ORDINANCE NO. 989 (#2-93)
AN ORDINANCE AUTHORIZING THE CITY OF JACKSONVILLE, ARKANSAS,
TO PARTICIPATE IN THE STATE OF ARKANSAS PURCHASING CONTRACTS;
WAIVING COMPETITIVE BIDDING ON ALL SUPPLIES, EQUIPMENT,
MATERIALS I AND SERVICES PURCHASED UNDER A STATE PURCHASING
CONTRACT; DECLARING AN EMERGENCY; AND, FOR OTHER PURPOSES.
WHEREAS, Arkansas' State Purchasing Law (A.C.A. Section
19-11-201) provides the opportunity for municipalities to
participate in contracts of the State of Arkansas, Department
of Finance and Administration, Office of State Purchasing, for
the purchase of supplies / services, equipment, and certain
materials at the most efficient costs available.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF JACKSONVILLE, ARKANSAS, THAT:
SECTION ONE: The City Council of the City of
Jacksonville, Arkansas, hereby requests authority in the name
of the City of Jacksonville to participate in state contracts
which the Department of Finance and Administration, Office of
State Purchasing, for the purchase of supplies, services,
equipment, and certain materials pursuant to the State
Purchasing Law and Amendment 54 to the Arkansas Constitution.
SECTION TWO: The Mayor of the City or his authorized
agent is hereby authorized to agree in the name of the City of
Jacksonville to be bound by all contract terms and conditions
as the Department of Finance and Administration, Office of
State Purchasing I prescribes. Such terms and conditions may
include a reasonable fee to cover the administrative costs
which the Department of Finance and Administration incurs as a
result of the City of Jacksonvillets participation in a
contract. Further, that the City of Jacksonville does hereby
agree to be bound by all such terms and conditions.
SECTION THREE: The Mayor of the Ci ty or his authorized
agent is hereby authorized to agree in the name of the City of
Jacksonville to pay directly any vendor, under such state
contract in which the City of Jacksonville may participate I
for items received pursuant to the contract, and that the City
of Jacksonville does hereby agree to pay directly those
vendors from which they receive said supplies, equipment,
materials, and services.
SECTION FOUR: Because of the economic savings and mini-
mal cost involved in purchasing through the State Purchasing
Contract Program, it is unfeasible and impractical to solicit
bids for those supplies / materials I equipment I and services
available through the State Purchasing Contract. As such, and
by authority granted in A.C.A. Section 14-58-383, the City of
Jacksonville authorizes the Mayor, the City Purchasing Agent,
or their duly authorized agent, to purchase and utilize those
supplies, equipment, materials, and services available under
the State Purchasing Contract program which are deemed
necessary for the efficient and effective operation of the
City of Jacksonville without requiring the necessity of
competitive bidding on the selection of those materials,
equipment, supplies, and services. As such, the competitive
bidding process will have been done by the State, and the City
of Jacksonville shall avoid any unnecessary duplication of
effort and hereby waives competitive bidding on all supplies,
materials, equipment, and services obtained through the Office
of State Purchasing.

SECTION FIVE: All Ordinances or parts of Ordinances in
conf lict herewi th are hereby repealed to the extent of said
conflict.
SECTION SIX: This Ordinance shall take effect
immediately upon its passage I as provided by and subject to
applicable law.
SECTION SEVEN: Immediate implementation of the terms of
this Ordinance are necessary to the welf are of the citizens
because efficient operation and effective governing of tax
money is vital to the sufficient administration of the City of
Jacksonville. Therefore, an emergency is hereby declared and
this Ordinance shall take effect immediately upon its passage
and publication, as provided by and subject to applicable law.
