0943 \.tl ORDINANCE NO. 943 (#6-91) AN ORDINANCE AMENDING THE ANIMAL CONTROL ORDINANCE, SPECIFICALLY CODIFIED AS JACKSONVILLE MUNICIPAL CODE CHAPTER NO. 6.04, AND THE.INSPECTION FEES ASSESSMENTS, SPECIFICALLY CODIFIED AS JACKSONVILLE MUNICIPAL CODE SECTION 16.12.030; DECLARING AN EMERGENCY; AND, FOR OTHER PURPOSES. WHEREAS, the City of Jacksonville's Animal Control Department needs additional flexibility in its enforcement of certain terms in the Jacksonville Municipal Code; and, WHEREAS, the City of Jacksonville's Inspection Department must raise out-of-City building inspection fees because of increased costs and demands. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JACKSONVILLE, ARKANSAS, THAT: SECTION ONE. Jacksonville Municipal Code Section 6.04.010 (Definitions) shall include the following amend- ments, deletions, and additions: J . "Owner" - Any person havil1g a right of property or custody of an animal or who keeps or harbors an animal or knowingly permits an animal to remain on or about any premises ~ a Deriod Q! fifteen Llal ~ ~ lon~er and occupied by the person over which that person has substantial control. SECTION TWO. Jacksonville Municipal Code Section 6.04.070 (Cruelty to Animals) shall include the following amendments, deletions, and additions: 1. (0) abandon any animal within the corporate limits of the City of Jacksonville. Any person desiring to diBD~ Q! an unwanted, healthy animal may take the animal to the Animal Shelter and, upon relin- quishment of ownership and payment of a fee of $.5.00, full and complete authority shall be given to the Animal Shelter to make such disposition of the animal as the Shelter may deem satisfactory; Lhl Anim.als f.1:.wD. outside .t.h.e. ~ Hill n.a.t. Jacksonville Municipal Code Section 16.12.030 (Applications and Permits) shall include the following amendments, deletions, and additions: B. A $5.00 per inspection fee for any inspections given inside the city limits and a ~16.00 per inspection fee for any inspections provided outside the city limits. In the event an inspector is required to make more than one (1) visit for the purpose of reinspection of work due to violation of code rules or regula- tions, wrong address, or any other irregularities caused by the master plumber or his agents, a charge of $5.00 shall be made for each additional visit inside the city and $10.00 ~ ~ addi- tional visit outside .t.h.e. ~. [Note: Proposed amendments in bold, underscored print] ~o Ordinance No. 943 (#6-91) January , 1991 Page Two SECTION FOUR: All other terms of the specified sections within the Jacksonville Municipal Code not specifically modified herein shall remain in full force and effect and are not amended by the terms and conditions of this Ordinance except as specifically provided for herein. Because of immediate financial demands and the necessity of increasing the effectiveness of the Animal Control Department, it is imperative that the above prescribed changes be implemented immediately. Therefore, to promote public health, safety, and welfare, an emergency is hereby declared to exist and this Ordinance shall be in full force and effect from and after its date of passage.
