1530AN ORDINANCE AUTHORIZING THE MAYOR AND/OR HIS DESIGNATED
REPRESENTATIVE TO JOIN AND PARTICIPATE M THE PULASKI COUNTY
ENERGYIMPROVEMENTDISTRICT; DESIGNATING MAYOR GARYFLETCHER
AS THE CITY OF JACKSONVILLE'S INITIAL REPRESENTATIVE ON SAID
DISTRICT BOARD; AND, FOR OTHER PURPOSES.
WHEREAS, ACA § 8-15-101 et. seq., provides for development of Energy Improvement
Districts to promote Property Assessed Clean Energy (PACE), a creative funding mechanism that
will allow interested property owners to borrow money for energy efficiency, renewable energy
methodologies, and/or water conservation improvements to their property; and,
WHEREAS, under the above authorization, Pulaski County created an Energy
Improvement District on March 24, 2015. All PACE funding for Pulaski County will be
administered by said District Board. Pursuant to ACA § 8-15-106 and by joining, the City of
Jacksonville is entitled to a representative on the District's Board. As a result, the City Council
believes that Mayor Fletcher and/or his designated representative/successor should serve in that
capacity, upon confirmation and appointment by the County Judge/Quorum Court.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OFJACKSONVILLEf ARKANSAS, THAT. -
SECTION ONE: The Mayor and City Clerk are hereby authorized to enter into
a Joint Agreement between the City of Jacksonville, Pulaski County, City of Little Rock, City of
North Little Rock, City of Maumelle, City of Wrightsville, and the City of Sherwood and/or
whichever entities join the District to join and participate in the Pulaski County Energy
Improvement District.
SECTION TWO: Mayor Gary Fletcher and/or his designated
representative/successor shall be the City of Jacksonville's designated representative on the
Pulaski County Energy Improvement District Board, upon appointment by the County Judge and
confirmation by the Quorum Court.
SECTION THREE. The Mayor and Council understand and agree that Board
positions will be filled by the County Judge, his designee, Mayors or designees of municipalities
within Pulaski County that join the Board, and/or by those the County Judge appoints and the
Quorum Court confirms. The other such appointments will follow consultation of members of
the District Board, and consideration will be given to candidates' backgrounds, experience, and
expertise in the areas of municipal financing, banking, commercial lending, real estate
development, commercial construction, legal services, architecture and/or professional
engineering, knowledge of the advanced energy industry, energy efficiency, "green
building/contracting" 'and relations to local utility companies, lending or bonding institutions,
and relevant trade and economic development groups, and associations.
SECTION FOUR: Any and all other Ordinances or Resolutions in conflict
herewith are hereby repealed to the extent of said conflict. This Ordinance shall be in effect
from and after its date of passage.
