0597 /3f 597 ORDINANCE NO. AN ORDINANCE PROVIDING FOR THE WAIVING OF REQUIREMENTS OF COM- PETITIVE BIDDING IN EXCEPTIONAL SITUATIONS WHERE SUCH PROCEDURE IS DEEMED NOT FEASIBLE OR PRACTICAL; FOR OTHER PURPOSES AND DE- CLARING AN EMERGENCY. (FOR JACKSONVILLE WATER COMMISSION - AIR CONDITIONING UNIT FOR BILLING COMPUTER) WHEREAS, the City Council of the City of Jacksonville, deems it necessary to establish an ordinance providing for the waiving of requirements of competitive bidding in exceptional situations where such procedure is deemed not feasible or practical, and WHEREAS, Act 28 of 1959 of the General Assembly of the State of Arkansas and Ark. Stat. 19-4425 provides that the City Council may, by ordinance, waive the requirements of competitive bidding, and WHEREAS, the City Council of the City of Jacksonville deems it necessary to establish such an ordinance, and WHEREAS, the Jacksonville Water Commission of the City of Jacksonville presently has a billing computer which is not being sufficiently cooled by the air conditioners now in the building and WHEREAS, it is necessary that such billing computer be kept cool in order to operate properly, and WHEREAS, the City Council of the City of Jacksonville deems it necessary to authorize the Jacksonville Water Commission to purchase an additional air conditioner without delay, the City Council deems it necessary to waive the requirements of competitive bidding on the purchase of this air conditioner by the Jacksonville Water Commission. NOW THEREFORE, BE IT ORDAINED, BY THE CITY COUNCIL OF THE CITY OF JACKSONVILLE, ARKANSAS, that: Section 1. That the Jacksonville Water Commission is author- ized to purchase an additional air conditioner to keep the computer cool. Section 2. That the City Council of the City of Jacksonville deems it necessary to waive the requirements of competitive bidding due to the fact that such air conditioner is needed iUl1uediately to prevent the malfunction of the billing computer. Section 3. This ordinance being necessary for the iUlluediate preservation of the health, safety and morale of the citizens of the City of Jacksonville, Arkansas, an emergency is hereby declared to exist and this ordinance shall take effect immediately upon its passage and approval.
