0559 '3 ORDINANCE NO. 5 5 9 AN ORDINANCE AMENDING THE FEES FOR FIRE PROTECTION OUTSIDE THE CITY LIMITS OF JACKSONVILLE BY THE JACKSONVILLE FIRE DEPARTMENT AMENDING ORDINANCE 192, SECTION 1 OF 553 ) AND CHAPTER 2.20 OF THE MUNICIPAL CODE OF JACKSONVILLE AND FOR OTHER PURPOSES BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JACKSONVILLE, ARKANSAS, THAT: SECT'ION 1: Ordinance number 192" Section 1 of 553, and Chapter 2.20' of the Jacksonville Municipal Code are amended to read as follows: 2.20.040 2.20.050 2.20.060 Application for Outside Fire Protection - Conditions. MUtual Aid Agreements. Adoption by Reference.q 2.20.040 Application for Outside Fire Protection - Conditions. Any person, fi1111 or corporation wi thin a radius of five highway miles of any fire station of the Ci ty of Jacksonvill,e is hereby granted the privilege of applying to the Jacksonville City Council for limited fire fighting equipment protection as to property in which such person, fil.iH or corporation has an interest. The City Council, at its discretion, may approve or reject any such application. If the City Council approves an application, then the fire fighting facilities of the City of Jacksonville shall then be available to the applicant on the following conditions: (a) Agreement. An agreement shall be signed by the appli- cant, which agreement shall state that the City agrees only to furnish limited fire fighting equipment and that the applicant agrees that any portion or all of this equipment may be recalled at any time by the City when, in the judgment of the fire chief such equipment is necessary for fire protection within the City of Jacksonville. This agreement shall further provide that the City does not undertake to guarantee any fire fighting results and that" the City offers only such reasonable equipment as is consistent with conditions prevailing at the time. Further, this agreement shall state that the applicant agrees that no claims of any kind or nature shall ever be asserted against the City as a result of the use and/or operation of the fire fighting equipment. '('b) Fee. The applicant shall pay in advance to the Ci ty Collector an annual fee of $100.00, which shall be known as the "ready to serve fee", except for mobile home parks with a minimum of ten (10) mobile homes and the Valentine Road - Dick Ueter Asso- ciation which fee shall be as follows: 10-24 Mobile homes or houses - $30.00 per Mobile home or house. 25-49 Mobile homes or houses - $20.00 per Mobile home or house. 50 or More r - $iO.OOper Mobile home or house. (c) Purpose -and intent. The purpose of this ordinance is to offer service to separate properties subject to fire damage. The grouping of one or more properties shall not be allowed for the purposes of this ordinance. It is the intent of the City Council to offer limited fire fighting protection to any prop- erties not within the jurisdiction of another fire department, including volunteer fire departments. (d) Usage fee. In addition to the "ready to serve fee" provided for above, the applicant shall pay a usage fee of $100.00 per hour or fraction of an hour for each fire fighting company which responds to an ala.Lill on the premises of the applicant, whether ()0009 ,~ the alaLlli is false or comes as a result of a fire. Only one fire fighting company shall respond to an alarm on the premises of any applicant unless the applicant, personally or through an agent, requests additional companies. The City shall not be bound to dispatch any equipment unless the eqqipment is available and not needed at the time for fire fighting within the city limits. (e) Failure to Pay Fee. Failure to the applicant to pay any fee provided for above within ten days after receiving due notice from the City Collector shall have the effect of rendering void all agreements between the applicant and the City relating to fire protection. 2.20.050 Mutual Aid Agreements. The fire chief may provide mutual fire fighting aid at the request of the chief of the fire department of any incorporated city or town to ala1.111S on s'uch cities or towns. Further, the chief of the fire department ~may approve written agreements with uninco1.~orated communities within a ten-mile radius of the city limits of Jacksonville, provided such communities maintain in service quality fire fighting equipment capable of mutually aiding the City of Jacksonville. This section is intended to include volunteer fire departments within a ten-mile radius of the City of Jacksonville. 2.20.060 Adoption by Reference. This ordinance is enaated pursuant to Ark. Stat. Ann. g 19- 2106 (Repl. 1968). The provisions of Ar. Stat. Ann. ~ 19-2107 (Repl. 1968) and 19-2106.1, 2106.2 (Cum., Supp. 1977) are hereby incorporated and made applicable to the Fire Department of the City of Jacksonville and to the City of Jacksonville. SECTION 2: All ordinances before mentioned are hereby repealed to the extent of such conflict. SECTICN 3. Hvllit{GENCY CIAUSE APPROVl:ill AND ADOP'llill.
