0979 11 ORDINANCE NO. 979 (#18-92) AN ORDINANCE WAIVING COMPETITIVE BIDDING FOR THE PURPOSE OF PURCHASING CURBSIDE RECYCLING CONTAINERS FOR USE IN THE CITY OF JACKSONVILLE'S RECYCLING PROGRAM; DECLARING AN EMERGENCY; AND, FOR OTHER PURPOSES. WHEREAS, in an effort to further develop the City of Jacksonville's recycling program, as well as take advantage of Pulaski County's offer to use a curbside recycling collection trailer at no charge, the City must purchase curbside recycling containers for use by the citizens of Jacksonville; and, WHEREAS, the unusual nature and format required of these containers, as well as time constraints, require immediate purchase and delivery of such containers. After soliciting telephone bids, only one vendor can provide these containers at a cost below other bidders within a short time. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JACKSONVILLE, ARKANSAS, THAT: SECTION ONE: Competitive bidding for the purpose of purchasing curbside recycling containers for use in the City of Jacksonville~s recycling program would be costly and non- productive, making said competitive bidding unfeasible and impractical. 303 ,::) )-i) SECTION TWO: Competitive bidding is hereby waived, pursuant to Arkansas Code Annotated Section 14-58-~, to purchase curbside recycling containers for use in the City of Jacksonville's recycling program. Authorization is hereby given to the Mayor and City Clerk to enter into a purchase contract with Piper Industries of Texas, Inc., d/b/a Piper Casepro of Dallas, Texas, to purchase up to 3,300 curbside containers at a total cost of Ten Thousand Four Hundred Twenty-Eight and No/100 Dollars ($10,428.00), or $3.16 per unit cost, plus taxes. SECTION THREE: All Ordinances or parts thereof in conflict herewith are hereby repealed to the extent of said conflict.
