0011 ORDINANCE NUMBER I J AN ORDINANCE TO ESTABLISH 1\ FIHE DEPARTMENT FOR TEE CITY OF JACKSONVILLE, ARKANSAS Be i.t orda.ined and ena.cted by the Ci ty Counci 1 of the City of Jacksonvi lIe, Arkansas: That the City of Jacksonville, Arkansas hereby a.grees to accept the fire station and fire fighting apparatus whioh fonnerly' was a part of the Arkansas Ordinance Pla,nt from the Jacksonville Motors, Jacksonville, Arkansas, upon tre following terms am oonditionse 1. The City of- Jackson1Jille 'Will take charge of said station and fire fighting apparatus on January 1, 1949, and keep the same in as good as or better condition tha.n they now are. 2. The City of Jackson'Tilleagrees to maintain such number of men in its fire department and such amount andkind of equipment as may be required, in order that the fire insurance rate of Jacksonville and that property forrrerly k"nown as the Arkana.s Ordnance Plant shall not be increased from the rate now in effect at such plac,.. 3- City of JacksoTlville ~uaranteos that for a peri.od of fiteen ~15) years from and after January 1, 19li.9, Jacksonville Motors, Inc., or its successor or successors, shall ~not be required to pa.y any special ta.x, assessment, or other exaction for the maintenance of the fire department, its apparatus and personnel. 4. At the end of the 15 year period, Jacksonville Motors, or its successor shall execute and deliver to the City of Jacksonv1.11e a bill of sale for said fire fighting apparatus and a special warranty deed to said fire st~tion includin~ that parcel of land no. used in opsation of the fire department. 5. If the City of Jacksonville shall fail or refuse to perform any of the conditions contai11ed herein, then and in. that event Jacksonville Motors, Inc., or its successor may i.uuuediately and without process of law take charge and possession of said fire station and apparatus and use the same for the protection of its property, and in which event Jacksonville Motors, Inc. s~hall not be liable in any amount to the City of Jacksonville. 6. If, for any reason any portion of this ordinance be held to be invalid, such invalidity shall in no way effect the remaining portions thereof which are valid, but such valid portions shall be and remain in full force and effect. 7. All ordinances or parts of ordinances in conflict here'with are hereby repealed. 8. And this ordinance being necessa.ry for the iuunediate preservation of the public peace, hea.lth and safety, an emergency is hereby declared to exist and the same sha.ll be in full force and effect iuunediately after its passage.
