the Jacksonville City Council held a Rublic hearing regarding said abandonment of easement on May 4, 2006, with notice of said meeting dury pubnshed. Because additional easement(s) have previously been granted, no consent was necessary from other parties; and, WHEREAS, under State law the CiW has determined that said real property reverts to the real property owners of record, who has consented and approves of the abandonment 0 the old City easement and who, in exchange, has granted new easements. I NOW, THEREFOREL BE IT ORDAINED AND ENACTED BY THE CITY COUNCIL OF THE CITY 0... JACKSONVILLE, ARKANSAS: SECTION ONE: The Public Right-of-Way Easements being abandoned are more particularly described as follows: The East 10' of the West line of Lot 1, Rebsamen Medical Subdivision #1, as recorded in the records of Pulaski County, Arkansas in Plat Book D at Page 801. (GENERAL LOCATION: Real property located in the Haskins Commercial Subdivision at the corner of John Harden Drive and Marshall Road, Jacksonville, Arkansas) I Said Right-of-Way Easement is hereby abandoned under the powers granted to Cities of the First Class in the State of Arkansas. The Mayor and CiW CierI< are hereby duly authorized and directed to approve the appropriate documents designating the easements as described above closed and abandoned. The real property rights described herein shall revert to the current property owner, identified as Haskins Family Limited Partnership, of the real property affected in accordance with State law. SECTION TWO: A copy of this Ordinance, duly certified by the City Clerk, shall be filed in the Office of the Recorder of the County and recorded in the Deed Records of the County, hereby amending the plat recorded on November 1, 1920, in the Pulaski County Circuit Clerk Records. SECTION THREE: All Ordinances or parts thereof in conflict herewith are hereby repealed to the extent of said conflict. SECTION FOUR: This Ordinance shall take effect immediately upon passage and publication, as provided by and subject to the requirements of applicable law.
