OTHER PURPOSES.
WHEREAS, the City and the Jacksonville Water Works has certain portions of the
City's property and the Water Department's Well Fields that are in need by Magellan
Pipeline Company, L.P., for delivery of petroleum products to portions of the State,
specifically including the Little Rock Air Force Base. Representatives of the City and the
Water Department have negotiated satisfactory terms and conditions for Magellan's
requested Easements and Use Agreements of certain real property owned by the City
and the Water Department for installation, operation, and maintenance of their new
petroleum products pipeline; and,
WHEREAS, after consideration and negotiation, it is hereby found that it is in the
best interests that the City and the Jacksonville Water Works enter into Agreements and
subsequent Easements be approved for use of certain City property and Water
Department property for installation, operation, and maintenance of Magellan's new
petroleum products pipeline. Use of said property and Easements will not, as designed
and planned, be destructive and/or hazardous to the City's property nor the aquifer that
the Water Department's wells obtain water from for our public water system.
NOW. THEREFORE, BE IT RESOL VED BY THE CITY COUNCIL OF THE
CITY OFJACKSONVrLLE, ARKANSAS, THA T. -
SECTION ONE: Approval and authority is hereby granted for Easements, in
substantially the form shown on the attached drawings, between the City of Jacksonville
and the Jacksonville Water Department and Magellan Pipeline Company, L.P. Upon
recommendation and request by the Water Commission and the same by City officials
and staff, execution of Agreements with Magellan regarding the terms and conditions
upon which said Easements and Use of Property are granted that are, in the parties'
involved respective opinions, favorable to the City, the Water Department, and are vital
in continuing the mission of the United States Air Force as performed by the Little Rock
Air Force Base.
SECTION TWO., The Agreements and Easements, in substantially the form
presented at the meeting at which this Resolution is addressed, are hereby approved,

and the Mayor, the City Clerk, and the Chair of the Water Commission are requested and
authorized to execute the Agreement and Easements on behalf of the City and the
Jacksonville Water Works, with such changes as may be approved by Mayor Fletcher,
Chair Peacock, and City Attorney Bamburg consistent with the Agreements and
Easements as presented through this Resolution.
SECTION THREE: Mayor Fletcher, City Clerk Davitt, and Chair Peacock of the
Water Commission are hereby authorized to execute such documents and take such
actions as may be appropriate to carry out the terms of this Resolution.
SECTION FOUR: This Resolution, being necessary for the betterment of the
public utility and in the continuing purpose of protecting the public's health and safety,
shall be in effect from and after its date of adoption.

• Compensation for use of the Easement running adjacent to the old Rogers Road
landfill (outside of those restricted perimeters and across from the Shooting
Range) will be Eighty-nine Thousand One Hundred Dollars ($89,100.00), payable
by Magellan to the City.
Jacksonville Water Department
• Tract 6601-PU-23.1 — Water Department Pipe Easement - $4,050.00
• Governor Wells Road — Electric Easement (Entergy) -$9,540.00
• Magellan will pay all costs of decommissioning/capping/plugging Two (2) wells in
the Water Department's McCain Road Well Field. Magellan will pay directly all
relevant costs to Layne Arkansas, the Water Department's preferred contractor,
and all funds will go from Magellan directly to Layne per the specifications and
requirements of all applicable Water Department, City, State, and Federal
regulations. ed wells,
• As compensation for replacement of the Two (2) decommission
Magellan will be paying the Water Department One Hundred Eighty-three
Thousand Four Hundred Dollars ($183,400.00).
