0643 /.2) ORDINANCE NO. 6 4 3 AN ORDINANCE PROVIDING FOR THE WAIVING OF REQUIREMENTS OF COM- PETITIVE BIDDING IN EXCEPTIONAL SITUATIONS WHERE SUCH PROCEDURE IS DEEMED NOT FEASIBLE OR PRACTICAL; FOR OTHER PURPOSES AND DE- CLARING AN EMERGENCY. WHEREAS, the City Council of the City of Jacksonville, deems it necessary to establish an ordinance providing for the waiving of requirements of competitive bidding in exceptional situtations where such procedure is deemed not feasible or practical, and WHEREAS, Act 28 of 1959 of the General Assembly of the State of Arkansas and Ark. Stat. Ann. 19-4425 provides that the City Council may, by ordinance, waive the requirements of competitive bidding, and WHEREAS, the City Council of the City of Jacksonville deems it necessary to establish such an ordinance, and WHEREAS, the Jacksonville Animal Control Department is presently without an operative incinerator to dispose of the animals that have undergone euthanasia, and WHEREAS, the City Council of the City of Jacksonville deems it necessary to authorize the Jacksonville Animal Control Depart- ment to have its incinerator repaired without delay, the City Council deems it necessary to waive the requirements of competi- tive bidding. NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JACKSONVILLE, ARKANSAS, that: Section 1. That the Jacksonville Animal Control Department is authorized to have its incinerator repaired immediately. Section 2. That the City Council of the City of Jackson- ville deems it necessary to waive the requirements of competi- tive bidding due to the fact that such incinerator is needed immediately. Section 3. That this ordinance being necessary for the lm- mediate preservation of the health, safety and morale of the citizens of the City of Jacksonville, Arkansas, an emergency is hereby declared to exist and this ordinance shall take effect immediately upon its passage and approval.
