0945MW MW ORDINANCE NO. 945 AN ORDINANCE TO ADOPT A POT .UICY REGARDING PROPER DISBURSEMENT OF ALL PERSONAL PROFEl',TY OWNED BY THE CITY OF JACKSONVILLE, ARKANSAS; AND, FOR OTHER O-URPOSES. WHEREAS, the current policy and guidelines of the City of Jacksonville, Arkansas, regarding disbursement of personal property owned by the City has created controversy regarding certain distributions of said property; and, WHEREAS, such a policy is necessary to provide proper guidelines for City officials in the management and disposal of City owned personal property. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JACKSONVILLE, ARKANSAS, THAT: SECTION ONE: The City of Jacksonville, Arkansas, through its Mayor, City Clerk, Purchasing Agent, and/or its authorized agents or employees, will allow disbursement of any and all personal property owned by the City of Jacksonville, Arkansas, only through its regularly scheduled private or public auction, held on an annual basis by the Purchasing Department. No personal property of any nature owned by the City of Jacksonville will be given, bequeathed, sold, or disposed of for anything other than its fair market value through the private or public auctions regularly held by the City of Jacksonville, with the following exception: Police Department issued service revolvers shall be sold for the sum of One and 00/100 Dollars ($1.00) to those police officers who retire after a minimum of twenty (20) years of service, and/or those officers who medically retire under the rules and regulations of the Civil Service Commission, Police Pension Board, and/or the laws of the State of Arkansas. This exemption will not apply to the purchase of any service revolver if the Department replaces the current regular issued service revolver with automatic weapons. Any personal property which may be used by other City departments may be transferred from one department to another to allow for maximum benefit and use of said personal pro- perty prior to disposition of said property. SECTION TWO: The aforesaid officials are further authorized to promulgate and adopt those policies and procedures necessary to insure adoption, adherence.. and implementation of the above described policy. SECTION THREE: No provision contained in this Ordinance shall prohibit the City of Jacksonville from disposing of personal property within the means and methods allowed under the laws of the State of Arkansas. SECTION FOUR: All Ordinances or parts of Ordinances in conflict herewith are hereby repealed to the extent of such conflict.
